出國(guó)人員遵紀(jì)守法保證合同編號(hào)：__________出國(guó)人員遵紀(jì)守法保證甲方：__________乙方：__________1.ObligationsoftheOutgoingPersonnel1.2Theoutgoingpersonnelshallnotengageinanyactivitiesthatmaybeillegalorviolatethesocialorderanddisciplineofthedestinationcountry.1.3Theoutgoingpersonnelshallrespectthelocalcustoms,traditions,andnormsofthedestinationcountry.1.4Theoutgoingpersonnelshallnotdamagethereputationandimageoftheemployerorthedestinationcountry.2.ObligationsoftheEmployer2.1Theemployershallprovidetheoutgoingpersonnelwithnecessaryinformationandtrainingregardingthelaws,regulations,andcustomsofthedestinationcountry.2.2Theemployershallprovidetheoutgoingpersonnelwithnecessarysupportandassistanceincaseofanylegalordisciplinaryissuesarisingduringtheirstayabroad.2.3Theemployershallensurethattheoutgoingpersonnelhavevalidtraveldocumentsandnecessaryvisasorpermitstoenterandstayinthedestinationcountry.2.4Theemployershallberesponsibleforanylossesordamagescausedtheillegalordisciplinaryactionsoftheoutgoingpersonnel.3.Confidentiality3.1Theoutgoingpersonnelshallkeepallconfidentialinformationoftheemployerstrictlyconfidentialatalltimesduringandaftertheirassignmentabroad.3.2Theoutgoingpersonnelshallnotdiscloseoruseanyconfidentialinformationforpersonalgainoranyotherunauthorizedpurposes.4.GoverningLawandDisputeResolution4.1ThisagreementshallbegovernedandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.4.2Anydisputesarisingoutoforinconnectionwiththisagreementshallberesolvedthroughfriendlynegotiation.Ifthenegotiationfails,eitherpartymaysubmitthedisputetothepeople'scourtwithjurisdictionovertheplacewheretheemployerislocated.5.Miscellaneous5.1Thisagreementmaybeamendedormodifiedmutualconsentofbothpartiesinwriting.5.2Thisagreementshalltakeeffectuponthesigningbothpartiesandshallremainineffectforthedurationoftheoutgoingpersonnel'sassignmentabroad.5.3Thisagreementconstitutestheentireunderstandingbetweenthepartiesandsupersedesallprioragreements,representations,andunderstandings,whetherwrittenororal,betweentheparties.INWITNESSWHEREOF,thepartieshaveexecutedthisagreementasofthedatefirstabovewritten.PartyA:__________Representative:__________Date:__________PartyB:__________Representative:__________Date:__________一、附件列表：1.出國(guó)人員名單2.出國(guó)人員培訓(xùn)材料3.目的地國(guó)家法律法規(guī)指南4.保密協(xié)議5.出國(guó)人員行為準(zhǔn)則6.出國(guó)人員出國(guó)證明文件二、違約行為及認(rèn)定：1.違反目的地國(guó)家法律法規(guī)2.參與非法活動(dòng)或擾亂社會(huì)秩序3.泄露或不當(dāng)使用保密信息4.未遵守出國(guó)證明文件規(guī)定5.損害雇主或目的地國(guó)家聲譽(yù)形象三、法律名詞及解釋?zhuān)?.出國(guó)人員：指被甲方派遣到目的地國(guó)家工作或?qū)W習(xí)的人員。2.保密信息：指與甲方業(yè)務(wù)、技術(shù)、經(jīng)營(yíng)相關(guān)的未公開(kāi)信息。3.目的地國(guó)家：指甲方派遣出國(guó)人員前往的國(guó)家。4.法律法規(guī)：指目的地國(guó)家的法律、行政法規(guī)、規(guī)章等規(guī)范性文件。5.違約行為：指違反本合同約定的行為。四、執(zhí)行中遇到的問(wèn)題及解決辦法：1.問(wèn)題：出國(guó)人員不熟悉目的地國(guó)家法律法規(guī)解決辦法：提供充分的培訓(xùn)和指導(dǎo)，確保出國(guó)人員了解并遵守相關(guān)法律法規(guī)。2.問(wèn)題：出國(guó)人員泄露或不當(dāng)使用保密信息解決辦法：加強(qiáng)保密教育，簽訂保密協(xié)議，對(duì)違規(guī)行為進(jìn)行嚴(yán)肅處理。3.問(wèn)題：出國(guó)人員違反行為準(zhǔn)則解決辦法：加強(qiáng)行為準(zhǔn)則培訓(xùn)，強(qiáng)化責(zé)任感，對(duì)違規(guī)行為進(jìn)行嚴(yán)肅處理。4.問(wèn)題：出國(guó)人員遇到法律或disciplinaryissues解決辦法：提供必要支持和協(xié)助，與當(dāng)?shù)芈蓭熀献鹘鉀Q問(wèn)題。5.問(wèn)題：違反合
