20XX專業(yè)合同封面COUNTRACTCOVER20XX專業(yè)合同封面COUNTRACTCOVER甲方:XXX乙方:XXXPERSONALRESUMERESUME2024年度高校教學(xué)樓租賃合同(含設(shè)備維護(hù)服務(wù))本合同目錄一覽第一條合同雙方基本信息1.1甲方基本信息1.2乙方基本信息第二條教學(xué)樓租賃標(biāo)的物2.1教學(xué)樓位置及面積2.2教學(xué)樓設(shè)施設(shè)備第三條租賃期限及租金3.1租賃期限3.2租金支付方式及金額第四條租賃用途4.1甲方使用教學(xué)樓用途4.2乙方使用教學(xué)樓用途第五條設(shè)備維護(hù)服務(wù)5.1設(shè)備維護(hù)范圍5.2設(shè)備維護(hù)方式5.3設(shè)備維護(hù)費(fèi)用第六條合同雙方權(quán)利義務(wù)6.1甲方權(quán)利義務(wù)6.2乙方權(quán)利義務(wù)第七條違約責(zé)任7.1甲方違約責(zé)任7.2乙方違約責(zé)任第八條租賃合同解除8.1合同解除條件8.2合同解除程序第九條爭(zhēng)議解決方式9.1爭(zhēng)議解決途徑9.2爭(zhēng)議解決機(jī)構(gòu)第十條其他約定事項(xiàng)10.1合同生效條件10.2合同附件10.3合同變更及補(bǔ)充第十一條合同簽署及生效11.1合同簽署日期11.2合同生效日期第十二條合同解除及終止12.1合同解除條件12.2合同終止條件第十三條合同履行及變更13.1合同履行方式13.2合同變更程序第十四條合同附件14.1附件一:教學(xué)樓租賃清單14.2附件二:設(shè)備清單14.3附件三:租賃合同附件第一部分:合同如下:第一條合同雙方基本信息1.1甲方基本信息甲方名稱:大學(xué)甲方地址:省市區(qū)路號(hào)甲方法定代表人:聯(lián)系電話:138xxxx5678電子郵箱:1.2乙方基本信息乙方名稱:教育科技有限公司乙方地址:省市區(qū)路號(hào)乙方法定代表人:聯(lián)系電話:139xxxx5678第二條教學(xué)樓租賃標(biāo)的物2.1教學(xué)樓位置及面積教學(xué)樓位于大學(xué)校內(nèi),占地面積為800平方米,樓層數(shù)為5層。2.2教學(xué)樓設(shè)施設(shè)備教學(xué)樓內(nèi)設(shè)施設(shè)備包括:教室、辦公室、會(huì)議室、實(shí)驗(yàn)室、圖書館、衛(wèi)生間等,具體設(shè)備清單詳見(jiàn)附件一。第三條租賃期限及租金3.1租賃期限本合同租賃期限自2024年1月1日起至2024年12月31日止,共計(jì)12個(gè)月。3.2租金支付方式及金額租金按月支付,每月租金為人民幣10萬(wàn)元整,總計(jì)人民幣120萬(wàn)元。租金支付方式為銀行轉(zhuǎn)賬,乙方應(yīng)在每月5日前將租金匯入甲方指定賬戶。第四條租賃用途4.1甲方使用教學(xué)樓用途甲方將教學(xué)樓用于開展教育教學(xué)活動(dòng),包括但不限于課堂教學(xué)、實(shí)驗(yàn)、學(xué)術(shù)會(huì)議等。4.2乙方使用教學(xué)樓用途乙方將教學(xué)樓用于舉辦各類教育培訓(xùn)活動(dòng),包括但不限于短期培訓(xùn)、研討會(huì)、講座等。第五條設(shè)備維護(hù)服務(wù)5.1設(shè)備維護(hù)范圍甲方負(fù)責(zé)教學(xué)樓內(nèi)所有設(shè)施的日常維護(hù),包括但不限于照明、空調(diào)、電梯、消防等。5.2設(shè)備維護(hù)方式甲方應(yīng)定期對(duì)教學(xué)樓設(shè)施設(shè)備進(jìn)行檢查,發(fā)現(xiàn)問(wèn)題及時(shí)維修,確保設(shè)施設(shè)備正常運(yùn)行。5.3設(shè)備維護(hù)費(fèi)用設(shè)備維護(hù)費(fèi)用由甲方承擔(dān),具體費(fèi)用按實(shí)際發(fā)生金額計(jì)算。第六條合同雙方權(quán)利義務(wù)6.1甲方權(quán)利義務(wù)(1)甲方有權(quán)在租賃期限內(nèi)使用教學(xué)樓及其設(shè)施設(shè)備;(2)甲方應(yīng)按時(shí)支付租金;(3)甲方應(yīng)保證教學(xué)樓及其設(shè)施設(shè)備的安全,防止火災(zāi)、盜竊等事故發(fā)生;(4)甲方應(yīng)遵守國(guó)家法律法規(guī)和學(xué)校規(guī)章制度。6.2乙方權(quán)利義務(wù)(1)乙方有權(quán)在租賃期限內(nèi)使用教學(xué)樓及其設(shè)施設(shè)備;(2)乙方應(yīng)按時(shí)支付租金;(3)乙方應(yīng)遵守甲方制定的各項(xiàng)規(guī)章制度,愛(ài)護(hù)教學(xué)樓及其設(shè)施設(shè)備;(4)乙方不得擅自改變教學(xué)樓的結(jié)構(gòu)和用途。第七條違約責(zé)任7.1甲方違約責(zé)任(1)甲方未按時(shí)支付租金,每逾期一日,應(yīng)向乙方支付相當(dāng)于租金1%的違約金;(2)甲方違反合同約定,造成乙方損失的,應(yīng)承擔(dān)相應(yīng)的賠償責(zé)任。7.2乙方違約責(zé)任(1)乙方未按時(shí)支付租金,每逾期一日,應(yīng)向甲方支付相當(dāng)于租金1%的違約金;(2)乙方違反合同約定,造成甲方損失的,應(yīng)承擔(dān)相應(yīng)的賠償責(zé)任。第八條合同解除及終止8.1合同解除條件(1)甲方或乙方提前30日書面通知對(duì)方,且雙方達(dá)成書面協(xié)議同意解除合同;(2)因不可抗力導(dǎo)致合同無(wú)法履行;(3)一方違約,經(jīng)對(duì)方書面催告后,違約方在合理期限內(nèi)仍未采取補(bǔ)救措施或未履行合同;(4)合同約定的其他解除條件。8.2合同解除程序(1)一方提出解除合同,應(yīng)書面通知對(duì)方,并說(shuō)明解除合同的理由;(2)雙方應(yīng)就解除合同的后果進(jìn)行協(xié)商,達(dá)成一致意見(jiàn);(3)解除合同的通知送達(dá)對(duì)方后,合同自通知送達(dá)之日起解除。第九條爭(zhēng)議解決方式9.1爭(zhēng)議解決途徑(1)雙方應(yīng)友好協(xié)商解決爭(zhēng)議;(2)協(xié)商不成的,任何一方均可向合同簽訂地人民法院提起訴訟。9.2爭(zhēng)議解決機(jī)構(gòu)本合同爭(zhēng)議解決機(jī)構(gòu)為省市區(qū)人民法院。第十條其他約定事項(xiàng)10.1合同生效條件本合同自雙方簽字蓋章之日起生效。10.2合同附件(1)附件一:教學(xué)樓租賃清單;(2)附件二:設(shè)備清單;(3)附件三:租賃合同附件。10.3合同變更及補(bǔ)充(1)合同的變更或補(bǔ)充,應(yīng)經(jīng)雙方協(xié)商一致,并以書面形式簽訂補(bǔ)充協(xié)議;(2)補(bǔ)充協(xié)議與本合同具有同等法律效力。第十一條合同簽署及生效11.1合同簽署日期本合同自雙方簽字蓋章之日起簽署。11.2合同生效日期本合同自雙方簽字蓋章之日起生效。第十二條合同解除及終止12.1合同解除條件(1)合同約定的解除條件成就;(2)雙方協(xié)商一致解除合同;(3)法律、行政法規(guī)規(guī)定的其他解除情形。12.2合同終止條件(1)租賃期限屆滿;(2)雙方協(xié)商一致終止合同;(3)法律、行政法規(guī)規(guī)定的其他終止情形。第十三條合同履行及變更13.1合同履行方式(1)雙方應(yīng)按照合同約定履行各自的權(quán)利義務(wù);(2)任何一方違反合同約定,應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。13.2合同變更程序(1)任何一方提出變更合同,應(yīng)書面通知對(duì)方;(2)雙方應(yīng)就變更內(nèi)容進(jìn)行協(xié)商,達(dá)成一致意見(jiàn);(3)變更后的合同內(nèi)容應(yīng)以書面形式確認(rèn)。第十四條合同附件14.1附件一:教學(xué)樓租賃清單(1)教學(xué)樓名稱及編號(hào);(2)教學(xué)樓面積;(3)教學(xué)樓設(shè)施設(shè)備清單;(4)教學(xué)樓使用規(guī)則。14.2附件二:設(shè)備清單(1)設(shè)備名稱;(2)設(shè)備型號(hào);(3)設(shè)備數(shù)量;(4)設(shè)備使用說(shuō)明。14.3附件三:租賃合同附件(1)租賃雙方簽字蓋章;(2)合同簽訂日期;(3)合同簽訂地點(diǎn)。第二部分:第三方介入后的修正第一條第三方介入的概念和范圍1.1第三方定義本合同所指的第三方,是指除甲方和乙方之外的,參與本合同履行過(guò)程中的任何自然人、法人或其他組織。1.2第三方介入范圍(1)提供技術(shù)服務(wù)或咨詢服務(wù);(2)作為中介方促成本合同的簽訂或履行;(3)提供資金支持或擔(dān)保;(4)提供設(shè)備或設(shè)施;(5)其他與本合同履行相關(guān)的活動(dòng)。第二條甲乙方根據(jù)本合同有第三方介入時(shí)的額外條款2.1甲方額外條款(1)甲方應(yīng)確保第三方具備履行合同所需的資質(zhì)和能力;(2)甲方應(yīng)與第三方簽訂書面協(xié)議,明確雙方的權(quán)利義務(wù);(3)甲方應(yīng)將第三方介入情況及時(shí)通知乙方。2.2乙方額外條款(1)乙方應(yīng)配合甲方與第三方簽訂書面協(xié)議;(2)乙方有權(quán)要求甲方提供第三方資質(zhì)證明;(3)乙方有權(quán)對(duì)第三方介入的行為進(jìn)行監(jiān)督。第三條第三方的責(zé)任限額3.1第三方責(zé)任第三方在履行本合同時(shí),因自身原因造成甲方或乙方損失的,應(yīng)承擔(dān)相應(yīng)的賠償責(zé)任。3.2責(zé)任限額(1)第三方責(zé)任限額為本合同租金總額的10%;(2)如第三方責(zé)任超過(guò)責(zé)任限額,超出部分由甲方和乙方按比例承擔(dān);(3)甲方和乙方各自承擔(dān)的責(zé)任,不得超過(guò)其在本合同項(xiàng)下的總義務(wù)。第四條第三方與其他各方的劃分說(shuō)明4.1資質(zhì)責(zé)任劃分(1)第三方應(yīng)自行承擔(dān)其提供的資質(zhì)證明的真實(shí)性和合法性責(zé)任;(2)甲方和乙方對(duì)第三方提供的資質(zhì)證明不承擔(dān)任何責(zé)任。4.2服務(wù)責(zé)任劃分(1)第三方提供的技術(shù)服務(wù)或咨詢服務(wù),其質(zhì)量、安全、效果等由第三方自行負(fù)責(zé);(2)甲方和乙方對(duì)第三方提供的服務(wù)不承擔(dān)任何責(zé)任。4.3設(shè)備責(zé)任劃分(1)第三方提供的設(shè)備或設(shè)施,其質(zhì)量、安全、維護(hù)等由第三方自行負(fù)責(zé);(2)甲方和乙方對(duì)第三方提供的設(shè)備或設(shè)施不承擔(d
