9、is accurate and concrete.)二、工作內(nèi)容和工作地點Article 2, Worki ng content and place1、工作內(nèi)容:甲方安排乙方在 崗位從事工作。甲方安排乙方從事工作的內(nèi)容和要求應當符合國家制定的勞動基準。1. Working contents: Part A employs Party B to as to executeJob. The worki ng contentsand requireme nts defi ned by Party A forParty B shall comply with the working standards
10、 specified by the State.2、 工作地點:。2. Worki ng place: .3、乙方應當提高職業(yè)技能,按相關標準及甲方依法制訂并公示的勞動規(guī)章和合同約定履 行勞動義務。3. Party B shall improve occupati onal skills to fulfill the obligati ons accord ing to the releva nt sta ndards and labor regulati ons and con tract agreeme nts made and publicized by Party A accordi
11、ng to the law.三、工作時間和休息休假Article 3 worki ng hours and holidays1、工作時間:乙方的崗位實行(標準、綜合計算、不定時)工時工作制。其中,標準工 時工作制度為(常白班、 班 / 運轉工作制),每天工作8小時,每周休息日為2天 。1. 12、e refers to (regular daytime,shiftshours operati on), with 8 hour(s)/day an d2 rest day(s)/week.實行綜合計算工時工作制或不定時工時工作制的崗位(工種),應當經(jīng)甲方報經(jīng)勞動行政部門批準。The positions or disciplines applied with comprehensive calculation or non-fixed time shall be reported to the Labor Admi nistrati on for approval by Party A.2、
13、乙方享有法定休息休假權利,乙方具體休息辦法和時間按甲方規(guī)定由雙方商定。甲方 因工作需要安排乙方延長工作時間或在節(jié)假日加班的,應與工會和乙方協(xié)商同意,依法支付 加班加點工資,或按規(guī)定安排補休。2. Party B shall have the legitimate right to enjoy vacations and holidays. The detailed restmethod and time shall be n egotiated by both parties accord ing Party AIn casesFpao yiAons.may exte nd the work
14、ing hour of Party B or arra nge overtime job duri ng the holiday for Party B,Party A shall acquire the consent of labor union and Party B; over time salary or rest compensation shall be impleme nted by Party A.3、乙方休息休假期間的工資支付或扣減辦法按國家相關規(guī)定執(zhí)行。3. Salary payment or deduction method during Party B s rest
15、period or holildaseshall beon the releva nt provisi ons of state.四、勞動報酬Article 4 Labor Remun erati on1每月日為甲方工資發(fā)放日,工資發(fā)放形式為(現(xiàn)金直接發(fā)放、委托銀行發(fā)放),乙方的工資標準采用下列第()方式確定:1, Party A shall pay the wage on th day of each month with the form of (cash, bankentrustment). Overtime salary shall be calcul
17、ated as per the occupational salary standard basis.(2) 基本工資和績效工資相結合的工資分配辦法:乙方的基本工資為每月 元(實行年薪制的每月預付工資為 元);績效工資考核發(fā)放辦法按乙方的業(yè)績和甲方依法制訂的相關規(guī)定考核確定。(2) The salary compo un ded with basic salary and performa nee salary: the basic salary of Party BisRMB per mon th (the prepayme nt for annual payme nt isRMB); th
18、e performa nee salaryassessme nt method will be defi ned as per the performa nee of Party B and the releva nt evaluati on rules formulated by Party A accordi ng to the laws.(3) 計件工資制:計件工資的勞動定額管理按照甲方依法制訂的相關規(guī)定,乙方的定額單價為/ 元。甲方確定、調(diào)整勞動定額的標準應當保證本單位與乙方同崗位90%以上的勞動者在法定工作時間內(nèi)能夠完成。超過法定工作時間及標準以外勞動定額,應當按照法定加班工資的標準
19、計算計件工資。(3) Piecework salary: the quota of piecework, which isRMB/Piece, shall be defi ned as perthe releva nt provisi ons formulated by Party A accord ing the laws. The quota sta ndard defi ned or adjusted by Party A shall en sure 90% employees in the compa ny can complete the work with in the statu
20、tory working hours. The piecework wages for the working hours exceeding the statutory work ing time or quota bey ond the sta ndard shall be calculated accordi ng to the statutory overtime payme nt sta ndard.(4) 其他工資分配形式:(4) Other salary distributio n forms:2、乙方從事可能產(chǎn)生職業(yè)病危害的崗位工種、夜班勞動、高溫等作業(yè)的津貼、補貼,按國家和甲
21、方有關規(guī)定或集體合同執(zhí)行。2. In case Party B may take the positions which can cause occupational disease hazard, night shifts and high temperature operations, the compensation and subsidy shall be implemented as per the relevant regulations of state and Party A, or based on collective contract.3、甲方向乙方支付工資時,必須出具工
22、資清單,包括乙方姓名、發(fā)放時間、應付工資、 實發(fā)工資、代扣和扣減工資等項目內(nèi)容,由乙方簽字確認。3. When paying Party B, Party A shall issue salary list with the name of Party B, salary time, total pay amount, final pay amount, withholding and deduction from wages, etc. Party B shall sign the salary list for confirmation.4、甲方應當根據(jù)本單位的經(jīng)濟效益增長情況、當?shù)卣l(fā)
23、布的工資指導線、工資指導價 位等標準,通過工資集體協(xié)商以及工資正常增長制度,合理增加乙方工資報酬。4. In accordance with economic benefits growth status, the local government s wage guidand guidance wage standard, Party A shall rationally increase the wages of Party B through collective wage negotiations and wage growth system.五、社會保險Article 5 Socia
24、l Insurance1、自勞動關系建立之月起,甲乙雙方應當依法參加社會保險,按時足額申報繳納社會保 險費,其中乙方應繳納的社會保險費由甲方代扣代繳。1. Since the establishment of labor relationships, the both parties shall attend social insurance according to law, pay on time and full specified amount for each social insurance premium, in which, the Party B part of premiu
25、m shall be deducted and paid by Party A on a monthly basis for and on behalf of Party B, in accordance with the rules of China.2、甲方應當每年至少一次向本單位職工代表大會或本單位住所的顯著位置公布本單位和 個人全年社會保險費繳納情況,接受乙方監(jiān)督。2. Party A shall publicize the insurance paying status at list once a year for Party B s supervision.3、合同履行期間,乙方
26、依法享受國家規(guī)定和雙方約定的福利待遇。3. During contract performance, Party B shall legally enjoy the welfares stipulated by state regulations or both parties agreed.六、勞動保護、勞動條件和職業(yè)危害防護Article 6, labor protection, work conditions and occupational hazard protection1、甲方保證執(zhí)行國家關于特種作業(yè)、女職工和未成年工特殊保護的規(guī)定,對可能產(chǎn)生職 業(yè)病危害的崗位向乙方履行如實告知
27、義務,對乙方進行勞動安全衛(wèi)生教育,防止勞動過程中 的傷亡事故,減少職業(yè)病危害。乙方從事有職業(yè)危害作業(yè)的,甲方應當定期為乙方進行健康 檢查,并在乙方離職前進行職業(yè)健康檢查。1. Party A shall promise to implement the special protection regulations of state for specials demoperations, women or the minor. Party A shall inform Party B about all kinds of potential hazards and provide labor s
28、afety and health training to preve nt injury accide nts and occupati onal hazards. In case Party B holds the position of dangerous operation. Party A shall regularly provide Party B with health exam in ati on, and con duct occupati onal health exam in ati on before Party B2、甲方承諾,為乙方提供符合國家規(guī)定的勞動安全衛(wèi)生條件
29、和必要的勞動防護用品。乙 方應當嚴格遵守國家和甲方規(guī)定的勞動安全規(guī)程和標準。2. Party A shall promise to provide safety and healthy working conditions and labor protection equipme nt for Party B accordi ng to state regulati ons. Party B shall strictly comply with the labor safety regulati ons and sta ndards of state or Party A.3、甲方及其管理人員
30、應當保障乙方在工作場所內(nèi)的生命安全和身體健康。乙方有權拒絕 甲方管理人員違章指揮、強令冒險作業(yè),并不視為違反本合同。乙方對危害生命安全和身體 健康的行為,有權提出批評、檢舉和控告。3. Party A and its management staff shall ensure the safety and health of Party B at the working place. Party B has the right to refuse to implement the work with rule violation and forced work at risk by Party
31、 A s man ageme nt staff, without breach of the con tract hPaetyfB has the rights to criticize, expose and accuse of the un safe and un healthy behaviors.4、乙方因工作遭受事故傷害或患職業(yè)病,甲方應當負責及時救治,并按規(guī)定為乙方申請 工傷認定和勞動能力鑒定,保障乙方依法享受各項工傷保險及相關待遇。乙方患病或非因工 負傷,甲方保證其享受國家規(guī)定的醫(yī)療期和相應的醫(yī)療待遇。4. Party A shall be reliable to cure Pa
32、rty B when Party B is suffering the accident or occupati onal disease due to the work and apply the ide ntificati on of related in juries and work ability for Party B to en sure Paty B worki ng injury in sura nee and related welfare ben efit. In case Party B suffers disease or non-working injury, Pa
33、rty A shall ensure Party B has the medical treatment period and releva nt medical treatme nt stipulated by the state.七、其他約定條款Article 7 Other terms of agreeme nt1、試用期:乙方試用期自 年月日起至年月日止,試用期乙方的工資待遇為 元/月(或合同約定工資的 一Z一)。1. Probati on period: The probati on period of Party B is from(date, mon th, and year)

The salary duri ng the probati onisRMB/M on th (or% of the wage agreed)2、培訓服務期:乙方由甲方出資進行專業(yè)技術培訓的,雙方可依法約定服務期;乙方違 反服務期約定,承擔的違約金不超過服務期尚未履行部分所應分攤的培訓費用。雙方約定的 培訓和服務期協(xié)議為本合同的附件。2. Training service: in case Party B takes the professional technical training funded by Party B, the bo
35、th parties may negotiate the service time according to the law; in case Party B violate the service agreeme nt, he or she shall bear the pen alty which does not exceed the shared training cost of unfulfilled portion of service period. The training and service agreement reached by both parties shall
36、be the appe ndix of the con tract hereof.3、保密和競業(yè)限制:乙方依法負有保守甲方商業(yè)秘密和知識產(chǎn)權的義務。乙方的保密范 圍為: 見保密協(xié)議,競業(yè)限制的范圍見競業(yè)禁止承諾書,競業(yè)限制的區(qū)域為,競業(yè)限制期限為 月。競業(yè)限制期間,甲方按月向乙方支付經(jīng)濟補償元。3. Con fide ntiality and non-competiti on restrict ion: Party B shall bear the obligatio ns of thetrade secrets and in tellectual property of Party A. T

During the restricti on period, Party A shall pay Party Bfi
38、nan cial compe nsatio nofRMB by mon th.雙方約定的保密和競業(yè)限制協(xié)議為本合同附件。The con fide ntiality and non-competitio n restricti on agreeme nt reached by both parties shall be the appe ndix of the con tract hereof.4、其他(補充保險、福利待遇等)約定:4. Miscella neous (compleme ntary in sura nee, welfare etc.)(1)乙方在聘用期內(nèi),不能適應聘用的崗位要求,
39、甲方可將乙方調(diào)整至新崗位,工資待遇 按新崗位工資執(zhí)行,或解除勞動合同,但甲方不支付補償金。(1) During the employment period, in case Party B is not capable for the position, Party A may deploy Party B to the new positi on with salary based on the new positi on, or dismiss the con tract hereof without compe nsatio n for Party B.(2) 公司所有規(guī)章制度甲方已向乙
40、方充分告知,作為本合同書有效附件,具有法律效力, 雙方應自覺遵守,如乙方違反制度規(guī)定,甲方有權按制度規(guī)定進行處理。(2) Party A shall notify Party B of all of the regulations and provisions of the company which shall be the effective appe ndix of the con tract hereof with legal force. Both parties shall con sciously abide by the rules. In case Party B viola
41、tes the rules, Party A is entitled to implement punishment to Party B accord ing to the releva nt regulati ons.本合同履行過程中,若乙方的姓名、戶籍、住所、聯(lián)系電話等相關信息發(fā)生變更,乙 方需及時以書面形式通知甲方進行變更,否則由此產(chǎn)生的相關責任一律由乙方承擔。(3) During the con tract performa nee, in case of any variati ons of Party B s releva n,such as n ame, household r
42、egistratio n, address, con tact nu mbers, etc., Party B shall no tify Party A in writte n form, otherwise, the releva nt reliability shall be borne by Party B.(4) 乙方提供就業(yè)證,且體檢合格后,本合同生效。(4) Party B shall provide Employ Certificates and the con tract shall be in force after the health exam in ati on re
43、sults are acceptable.(5) 甲乙雙方應依據(jù)國務院住房公積金管理條例等有關規(guī)定繳存住房公積金,其中乙 方應繳存的住房公積金由甲方代扣代繳。(5) Both parties shall pay housing fund in accordanceof the relevant stipulations of “ House Fund Management Ordinance ” of the State Council. Party A shall deduct the relevant amount from Party B s salary for Party B s s
44、hare of housing fund.八、本合同履行過程中,若甲方變更名稱、法定代表人或者主要負責人、投資人等事項, 不影響本合同履行;若甲方發(fā)生合并或分立等情況,本合同繼續(xù)有效,由承繼單位繼續(xù)履行。Article 8 During the contract performance, Party A s variations of name, legal representative or main responsible persons, investors will not affect the contract performance; in case the merger or d
45、ivision occurs to Party A, the contract hereof remain in effect and shall be formed by the successors.涉及勞動者切身利益的條款內(nèi)容或重大事項變更時, 雙方應當協(xié)商一致, 以書面方式變更 本合同。In case of any variations about contract content or significant event related to employee s benefit, both parties shall negotiate and reach agreements t
46、o modify the contract hereof in written form.九、本合同的解除或終止,應當按照法定的條件、 程序和經(jīng)濟補償規(guī)定標準執(zhí)行。甲方違 反法律規(guī)定解除或終止本合同,按勞動合同法第四十八條規(guī)定處理。Article 9 The dissolution or termination of contract shall be implemented based on statutory conditions, procedures and the standard of financial compensation. The circumstance that th
47、e dissolution or termination of contract due to Party A s breach of law, shall be treated in accwith the article 48 of“ Labor Contract Law ”.雙方依法終止和解除勞動合同的,甲方應當自解除或終止勞動合同之日起 15 日內(nèi),辦理 完畢乙方檔案和社會保險關系轉移等手續(xù);甲方依法應當支付的經(jīng)濟補償金、醫(yī)療補助費等 相關費用,在乙方履行完交接手續(xù)時支付。In case of dissolution or termination of contract by law, Party A s
