RENT CONTENT1.1 租賃地址: 甲方將其位于的商鋪?zhàn)赓U給乙方作 商業(yè)經(jīng)營用途。甲方對所由租的商鋪具有合法產(chǎn)權(quán)、并由示 房產(chǎn)證(或具有由租權(quán)的有效證明)、身份證明等文件;乙方也應(yīng)提供身份證明文件。雙方可復(fù)印對方文件備存。所有 復(fù)印件僅供本次租賃使用,不得挪作它用。1.2 LOCATION: Part B re
3、nt the shop located on from Part A for commercial businesspurposes. The shop is the legal property owned by Part A, and showed the property ownership certificate ,identifications and other documents which needed for law; Party B should also provide identification. The two parties can copy each other

All copies can use for the rent affairs only, and can not be used for any other purpose.1.3 租賃面積:甲方租賃給乙方的商鋪建筑面積為 平方米,使用面積為 平方米。甲方將該商鋪交付乙方使 用時(shí),商鋪結(jié)構(gòu)及配套設(shè)施為:簡裝修。承租期內(nèi)乙方在不改 變和影響房屋整體結(jié)構(gòu)的前提下,可進(jìn)行裝修裝飾、對室內(nèi) 空間進(jìn)行重新劃分;若期滿不續(xù)租,其裝修材料由乙方自行 處理,若拆除,其費(fèi)用由乙方自理。1.4 AREA: The area of the shop is m2, in
5、 this area, m2 can be used. When Part A put into serviced the shop to PartB, the shop building structure and the supporting equipments was: SIMPLE DECORATION. During the rent time, Part B have the rights to decorate the shop and redistrict the space but can not change and influrence the building str
6、ucture; When the contract be expired and do not renew, Part B have allrights to handle the decorations, if dismantle the decorations, Part B pay all the cost.第二條租賃期限2. TERM OF CONTRACT2.1 租賃期限:甲乙雙方商定 ,租賃期限自年月日起至 24: 00止,共力影響導(dǎo)致的合同終止情形外,任何一方不得 破壞租賃期限的完整和連續(xù)。2.1 CONTRACT PERIOD:After both parties agreed

The period stst2.4 續(xù)租:合同期滿后,甲方如繼續(xù)由租該商鋪,則同等條件下,乙方可享有優(yōu)先承租權(quán)。乙方如有意續(xù)租,可于合同期滿前30天向甲方提由,雙方另行協(xié)商,訂立新的租賃合同。2.5 CONTRACT EXTENSION: After the contract be expired, if the shop still be able to be rent

If Part B have the mind contract be expired, after negotiated, create the new rent contract.2.6 合同的中止2.4 CONTRACT TERNIMATION2.4.1 乙方有如下情形之一時(shí),甲方有權(quán)提前中止合同,收 回商鋪:a,乙方利用該商鋪從事非法活動(dòng)或損害公共利益的;b,乙方拖欠租金超過2.4.2 Under the follow status of Part B, Part A have the rights t
10、o terminatethe contract, take back the shop: a, Part B use the shop to do the illegal or public-interests damagingactivities;2.4.3 甲方有如下情形之一時(shí),乙方有權(quán)提前中止合同:a,甲方不能提供商鋪或提供商鋪不符合條件,嚴(yán)重影響乙方正常使用;b,甲方未盡房屋修繕義務(wù),嚴(yán)重影響乙方正常使用的。2.4.4 Under the follow status of Part A, Part B have the rights to terminatethe contract:a
11、, Part A can not offer the shop or the shop mismatch conditions,seriously affect the normal using of Part B;b, Part A does not matter the obligations, seriously affect the normal use of Part B.第三條租金及其支付方式和其它費(fèi)用3. RENTAL, MODE OF PAYMENT AND OTHER CHARGES3.1 年租金總額:甲乙雙方商定,租賃期內(nèi)該商鋪的年租金為¥(大寫:人民幣 圓整),
12、合同期限內(nèi)無浮動(dòng)。3.2 TOTALOF YEAR RENTAL: After both parties negotiated, the year rental is ¥ during the contract period, and no fluctuate.3.3 租金的支付:租金按年計(jì)算,按半年收付。乙方在每半 年到期后月份的5日前將下半個(gè)年度租金以現(xiàn)金或轉(zhuǎn)帳方式 一次交付到甲方(節(jié)假日可順延)。甲方收款后應(yīng)提供給乙方有效的收款憑證。3.4 RENTAL PAYMENT: The rental calculation isANNUAL RENTAL. PartB pay the
13、 rental as CASH or BANK TRANSFER to Part A in 5th of the next month after every half year period expired in one time. Part have the obligations to offer the valid voucher to Part B.3.5 首期款的支付:訂立本合同后甲方將商鋪交付乙方 裝修時(shí),乙方一次向甲方交納相當(dāng)于租金總額10% (百分之十)共計(jì)¥ (大寫:人民幣圓整);免租期過后,乙方一次 性補(bǔ)交租金支付周期內(nèi)的當(dāng)期房租;3.6 THE MODE OF
14、 PAYMENT OF FIRSTINSTALLMENT: When Part A put into service shop to Part B for decorating after this contract be signed, Part B pay 10% of total rental in one time, it is: ¥After RENTAL-FREE PERIOD, Part B pay the remainder rental in this RENTAL PERIOD to Part A in one time;3.7 水、電費(fèi)及其他公用事業(yè)費(fèi):合同期內(nèi)
15、,政府對租賃物 征收的有關(guān)稅、費(fèi)項(xiàng),由甲方負(fù)責(zé)繳交,該商鋪的衛(wèi)生費(fèi)、電 費(fèi)、水費(fèi)及經(jīng)營活動(dòng)產(chǎn)生的一切費(fèi)用由乙方負(fù)責(zé),乙方應(yīng)如期足額繳交上述應(yīng)繳費(fèi)用,如因乙方欠費(fèi)造成向甲方追繳時(shí),甲方有權(quán)向乙方追繳。3.8 WATER,ELECTRIC AND OTHER PUBLIC UTILITYCHARGES: During contract period, Part A pay all the tax and charges, etc government revenue from the shop, and Part B pay the clean, electric, water and all t
16、he charges because the business, Part B have the obligations to pay the charges enough and on time, if Part A be disgorged from other parties cause Part B arrears, Part A have the rights to disgorge from Part B.3.9 合同簽訂時(shí)水電表使用情況:水表:噸電表:度合同簽訂時(shí)最近一期水電費(fèi)繳納憑據(jù)經(jīng)雙方簽字確認(rèn)后以 附件形式加入本合同。3.10 The status of water and

SHOP SIGN SETTING甲方同意乙方在符合國家法律、法規(guī)、政府規(guī)章和規(guī)范 性文件的前提下,在租賃商鋪的室內(nèi)外安裝設(shè)置帶有其公司 標(biāo)志的招牌等廣告裝置
18、(例如帶照明的透明廣告燈箱、立牌和戶外廣告招牌等),并協(xié)助乙方做好跟物業(yè)裝修申請、施 工以及廣告設(shè)置的交涉工作。Part A agreed Part B set the shop signs and other advertising equipments with company logo in outside of the shop comply with the state laws, regulations, government regulations and normative documents, and Part A have the obligations to assist

24、e written notice to Party A One month prior the expiry of this lease , the revised rental rate and period should be negotiated between the two parties三、租金:Rent:3.1 ,取暖,家具,電器.The rent month, including furniture, electrical appliances,management fee,heating fee.3.2 租金支付方式為年付(十二個(gè)月)一次性支付,共 計(jì)人民幣for one y
25、ear rental。3.3 租金以人民幣支付。乙方在收到甲方的付款通知后須 盡快付款,甲方收到租金后付給乙方全額收據(jù)。The rent is payable in rmb. Party B has to pay the rent as soon as possible after receiving the note of payment from Party A. Party A then should issue a reciept of the total payment to Party B.3.4 在本租約有效期內(nèi),租金不予調(diào)整。The rental cannot be adjus

28、未能如期收取租金 或因而發(fā)生費(fèi)用開支,甲方可以根據(jù)憑證扣留全部或部分押金抵付。不足部分甲方有權(quán)要求乙方賠償。If Party B breaks any part of this contract, such as not paying the rent punctually, or causing additional expenses to Party A, Party A has the right to retain part of or all of the deposit as compensation according to its actual losses. If the s
29、aid deposit is insufficient to cover Party A ' s costs, Party A has the right to ask for compensation if any.4.3 發(fā)生4.2條款情況,押金不足抵付時(shí),乙方必須按接 到甲方付款通知后十日內(nèi)補(bǔ)足。If Clause 4.2 is brought into effect, and the said deposit is insufficient to cover Party A' s costs, Party B should pay the extra amount to
30、 Party A within ten days of receipt of Party A ' s invoice notice.4.4 押金以人民幣支付。甲方收到押金后付給乙方全額收 據(jù)。The deposit is payable in RMB. Party A should issue a receipt to Party B after receiving the deposit.五、其它費(fèi)用:Other Charges:5.1乙方在租賃期內(nèi)所用的水、電、煤氣,電話等費(fèi)用由乙方繳付。Party B ' s utilities expenses during the l
31、ease termwill be paid by Party B.六、甲方的責(zé)任:Landlord ' s Responsibilities:6.1 租賃期內(nèi)甲方不得無故收回房屋,如甲方中途要求收回房屋,乙方可以拒絕。Party A is not permitted to take back the leased property during the term of the contract without any reason. If Party A wishes to do so, Party B has the right to object.6.2 負(fù)責(zé)對乙方正常使用中發(fā)生的
32、房內(nèi)家具、電器及其他設(shè)施損壞或故障進(jìn)行及時(shí)維修并承擔(dān)費(fèi)用。To undertake responsibility and assume such costs for timely repairs to furniture, electrical appliances and other facilities that are damaged or have malfunctioned through normal usage by Party B.6.3 督促物業(yè)公司提供充分的保安、消防工作及安靜清潔的居住環(huán)境。To supervise the estate management office
33、 toprovide adequate security, fire prevention and quirt circumstance.6.4 督促管理公司向乙方提供所應(yīng)提供的服務(wù),如冷水、 熱水、電的供應(yīng)及各種設(shè)備(包括空調(diào))的正常工作,并提供公共區(qū)域和 公共設(shè)施的開放,如健身房、兒童房和其他娛樂場所。督促 公共區(qū)域和公共設(shè)施的清潔;公共區(qū)域的照明并提供道路指 示牌。督促道路和公共區(qū)域的維護(hù);督促修理、保養(yǎng)和更換 大廈的保安設(shè)施、消防設(shè)施、電器設(shè)施、變壓器、煤氣、排 水、空調(diào)、電梯和其它設(shè)施。To ensure the estate manager to provide proper se
34、rvice to Party B, such as supply of cold water, hot water, electricity, proper maintenance of all kinds of equipment , and to provide free access to public areas and facilities such as gymnasium, children ' s room and other recreational areas. To clean public areas and facilities; to illuminate
35、public areas and provide signs;to repair access ways and public areas; to repair, maintain, and replace security, fire fighting and electrical appliances, transformer, gas, sewage, air conditioning systems, elevators, lifts and other facilities of the building.6.5 保證物業(yè)的合法性,保證有合法權(quán)利由租該物業(yè)。Ensure the le

Ensure its legal rights to lease the property.6.6 負(fù)責(zé)因違反上述責(zé)任而對乙方造成的所有損失的賠 償。To compensate Party B for all loss arising from any breach of the above-mentioned responsibilities.6.7 負(fù)責(zé)開通電話及寬帶,負(fù)責(zé)乙方入住前清潔室內(nèi)衛(wèi)生.七、乙方責(zé)任:Tenant' s Responsibilities:7.1 乙方應(yīng)按本租約三、四、五條款規(guī)定交付租金,押金 和
37、各項(xiàng)費(fèi)用,如有拖欠,則作違約論。Party B should promptly pay the rent, deposit and other charges as set out in Clauses 3,4 and 5of the Agreement. Non-payment of these charges constitutes a breach of this Agreement.7.2 租賃期內(nèi)未經(jīng)甲方同意,乙方不能轉(zhuǎn)租其所租房屋,私自轉(zhuǎn)讓無效。During the period of Tenancy, unless with theagreement of Party A, Pa
38、rty B cannot sub-let or let in part or in full the leased property to other Party.7.3 乙方應(yīng)愛護(hù)房屋及其設(shè)備,如因使用不當(dāng)導(dǎo)致?lián)p壞應(yīng)負(fù)責(zé)賠償。Party B must take care of the property and its contents, otherwise Party B should pay compensation to Party A for his improper use of the property.7.4 在房內(nèi)已有的裝飾和設(shè)施之外,乙方如要增加設(shè)備或其他裝修須征得甲方同意;
39、租賃期滿必須恢復(fù)原狀如有損壞(正常使用磨 損、結(jié)構(gòu)或原有的問題除外),并承擔(dān)其費(fèi)用,經(jīng)甲方驗(yàn)收 認(rèn)可后歸還甲方。In addition to the decoration and equipment already in the property, if Party B wishes to make any alterations or decorate the property, Party B should get the permission from Party A. On completion of the tenancy, Party B must hand-over the pr
40、operty to Party A in its original condition , and all fees arising from such work have to be borne by Party B.7.5 保證賠償由于乙方或乙方有關(guān)系的官員、上司、雇員、客人、來訪者、雇傭工人、代理、執(zhí)照持有者或被邀請人等(統(tǒng)稱與乙 方相關(guān)的人)的粗心及疏忽造成的房屋的損害或損失,并允 許甲方或其代理人在事先通知后進(jìn)入房屋,對房屋的損失或 損害進(jìn)行彌補(bǔ)及修復(fù),在此所發(fā)生的費(fèi)用由乙方負(fù)擔(dān)。To indemnify Party A for any loss or damage to the l
41、eased property from negligent act or omission of Party B or any officer, director, employee, guest, visitor, servant, agent licensee or in invitee of Party B , to permit Party A or his authorized representatives, with an advance notice, to enter the leased property to repair any such loss or damage
42、at the expense of Party B.7.6 在甲方預(yù)先通知后,乙方應(yīng)允許甲方或其代理人在有 理由的情況下在合理的時(shí)間進(jìn)入及巡視房屋進(jìn)行必要的維修或修復(fù)工作; 在租賃期最后一個(gè)月內(nèi),允許甲方或其代理人帶領(lǐng)有意租賃 或購買房屋的客人視察房屋,但乙方已按第2.2條書面通知甲方將續(xù)租時(shí)除外。With Party A' s notice in advance, Party B should permit Party A and the person authorized by Party A under reasonable circumstances to enter and

During the last one months of the Tenancy, Party A has the right to show theleased property to prospective lessors or purchasers, unless according to clause 2.2, Party B has informed Party
44、A of its intention to renew the Lease.7.7 在未經(jīng)甲方書面同意下,乙方不得擅自設(shè)立、 安裝或移動(dòng)設(shè)施及設(shè)備,不能擅自設(shè)立隔段,不得擅自對房屋的結(jié)構(gòu)機(jī)關(guān)改動(dòng)或 增加。Not to erect, install or remove any fixtures or partitioning, or to make any structural additions and alterations without the prior written consent of Party A.7.8 租賃房屋過程中,必須嚴(yán)格遵守中華人民共和國的有 關(guān)法律、細(xì)則、規(guī)章及法
45、令的規(guī)定,并嚴(yán)格禁止乙方利用房屋進(jìn)行違犯法 律及不道德的行為。Strictly to comply and adhere in the use of the leased property with all laws, regulations and decrees of the People ' s Republic of China applicable to such use, and specifically not to permit or suffer the leased property to be used for any purpose that is unlawf
46、ul or immoral.7.9 房屋除供乙方居住之外,未經(jīng)甲方書面同意,房屋不可作辦公或協(xié)議未曾說明之用。上述同意不應(yīng)不合理地拒絕To use the leased property exclusively as the residence of his family and not to use the leased property as an office or for any other purpose without the prior written consent or Party A , which consent shall not be ueasonably withh
47、eld.7.10 未經(jīng)甲方書面同意,屋外不得擅自放置標(biāo)示板及陳 列任何設(shè)施,不允許在房外、窗及門上桂曬衣物以影響房屋外觀面貌,該條 件不得被不合理拒絕。Not to affix or display any signboard or other device visible from outside the leased property without the prior written consent of Party A, which consent shall not be ueasonably withheld, and not to use the outside of the l
48、eased property or any doors or windows to hang any washing.7.11 租客必須遵守物業(yè)條例準(zhǔn)則,如由現(xiàn)糾紛需與業(yè)主 來協(xié)商調(diào)解。To obey the regulation is set by the management office, in case any dispute arises, the two parties shall negotiate friendly.八、房屋不能居住時(shí)其他事件:Other things:房屋由于火災(zāi),惡劣天氣,戰(zhàn)爭或其它甲方不可抗拒因 素,而不是因?yàn)橐曳街苯踊蜷g接的疏忽及故意行為造成房屋毀壞而不
49、能被正常使用及居住時(shí),乙方從該日起停止支付租金,直 至房屋可再被使用及居住時(shí)為止,如該房屋因任何不能歸因 于乙方的原因不能正常使用超過10天,乙方有權(quán)終止合同并無需承擔(dān)任何責(zé)任,甲方應(yīng)退還剩余部分押金及預(yù)付租 金。甲方根據(jù)自己的意愿及經(jīng)濟(jì)、實(shí)際意義等原因,沒有義 務(wù)必須修繕復(fù)原房屋。若此情況發(fā)生,甲方應(yīng)書面通知乙方,并在作由上述通知的十天之內(nèi)將押金及預(yù)付租金全部退還 乙方。If the leased property are substantially destroyed or damaged by fire, bad weather, war, force major, or other c
