4、One Basic Information of the Property物業(yè)類(lèi)型:標(biāo)準(zhǔn)辦公樓Type of Property: Stan dard Office Buildi ng座落位置:常熟市湖山路 99 號(hào)常熟理工學(xué)院東南校區(qū)求真樓 1 號(hào)樓Location Site: Block 1, Qiuzhen Building, SoutheastCampus, Changshu Institute of Tech nology, No.99,3Hushan Road, Cha ngshu City.管理服務(wù)類(lèi)型:求真樓 1 號(hào)樓物業(yè)管理。Type of man ageme nt servi
5、ce: Block 1 Qiuzhe n Build ing property man ageme nt二、本合同中術(shù)語(yǔ)的定義Article Two. Definition管理區(qū)域:是指 求真樓 1 號(hào)樓 區(qū)域。Management area: Block 1 Qiuzhen Building area.業(yè)主:是指物業(yè)的所有權(quán)人。Owner: Owner of the Property.管理公司:是指在物業(yè)前期由開(kāi)發(fā)商委托根據(jù)物業(yè)管理服務(wù)合同進(jìn)行專(zhuān)業(yè)管 理服務(wù)的江蘇XXXXXX服務(wù)外包(集團(tuán))有限公司。Man ageme nt compa ny: IService(Jia ngsu)Group
6、, which con ductsprofessi onal man ageme nt service pursua nt to the Property ServiceCon tract in early stage of the Property as en trusted by the developer.共用部位:是指整棟建筑內(nèi)業(yè)主所有且共同使用的部位,其中包括(但不限 于)入口、大堂、外墻、天臺(tái)、樓道、樓梯、樓梯間、電梯間、平臺(tái)、垃圾房、廁所、貨梯機(jī)房、電表房、泵房、共用倉(cāng)庫(kù)、消 防中心、電話機(jī)房、天井、水箱。Com mon Parts: Parts owned and com mo

8、 and water tank.共用設(shè)備:是指整棟建筑內(nèi)業(yè)主所有且共同使用的設(shè)備,其中包括(但不限 于)電梯系統(tǒng)、通風(fēng)系統(tǒng)、防火設(shè)備、消防系統(tǒng)、保安監(jiān)控系統(tǒng)、 給、排水系統(tǒng)、污水處理系統(tǒng)、強(qiáng)弱電系統(tǒng)等。Common equipme nts: Equipme nt owned and com monly used by allowners in the build in g, in cludi ng but not limited to elevator system,ventilation system, fire fighting system, security monitoring sy
9、stem, water supplyand drainage systems, sewage treatment system, strong and weak electricitysystems, etc.公共設(shè)施: 是指管理區(qū)域內(nèi)歸全體業(yè)主所有或共同使用的設(shè)施(共用設(shè)施除 外),其中包括(但不限于)照明路燈、排水管道、水景、窖井、 化糞池、垃圾房、配電房等設(shè)施。Common facilities: Facilities owned and commonly used by all owners in themanagement area other than share faciliti
10、es, including but not limited to road lighting,drainage pipeline, waterscape, pit well, septic tank, garbage room, distributingsubstation, etc.4公共區(qū)域:是指管理區(qū)域內(nèi)歸全體業(yè)主所有或共同使用的部位和場(chǎng)所(共用 部位除外),其中包括(但不限于)道路、綠地、停車(chē)場(chǎng)庫(kù)等部 位和場(chǎng)所。Common areas: Parts and venues owned and commonly used by all owners in themanagement ar
11、ea other than shared facilities, including but not limited to road,greenbelt, parking lot, etc.三、甲方的權(quán)利與義務(wù)Article Three Party A s Rights and Obligations 1監(jiān)督乙方管理工作的實(shí)施;Oversee the implementation of Party B s management.2. 按期支付乙方的物業(yè)管理費(fèi)用;Pay property management fee to Party B when due.3提供乙方物業(yè)管理有關(guān)所需的裝潢平面圖
12、紙、電氣線路圖、消 防驗(yàn)收批文;Provide decorating plane drawings, electric wiring diagram, fire inspection approval required inconnection with Party B s property management.4自用部位、自用設(shè)備自行負(fù)責(zé)管理、保養(yǎng)、維修或根據(jù)房屋租賃合同或XXXXXX常熟站點(diǎn)委托建設(shè)及裝修合同要求乙方保養(yǎng)、維修;Manage, maintain and repair occupied parts and private equipments or request Part
13、y B tomaintain or repair in accordancewith the House Lease Contract or Changshu Site DecorationAgreement.5. 配合乙方做好物業(yè)管理中的其它協(xié)調(diào)工作;Cooperate with Party B in other coordination work in property management.四、乙方的權(quán)利與義務(wù)Article Four Party B s Rights and Obligations1. 遵守有關(guān)法律、法規(guī)及本合同的約定 .制定詳細(xì)的物業(yè)管理工作計(jì)劃Comply with
14、 relevant laws and regulations and provisions of this Contract, and formulatespecific property management plan.2. 對(duì)業(yè)主和物業(yè)使用人有違反法律法規(guī)的行為,提請(qǐng)有關(guān)部門(mén)處理。Report to relevant authority on the violations of laws and regulations committed by propertyowners and users.3. 在求真樓 1 號(hào)樓二樓建設(shè)可同時(shí)提供 100 人同時(shí)用餐的餐廳。 甲方支付餐廳 租金并承擔(dān)
15、水電費(fèi)Build up a canteen which can seat 100 people on the Second Floor, Block 1 of the QiuzhenBuilding.54. 向業(yè)主和物業(yè)使用人書(shū)面告知物業(yè)使用的有關(guān)規(guī)定, 當(dāng)業(yè)主和物業(yè)使用人 裝修物業(yè)時(shí),書(shū)面告知有關(guān)限制條件,并負(fù)責(zé)監(jiān)督。Notify property owners and users in writing of rules in connection with property management,and notify them of relevant restrictions thereo
16、n in case property owners and users decoratethe Property, and shall be responsible for oversight thereof.五、物業(yè)管理范圍:Article Five Scope of Property Management1. 求真樓 1 號(hào)樓區(qū)域的共用部位。Common parts of Block 1 of Qiuzhen Building;2. 求真樓 1 號(hào)樓區(qū)域的共用設(shè)備。Common equipment of Block 1 of Qiuzhen Building;3. 求真樓 1 號(hào)樓區(qū)域的公
17、共設(shè)施。Common facilities of Block 1 of Qiuzhen Building;4. 求真樓 1 號(hào)樓二樓的餐廳。Canteen of 2ndFloor of Block 1 of Qiuzhen Building.六、 物業(yè)管理服務(wù)內(nèi)容:Article Six Content of Property Management Services1 求真樓外觀:完好整潔,室外設(shè)備安裝有序。Qiuzhen Building appearance: Intact and clean, orderly installation of outdoor facilities.2 公共
18、環(huán)境衛(wèi)生: Public and environmental hygiene(1) 求真樓區(qū)域道路、停車(chē)點(diǎn)及公共走道、明溝、大廳、二樓餐廳、電梯廳、照明燈具、樓道、樓梯扶手、樓道玻璃、屋面、水泵房、配電房、電梯間及電梯機(jī)房等有專(zhuān)人負(fù)責(zé)保潔。Cleaners put in place in charge of cleaning of the roads, parking spots, publicwalkways, open trenches, lobbies, 2ndfloor canteen, elevator hall, lighting, corridors,staircase rail
19、s, corridor glasses, roofing, pump room, distributing substation,elevator hoistway and elevator machine room of Qiuzhen Building area.求真樓區(qū)域做好除蟲(chóng)害工作, 每月安排專(zhuān)業(yè)除蟲(chóng)害公司來(lái)做除害工作, 必須確保求真樓里沒(méi)有老鼠等蟲(chóng)害。 (費(fèi)用由大樓業(yè)主分?jǐn)偅?)Conduct insect pest removal in the Qiuzhen Building area, for that purpose aprofessional pest removal
20、company shall be engaged to do pest removal work eachmonth to ensure there are no insect pests such as mice.(3)配備垃圾箱、做到生活垃圾每日清運(yùn)。Dust bins are provided and domestic garbage is removed each day.6(4)求真樓區(qū)域外的門(mén)前保潔,委托環(huán)衛(wèi)部門(mén)操作。Cleaning in front of the door of the Qiuzhen Building area is entrusted to the publ
21、icsanitation department.(5)真樓 1 號(hào)樓外墻每年清洗一次。 (費(fèi)用由大樓業(yè)主分?jǐn)偅〦xterior wall of Block 1 of Qiuzhen Building shall be cleaned once a year.3.公共區(qū)域安全管理:Security Management of the Public Area:( 1) 保安全天候巡邏、控制閑雜人等進(jìn)入辦公樓區(qū)域。24/7 patrol by security guards, precluding people without fixed duties from entryinto the offi
22、ce building area;( 2) 機(jī)動(dòng)車(chē)與非機(jī)動(dòng)車(chē)停放有序,保持道路暢通。Motor vehicles and non-motor vehicles park orderly to enable the road unclogged.( 3) 機(jī)動(dòng)車(chē)停車(chē)實(shí)行無(wú)償服務(wù),給予固定停車(chē)位 10 個(gè)。Motor vehicles are parked free of charge and given 10 fixed parking spaces.提供非機(jī)動(dòng)車(chē)停放,搭建停車(chē)棚供甲方使用,至少提供 200 輛自行車(chē) 的停放。車(chē)棚建造費(fèi)用由大樓業(yè)主分?jǐn)偂rovide park ing spac
23、e for non-m otor vehicles, and con struct a park ing shed forParty A, which can accommodate at least 200 bicycles.4.特約服務(wù):Special services:(1)水電費(fèi)由委托方直接支付給常熟理工學(xué)院,付款信息如下。Water and electricity fees will be paid to Changshu Institute of Tech no logy ;受益人名稱(chēng)常熟理工學(xué)院銀行帳號(hào)32201986152050594557受益銀行名稱(chēng)常熟建行城中支行(2)對(duì)于
24、房屋租賃合同或xxxxxx常熟站點(diǎn)委托建設(shè)及裝修合 同未涉及的部分,接受甲方提出的自用部位、自用設(shè)備的維 修并合理收取費(fèi)用。Accept repairs of occupied parts and private equipme nt applied by Party A forthose areas not covered in the House Lease Con tract or Chan gshu Site Decoration Agreeme nt and may charge reas on able fees thereof;(3)代辦其它方面報(bào)修項(xiàng)目。En trusted w
25、ith other repairs.5.設(shè)備運(yùn)行及維護(hù)保養(yǎng): Equipme nt operati on and maintenance7(1)由大樓業(yè)主分?jǐn)倶菂^(qū)下水道疏浚費(fèi)用,每一年疏浚二次(其中 一次搖車(chē)進(jìn)場(chǎng)),確保下水道暢通。Sewer dredg ing in the pla nt area, dredgi ng twice a year (in clud ing rock ing cart,a kind of hoist) to en sure un clogged sewer.(2)由大樓業(yè)主分?jǐn)傎M(fèi)用及時(shí)更換損壞的窨井蓋座。Promptly replace damaged pit
26、well cover.(3)對(duì)落水管道進(jìn)行日常維護(hù),確保下水暢通。Con duct rout ine maintenance of dow nspout pipe to en sure un clogged sewer.(4)由大樓業(yè)主分?jǐn)傎M(fèi)用對(duì)二級(jí)生化處理池由物業(yè)公司進(jìn)行日常疏 通、保養(yǎng)。Secon dary biochemical treatme nt pond is dredged and maintained routi nely bythe Property Compa ny.(5) 由大樓業(yè)主分?jǐn)傎M(fèi)用定時(shí)清洗水箱,保證水質(zhì)衛(wèi)生。Regularly clea n the water
27、tank to en sure water san itati on.(6) 由大樓業(yè)主分?jǐn)傎M(fèi)用定期進(jìn)行除蟲(chóng)害工作。Regularly remove in spect pests.(7) 做好配電房、水泵房日常維護(hù)、保養(yǎng)工作。Con duct routi ne maintenance and repairs of the distributi on substatio n andwater pump room.(8) 及時(shí)更換損壞的垃圾桶。Promptly replace damaged garbage bins.(9)對(duì)機(jī)動(dòng)車(chē)停車(chē)點(diǎn)定期劃線(油漆);自行車(chē)車(chē)棚維護(hù)保養(yǎng),一年 兩次定期進(jìn)行油漆
28、。Regularly do linework (paint) for vehicle parking spots; maintain and repairbike shelter, regularly paint it twice a year.(10) 對(duì)大樓內(nèi)避雷針的維護(hù)、保養(yǎng),保持暢通。對(duì)大樓區(qū)內(nèi)消防系 統(tǒng)進(jìn)行日常檢查、保養(yǎng)。Repair and maintenance of arrestors in the pla nt area to keep themoperative. Repair and maintenance of fire protection system in the
29、 plant area.(11) 由大樓業(yè)主分?jǐn)偳笳鏄?1 號(hào)樓內(nèi)公共用電、用水等費(fèi)用的支出。 Bear the expe nditure of public electricity and watercon sumpti on in Block 1 of Qiuzhe n Build ing.(12) 由大樓業(yè)主分?jǐn)偡謹(jǐn)傠娞葸\(yùn)行的操作和日常保養(yǎng)及年檢費(fèi)用。 Operati on androuti ne maintenance and annual in spect ion of elevators.(13) 由大樓業(yè)主分?jǐn)偡謹(jǐn)偝袚?dān)電梯水泵日常運(yùn)行費(fèi)用的支出。Bear the expendit
30、ure of rout ine operati on cost of elevator and water pump.(14) 急修二十分鐘到現(xiàn)場(chǎng),24 小時(shí)修理完畢。For emergency repair, arrive at the sitein 20 minutes and complete repair in 24 hours.(15) 小修當(dāng)天報(bào)修,三十分鐘到現(xiàn)場(chǎng),當(dāng)天處理,一般不超過(guò)三天。 Arrive at the site8in 30 minu tes for small repair applied on the day, make treatme nt on the ve
31、ry day,gen erally not exceedi ng 3 days.七、物業(yè)管理服務(wù)費(fèi)用及期限Article Seven Property Management Services Fees and Term1 收費(fèi)標(biāo)準(zhǔn):運(yùn)營(yíng)場(chǎng)地整體物業(yè)管理,收費(fèi)標(biāo)準(zhǔn)按建筑面積每平方米36 元人民幣/月收取。每年物業(yè)費(fèi)在上一年度基礎(chǔ)上上漲5%Rate of charge: Con duct overall property man ageme nt of the sites, the rate of chargeshall be RMB 1.5 Yua n per square meters of
32、con struct ion area per mon th;2物業(yè)管理費(fèi)按本協(xié)議及甲方委托之內(nèi)容收取,甲方按季支付管理費(fèi),Property management fee shall be collected in accordanee with this Agreement and PartyA sentrustment. Party A shall pay property man ageme nt fee on a quarterly basis.2.1真樓 1 號(hào)樓 4 樓物業(yè)費(fèi)收費(fèi)標(biāo)準(zhǔn)從xxxxxx年 5 月_1日至 2017 年 4 月 30 日;thThe rate of pro
33、perty man ageme nt fee for 4 Floor, Block 1, Qiuzhe n Buildi ng shallapply from May 1,xxxxxtcXApril 30, 2017.2.2 真樓 1 號(hào)樓 3 樓物業(yè)費(fèi)收費(fèi)標(biāo)準(zhǔn)啟用日開(kāi)始至 2017 年 4 月 30 日;rdThe rate of property man ageme nt fee for 3 Floor, Block 1, Qiuzhe n Build ing shallapply from the comme nceme nt date to April 30, 2017.2.3 服務(wù)到
34、期后如乙方選擇續(xù)租,甲方承諾在上述價(jià)格基礎(chǔ)上給予優(yōu) 惠。If upon expiration of the service Party B chooses to renew the lease, Party Aundertakes to offer favorable discounts on the basis of the above-me nti oned rate.2.4 水電價(jià)格將根據(jù)常熟市電力局、自來(lái)水公司給到常熟理工學(xué)院的價(jià) 格的變動(dòng)而變動(dòng),但不得高于常熟市電力局、自來(lái)水公司給到常熟 理工學(xué)院的價(jià)格。The rate of water and electricity shall
35、float with but shall not be higher tha n the rateChan gshu Electric Power Bureau, r unning water compa ny offers to Chan gshu Institute of Tech no logy.3.物業(yè)管理服務(wù)期限:1) Term of Property Man ageme nt Services:3.1求真樓 4 樓自xxxxxx年 5 月 1 日至 2017 年 4 月 30 日;Fourth Floor of Qiuzhe n Buildi ng, comme nces from
36、 May 1,xxxxxand expires onApril 30, 2017.3.2求真樓 3 樓自啟用日至 2017 年 4 月 30 日。Third Floor of Qiuzhen Building, commencesfrom the opening day and expires onApril 30, 2017.3.3 但如果甲方與江蘇xxxxxx服務(wù)外包(集團(tuán))有限公司9之間的租賃協(xié)議因任何原因被終止的,本協(xié)議同時(shí)終止,在本合同項(xiàng)下任何一方不需承擔(dān)違約責(zé)任。Provided, however, i n case the Lease Agreeme nt betwee n Pa
37、rty A and iService(Jiangsu) Group is terminated for any reason, this Agreement shall terminatesimultaneously, and either Party hereto shall not be liable for breach of contract to theother Party.4. 甲方收到乙方物業(yè)管理費(fèi)和水電費(fèi)通知后, 在十日內(nèi)支付。 甲方如逾期交 納管理費(fèi)、水電費(fèi),乙方可以按逾期天數(shù)每天加收應(yīng)交費(fèi)用萬(wàn)分之五的 滯納金。Upon receipt of Party B s notif
38、ication of property management fee and waterand electricity fees, Party A shall pay the same within 10 days. If Party A delays in paymentof property management fee and water and electricity fees, Party B is entitled to a penalty of0.05% of the fees for each day of delay.5. 甲方延期交付水電費(fèi)超過(guò)三個(gè)月后,滯納金則按每天千分之
39、一計(jì)收。 In case Party A delayedpayment of water and electricity fees exceeds three months the penalty rate shall be 0.1%of the fees for each day of delay.八、乙方物業(yè)維修內(nèi)容概述:Article Eight Party B s free property maintenance content overview 按國(guó)家及地方有關(guān)法規(guī)規(guī)定執(zhí)行。 (法規(guī)中未明確的,按行業(yè)標(biāo)準(zhǔn)執(zhí)行)乙 方物業(yè)為下列項(xiàng)目提供維修服務(wù),并按市場(chǎng)價(jià)收取費(fèi)用National a

(if not specified in the regulations, industrialstandards shall apply)1.外墻屋面的修繕工作。Reparation of exterior wall and roofing.2.道路損壞部分的修復(fù)工作。Recovery of damaged part of road.3.對(duì)受損的落水管進(jìn)行修繕及更新。Reparation and replacement of damaged downspout pipe.4.二級(jí)生化處理池每?jī)赡赀M(jìn)行一次內(nèi)部
41、設(shè)備更新及大、中修項(xiàng)目。The secondary biochemical treatment pond undergoes twice a year internal facilityreplacement and big and medium-repair items.5.高壓配電房每?jī)赡赀M(jìn)行一次電試。配電房?jī)?nèi)部設(shè)備更新及大、中 修項(xiàng)目。HV distributing substation undergoes twice a year electricity test. Internal facility ofthe distributing substation undergoes re
42、placement and big and medium-repair items.6.水泵房易損件的更換及大、中修項(xiàng)目。Replacement of wearing parts in the water pump room and big and medium-repairitems7.電梯零部件更換及大、中修項(xiàng)目。10Replacement of elevator main parts and big and medium-repair items8.公共走道內(nèi)墻的定期粉刷及維修。Regular whitewashing and repair in the interior wall of
43、 public sidewalks.9.園區(qū)內(nèi)所有公共管道的修繕工作。Reparation of all pubic pipes in the park.10. 消防設(shè)備設(shè)施的定期更換。Regular replacement of fire prevention equipment and facilities.九、業(yè)主和物業(yè)使用人的自用部位、自用設(shè)備的維修保養(yǎng),在甲方提出委任時(shí)乙方必須接受委托并合理收取費(fèi)用。Article Nine In case Party A makes entrustment with respect to maintenance and repairs ofoccu
44、pied locations and private equipment of property owners and property users, Party B shallaccept the entrustment and may charge reasonable fees thereof.十、其它Article Ten Miscellaneous1.雙方可對(duì)合同的條款進(jìn)行補(bǔ)充,以書(shū)面形式簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié) 議與本合同具有同等效力。The Parties thereto may sign supplementary agreements to the Agreement which
45、shall be made in writing and shall have the same force and effect as this Agreement.2.甲乙雙方在合同期內(nèi),如無(wú)法定或合同約定的理由而單方面解除本 合同視為違約,違約方應(yīng)向?qū)Ψ街Ц哆`約金。違約金以三個(gè)月的物 業(yè)管理費(fèi)為標(biāo)準(zhǔn)。During the term of the Agreement, either Partys unilateral terminationof this Agreement without legal cause or cause provided hereunder shall be deemedas breach of contract, and the defaulting Party shall pay liquidated damages in theamount of three months property management fee to the other Party3.甲方在本協(xié)議有效期內(nèi),將物業(yè)使用權(quán)或產(chǎn)權(quán)轉(zhuǎn)讓于第三方的, 本 協(xié)議的效力及于第三方。If during the term of the Agreement, Party A transfers the right of use or ownership ofthe property t
