1、o物業(yè)正式租賃合同F(xiàn)ormal Tenancy Agreement出租方姓名/名稱:(以下簡稱“甲方”)Landlord:(hereinafter referred to as "Party A")承租方姓名/名稱:(以下簡稱“乙方”)Tenant: (hereinafter referred to as "Party B")甲、乙雙方就甲方愿意出租,乙方自愿承租物業(yè)之事宜,經(jīng)雙方協(xié)商一致,同意 簽訂本物業(yè)正式租賃合約。This Agreement is made by and between Party A and Party B in connect
2、ion with rentalof property whereby this agreed as follows:1 .租賃物業(yè)名稱及地址: (以下簡稱“該物業(yè)”)2 .Name & Address of Property to be Rented:(hereinafter referred to as "the Property")3 .用途:該物業(yè)只供 使用。4 . Usage: For use only.3.面積:該物業(yè)建筑面積為 平方米。5 . Area: building area of the Property is square meters.4租賃
3、期限:由年_月_日起至_年_月一日止。其中從一年月一日到 年月一日為固定期,從¥月 日到年月日為非固定期6 . Term of Tenancy: from to inclusive. From is fixed term;from is flexible term.5.租金:租賃期租金/每月金額:乙方在收到甲方提供的稅務(wù)發(fā)票后10個(gè)工作日內(nèi)全額支付本月租金。7 . Rent: /Month. Party B shall pay monthly rent within 10 working days after the Party B has received the current
4、month Tax Invoice from Party A.8 .付租方法:6 . Method of Payment6.1 日期:乙方需于租賃期限內(nèi)每月 日之前支付,以實(shí)際居住天數(shù)支付租金。6.2 Date: Party B shall pay off the rent on or before the 1st day of each month. Therental is according to the date the Party B living.6.3 方式:乙方須以現(xiàn)金/劃帳方式支付。每_月為一期支付一次。6.4 Method: Party B shall pay off th
5、e rent by T/T or cash._month(s) as a term.7 .管理費(fèi):按有關(guān)管理部門規(guī)定之金額及方法由甲方支付。8 .Management Fee: Shall be paid by Party A according to the amount and payment methodostipulated by the related management office.9 .公用事業(yè)費(fèi):水、電、煤氣、電話費(fèi)、ADSL8. Public Utility Fee: Water, electricity, gas, telephone, ADSL.8.1 計(jì)收方法:水、
6、電、煤氣、電話費(fèi)、ADS此乙方每月按帳單支付。8.2 Payment Method: Shall be paid by Party B according to the amount of relevant bills 。8.3 甲方需為乙方開通水、電、煤氣、電話費(fèi)、ADSL8.4 Party A shall help Party B to makethe Water, electricity, gas, telephone, ADSL in normal condition.9.保證金/訂金:9. Security Deposit:9.1 于本合約簽訂后交房同時(shí),乙方須以現(xiàn)金方式支付甲方保證
7、金,共計(jì)金額人 民幣整,甲方另立收據(jù)為憑。9.2 After the signing of this Formal Tenancy Agreement and on the date of hand-over, shall be issued by Party A.Party B shall pay to Party A by cash securitydeposit that isA separate receipt10.首期租金:10. Rent In Advance:10.1 于 年 月 日之前,乙方須以現(xiàn)金/劃帳方式支付甲方首期租金, 即租賃期內(nèi)一年一月日至 _年_月一日的租金,共計(jì)金
8、額 人民幣 元整,甲方另立發(fā)票為憑。10.2 Before the date , Party B shall pay to Party A the rent in advance whichcovers Tenancy from to that is_ . A separate invoice shall be issued by Party A.11.交房日期:于一年一月日或之前11. Date of Hand-over: On or before12. 乙方之義務(wù):12. Party B's obligations:12.1 租賃期間內(nèi),該物業(yè)內(nèi)所有公用事業(yè)費(fèi),如水、電、煤氣、電話
9、費(fèi)、 ADSL 均由乙方承擔(dān)。12.2 To pay all public utility fees such as water, electricity, gas, telephone, ADSL related to the Property exclusively during the Term of Tenancy.12.3 乙方須按上述規(guī)定交付承租保證金于甲方12.4 To pay the aforesaid security deposit to Party A.12.5 乙方同意按上述規(guī)定每月按時(shí)支付租金等,如乙方逾期不付,須繳納滯納金甲方,滯納金每日按月租金百分之零點(diǎn)五(0.5
10、%)計(jì)收,逾期超過十五天的,則視作乙方自動(dòng)退租,甲方有權(quán)收回該物業(yè),乙方應(yīng)按本租約第12.9條賠償甲方損失。12.6 To pay the said rent in of on time and in the aforesaid manner without any deduction whatsoever. In case payment delayed, Party B shall pay a fine to PartyA for delaying payment which equals to 0.5 percent of monthly rental per day, andif su
11、ch default has not been cured by Party B within 15 days of notice there of from Party A. Party B shall be regarded as terminating the Tenancy and Party A shall have the right to claim losses pursuant to Article 12.9 hereunder.12.7 乙方承租物業(yè)須按規(guī)定用途使用,不可用于不合法用途。12.8 To use the Property as per usage stipul
12、ated herein only and not to use theProperty for any illegal purpose.12.9 未經(jīng)甲方書面同意,乙方不得擅自將物業(yè)轉(zhuǎn)租給第三方,或與第三方合租、 分租,但甲方不得不合理地拒絕乙方該等請(qǐng)求。12.10 Not to sublease or part with the possession of the Property without written consent of Party A and such consent however but to be unreasonably withheld.12.11 方不得在該物業(yè)內(nèi)
13、,收藏政府違禁之物品,舉凡軍械.火藥.硫磺.汽油.及揮發(fā)性之化工原料,或?qū)ξ飿I(yè)有損害的有爆炸之危險(xiǎn)的物品, 均不得陳放該物 業(yè)內(nèi)外任何地方,并應(yīng)對(duì)違反地方法規(guī)的任何行為承擔(dān)責(zé)任。12.12 Not to store arms, ammunition or unlawful goods, gun-powder, saltpeter, kerosene or any explosive or combustible substance of any damage of the said property, and to be answerable and responsible for any c
14、onsequence of any violation of local regulations.12.13 租賃期間內(nèi),乙方須正確使用該物業(yè)內(nèi)甲方所提供之家具、裝置及設(shè)備, 保持其良好,在租賃期間內(nèi),乙方不做任何裝修。物業(yè)之一切設(shè)備如因乙方疏忽而導(dǎo)致的損失,乙方須負(fù)責(zé)維修或賠償,若物業(yè)內(nèi)之設(shè)備在正常使用過程中自然 損壞,甲方須負(fù)責(zé)及時(shí)修復(fù)。12.14 To duly use the furniture, fixtures and equipments inside the Property provided by Party A and keep them in good and tenan
15、table condition and Party B will not decorate the house throughout the tenancy. In the case any damage due to Party B, Party B shall be responsible, otherwise, Party A shall be responsible for repairingon time.12.15 期內(nèi),乙方不得提前退租,如乙方提前退租,甲方有權(quán)扣除乙方之保證 金作為賠償,除此之外,甲方不得要求乙方賠償由乙方退租引起任何其他直接或 間接損失。12.16 Not t
16、o terminate the tenancy during the Term of l Tenancy, otherwise Party Ashall have right to forfeit Party B's security depositas the compensation of lossParty A may suffer. Besides the security deposit,Party A shall not claim any otherlosses directly or indirectly incurred from such early termina
17、tion.12.17 約期滿,乙方如延長租約,須在租約期滿一個(gè)月前以書面通知甲方。經(jīng)雙方協(xié)商同意,乙方可以新訂租金繼續(xù)租用該物業(yè)。12.18 To notify Party A in writing not less thanmonth before the expirationof the Term of Tenancy if Party B wish to extend the tenancy. The tenancy may be extended upon terms and conditions agreed by both parties.12.19 乙方須全面遵守有關(guān)物業(yè)管理公約
18、,履行公約所規(guī)定的各項(xiàng)義務(wù),承擔(dān)違 反公約所產(chǎn)生的責(zé)任。12.20 To perform and observe the reasonable Covenants of the related Property Management and be fully responsible and liable for breach thereof.13.甲方之義務(wù)13. Party A's Obligations:13.1 租賃期內(nèi),甲方不得無故終止合約,否則甲方需雙倍返還乙方保證金做賠償。-可編輯修改-13.2 Not to terminate the tenancy during the
19、 Term of Formal Tenancy, otherwise Party A shall refund to Party B the security fund at same time with two months as compensation.13.3 甲方須負(fù)責(zé)該物業(yè)各種結(jié)構(gòu),包括但不限于屋頂、天花板、墻壁等結(jié)構(gòu)以及各種內(nèi)外部管線等之維修并承擔(dān)維修費(fèi)用。13.4 To keep and be responsible for repairing all structure the Property including but not limited to the roof, c
20、eiling, main structure which includes walls of the Property, internal and external pipelines for electricity and water at its own cost. 13.3 在本租約簽定及甲方收到乙方保證金后,甲方按照合約之附件(標(biāo)的物業(yè) 內(nèi)家私與設(shè)備清單)提供配備家私與電器設(shè)備。13.5 To furnish the Property according to the Exhibit of the Formal Tenancy Agreement, the Furniture, Fix
21、tures & Equipment List, after the execution of this agreement and after Party A receives the security deposit from Party B.14. 如由于出現(xiàn)不可抗力的情況, 包括但不限于地震、風(fēng)暴、洪水等自然災(zāi)襲擊,而使該物業(yè)內(nèi)任何設(shè)施不能正常運(yùn)行,或水、電、煤氣、冷暖氣供應(yīng)中斷時(shí),甲乙雙方概不負(fù)責(zé)。 如果由于不可抗力無法按本租約條款履行, 受不可抗力影響的一方有權(quán)解除租約,并不負(fù)任何賠償義務(wù),保證金及租金余額應(yīng)退還乙方。14. In the case the Property
22、or any part thereof or any facilities thereof shallat any time during the Term of Tenancy be destroyed, damaged or cannot work, or inthe case the supply of water, electricity, gas, air conditioning or central heating is cut off due to the force major including but not limited to earthquake, storm, f
23、lood and etc, both parties shall be discharged of liabilities for losses due toforce major. In case of failure in performance of this agreement upon agreed conditions, the affected party by force major is entitled to terminate the tenancy without any compensation and the security deposit and the bal
24、ance of all rents shall be returned to Party B.15. 如有任何本租約下的通知,應(yīng)經(jīng)書面通知至各方上述之地址。15. Any notice under this Agreement shall be in writing and shall be sent to the address of the parties above.16. 本租約之附件,包括甲、乙雙方身份證件,甲方產(chǎn)權(quán)證,家私清單均為不可 分割的組成部分。16. The attachments, including: Party As ID card and property righ
25、ts papers of the Property, Party Bs passport, Furniture, Fixtures & Equipment List are integral parts of this Agreement and are equally enforceable.17. 本租約適用中華人民共和國法律,自甲乙雙方簽字后,雙方均應(yīng)遵守本租約規(guī)定的各項(xiàng)條款。 任何由本租約引起或與之有關(guān)糾紛,雙方不能完滿解決, 將依照中華人民共和國有關(guān)法律, 提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)上海分會(huì)根據(jù)屆時(shí)有效之仲裁規(guī)則在上海通過仲裁解決。17 . The Agreement shall be governed by and construed in accordance with the lawsof People's Republic of China (PRC). Both parties shall perform and observe theostipulations herein containe
