2、the leasedpropertyis m在租期開始三日前,出租房屋及其家俱電器應已裝修或安裝布置.2、簽訂本合同之前,甲方必須向乙方出示有關物業(yè)的房地產(chǎn)產(chǎn)權證 產(chǎn)權證編號:如不能提供該文件,甲方必須提供相關有效的可證明其物業(yè)所有權的文件。若該物業(yè)產(chǎn)權證上所有權人的名稱與此合同中甲方名稱不一致。則必須提供甲方與物業(yè)所有權人的合法租 賃協(xié)議的復印件。Prior to the execution of thisagreement, Party A shall provide toParty B the Real Estate Ownership with the No.If thisdocume

4、ed.第二條: 租期 Term of Tenancy :1、 租賃期為,自年月起至年月止。The above property is hereby leased for a term ofmon ths, comme ncing on and expiri ng on.完畢,處于可供租賃的良好狀態(tài)。The above property and its equipment and furniture shall be fully renovated or installed and in tenantable conditions three days before the commenceme

5、nt of the lease.3、租期屆滿,甲方有權收回出租房屋及全部家俱、電器,乙方亦應如期交還(附件1);乙方如要求續(xù)租,則享有優(yōu)先續(xù)租權,但必須 在本租約固定期滿前二個月向甲方提出書面申請,租金雙方另行協(xié)商;如乙方不再續(xù)租,甲方有權向新租客展示該房。On expiry of this lease, Party A has the right to take back the leased property in full, and Party B must deliver the leased property on the date of expiry (Appendix I). I

6、f Party B wishes to renew the lease after the tenancy period, Party B shall have the priority to renew the lease with two months advance written notice to Party A. The revised rental shall be negotiated between the two parties. If party B not renew the leasecontract, Party A have rights show the pro

7、perty to new tenant.第三條:租金Rent :1、租金標準人民幣 : /每月。Rent: RMB/ Per month.2、付款方式:押月付Payment method: as much as月,押金不得充抵房屋租金month(s)andmonth(s) for each payment. 8、sue a receipt uponthe receipt of deposit.甲方收款賬號如下:Party A 'bank account is as follows:銀行 Bank name:賬號 account number:賬戶名 account name:5、在本租約有效期內,租金不予調整。The rentcannot be adjusted during the term of this TenancyAgreement.第四條押金Deposit :1、本租約押金計RMB。租約期滿,乙方如不再續(xù)租,甲方應在租賃期結束后叁日內(在乙方將全部水,電,煤氣費和中央空 調費等雜費

9、及電話費付清后)將押金退還(不計利息)。如因賬期原 因,乙方承擔的全部水,電,煤氣費和中央空調費等雜費及電話費無 法在柒日內付清,甲方有權保留部分押金并在上述項目付清后返回剩余押金給乙方,但保留的押金部分不因超過上一賬期應付額的二倍 The deposit is RMBin total. Ifsuchoutstanding utilities feescouldnot be settled due to the time limit of its accoun

11、t within 7 days, Party A has the right to keep part of the deposit and pay back the balance to Party B after the outstanding utilities feeissettled. However the kept part of depositshould be limited to twice the amount of the previous billing period.2、甲方因乙方違反本合同的規(guī)定而受的損失 ,可在保證金中扣抵合 理數(shù)目,在甲方作出該種抵扣前,需通知

12、乙方將被抵扣的金額和理由 乙方有權拒絕不合理或不公正的抵扣。如果保證金不足以支付前述金 額的,不足部分乙方必須在接到甲方付款通知后 7天內補足。Party A maydeduct a reasonableamount from the security deposittowardspayment of anyactualdamages Party A mayhaveincurred or sufferedas a result of Party B'sbreach of this Agreement. Prior to makingsuchdeductions, Party A sha

13、llinform Party B of the amount, and the reason for makingsuchdeductions. Party B shall be entitled to object to suchdeductionsif Party B believesthatsuchdeductions are unreasonable or unjustified. If the security depositisnotsufficient to cover suchamounts; Party Bmust pay the deficiencywithinseven

14、(7) days of the receipt of a demand from Party A.第五條:其它費用OtherCharges :1、乙方承擔在租賃期內所用的水、電、煤氣、寬帶、有線電視,管 理公司每月按實際耗用量結算,乙方按單繳付,同時乙方承擔During the period of tenancy, Party B shallpayallmonthlycharges for usage of water, electricity, gas, broadband and cable TV based on the actualconsumptionamount, billed f

And party B shallpay 、2、 乙方所用電話,按電信局標準收費,每月根據(jù)實際用量結算,乙 方按單繳付。Alltelephonechargesshall be paid by Party B and based on the actualusageaccording to the Telecommunication Bureau standard tariffs on receipt of the bills.3、 甲方承擔在租賃期內的物業(yè)管理費,供暖費During the period of tenancy, Party

16、A shallpayproperty management fee, heatingfee、_ 第六條:甲方的責任 Landlord ' sResponsibilities :1、本租約簽訂后,甲方不得無故收回房屋。租賃期內,甲方需提前收回該房屋的,應提前30日通知乙方,將已收取的租金余額退還乙方并按月租金的%支付乙方違約金。Party A isnotpermitted to take back the leasedpropertyduring the term of contractwithoutanyreason. During the term of contract, Part

17、y A shallinform Party B 30 days in advance in case Party A needs to reclaim the premise in advance and Party A shallreturn the balance of the collected rent to Party B and pay default fine equal to% of the monthlyrent to Party B.2、 甲方應保證物業(yè)公司向乙方提供足夠的服務,如冷水、熱水、電的供應及各種設備的正常工作。甲方應負責租賃期內房屋及其設備的正常維修,并承擔維修

18、房屋及設備的正常磨損而產(chǎn)生的費用。PartyA shallensurethat the estate management officeprovidessufficient and timely service to Party B, suchassupply of cold water, hot water, electricity and ensure the propermaintenance of allkinds of equipment. Party A shall be responsible for allnormalmaintenance of the leasedprope

19、rty and equipmentduring the termlease, and Party A shall bear allmaintenancecharges.3、 甲方應對甲方的固定設施,包括該物業(yè)的結構、屋頂、管道、設施、排污、管道和纜線(包括電力及電話)等進行維護,使之處于完 好狀態(tài);如果對上述各項的造成的損壞或破壞,不是由乙方的疏忽或 不良行為造成的,則甲方在收到乙方發(fā)出的通知后7天內修理或修繕該損壞處。To maintain and keep Party A' sfixtures, including the structure,roof, sanitary and

20、plumbingfacilities, drains, pipes and cables (includingelectricity and telephone) in goodconditions. Party Ashouldpromptlyrepair or remedyanydefectsthereinafterbeingnotified of suchdefects by Party B, providedallsuchdefects are not as a result of the Party B' scarelesmistake or misconduct. Party

21、A shall do the necessary repairs or maintenancewithinsevendaysafterreceiving the notice from Party B.4、如果甲方未能在規(guī)定時間內修理,乙方可以自行請人維修,維修的費用由甲方承擔,乙方可以從應支付給甲方的房租中扣除。If Party A fail to do necessary repairs in stated time Party B shall have a third party to repair and the fee shall be borne by Party A. Party

22、 B can deduct the fee from the rent which shall be paid to Party A.(new added) 5甲方謹在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位 出租此房屋于乙方。Party A herebyrepresents and warrants that Party A is the legalowner of the leasedproperty and has the necessarylegalcapacity to lease the property to Party B.6、所有權變動:租賃期內該房屋所有權發(fā)生變動

23、的,甲方須保證本合同在乙方與新所有權人之間具有法律效力,否則視為甲方違約,甲方應向乙方承擔xxx月租金作為違約金。Transfering of theownership: In case the ownership of the premise changesduringthe leaseperiod,Party A shall guarantee that the Contractshall bekepteffectivebetween Party B and the new owner.otherwise it'deemed that Party A breach the cont

24、ract and Party A shall pay a penalty of xxx month 'rental.第七條: 乙方責任 Tenant' sResponsibilities :1、 乙方應按本租約第三、五條約定,按期交納租金及其他費用。如 乙方遲延支付,超過期限五個工作日,則甲方有權解除本租約。Party B shouldpromptlypay the rent, deposit and otherchargesas set out in Clauses 3 and 5 of the Agreement. In the eventthat Party B dela

25、ys to pay the rent for fiveworkingdays, Party A has the right to terminate the contract.2、未經(jīng)甲方書面同意,乙方不得將所租房屋分租或轉租給第三方及與第三方以任何方式共用該房屋;若出現(xiàn)上述情形,則甲方有權解除本租約,房客的家庭成員及朋友的短暫居住或拜訪除外。During the period of Tenancy, unless with writtenconsent from Party A, Party B shallnot transfer or sublease the Property in wh

26、ole or in part or in any manner whatsoever share the use thereof in common or jointly with any third party. Otherwise Party A has the right to terminate the Agreement. Thisexcludes the staying of family and friends for short term.3、 乙方應愛護房屋及其設備,如因使用不當而導致?lián)p壞,乙方應負 責賠償。Party B must take good care of the

27、 property and itscontents, otherwise Party B shouldpaycompensation to Party A for his improper use of the property.4、 除房內已有的裝飾和設施之外,乙方如要增加設備或其他裝修須 征得甲方同意。租賃期滿,乙方向甲方交還房產(chǎn)時,必須恢復其原狀(正常磨損除外)。In addition to the decoration and equipmentalready in the property, if Party B wishes to mak eany alterations or d

28、ecoration to the property, Party B should get the consent of Party A. On completion of the Lease, Party B must hand over the property to Party A in its original condition (except for its normalwear&tear).5、 在未經(jīng)甲方書面同意下,乙方不得擅自設立、安裝或移動設施及 設備,不能擅自設立隔斷,不得擅自對房屋的結構改動或增加。Not to erect, install or removea

29、nyfixtures or partitioning, or to makeanystructuraladditions and alterationswithout the priorwrittenconsent of Party A.6、 租賃房屋過程中,乙方必須遵守中華人民共和國的有關法律、細 則、規(guī)章及法令的規(guī)定,禁止利用房屋進行違反法律及不道德的行為 Party B must comply and adhere in the use of the leasedproperty according to alllaws, regulations and decrees of thePe

30、ople ' s Republic of China. The leased property is not to be used for any purposethatisunlawful or immoral.7、 房屋除供乙方居住之外,未經(jīng)甲方書面同意,房屋不可作辦公或 協(xié)議未曾說明之用。The leasedpropertyisonly for residential use. Party B shallnot use the leasedpropertyas office or some otherpurposeswithout the writtenagreement of

Please have a look.第八條:房屋不能居住時,房屋由于火災、惡劣天氣、戰(zhàn)爭或其它甲 方不可抗拒因素,而不是因為乙方直接或間接的疏忽及故意行為造成 房屋毀壞而不能被正常使用及居住時,乙方從該日起停止支付租金,直至房屋可再被使用及居住時為止。When the propertyisunfit for use or occupation, If theleasedproperty are substantiallydestroyed or damaged by fire, badweather, war, force majeure, or othercausesbeyond t

33、he control of Party A and notattributabledirectly or indirectly to the negligence or malice of Party B or are otherwiserenderedunfit for use or occupation, the rentshallcease to be payable from the date the leasedpropertybecomeunfit for use or occupationuntil the leasedpropertyshallagain be rendered

34、accessible and fit for use.第九條:本合同適用中華人民共和國法律 ;如在合同執(zhí)行過程中有爭 議,雙方應當進行協(xié)商;如協(xié)商無法解決,因本合同引起的或與本合 同有關的任何爭議,均提請華南國際經(jīng)濟貿易仲裁委員會按照該會仲 裁規(guī)則進行仲裁。仲裁裁決是終局的,對雙方均有約束力。This Contract will be interpreted in accordance with the law of the Peoples Republic of China. All disputes arising from or in connection with this Contr

35、act shall be submitted to South China International Economic and Trade Arbitration Commission for arbitration in accordance with its rules of arbitration in effect atthe time of applying for arbitration.
