14、現(xiàn)場周圍建筑物、設(shè)備管線、古樹名木不受損壞。做好施工現(xiàn)場保衛(wèi)和垃圾消納等工作，自理好由于施工帶來的擾民問題及與周圍單位（住戶）的關(guān)系。3.5施工中未經(jīng)甲方同意或有關(guān)部門批準(zhǔn)，不得隨意拆改原建筑物結(jié)構(gòu)及各種設(shè)備管線。3.6工程竣工未移甲方之前，負(fù)責(zé)對現(xiàn)場的一切設(shè)施和工程成品進(jìn)行保護(hù)。第四條 關(guān)于工期的約定4.1甲方要求比合同約定的工期提前竣工時，應(yīng)征得乙方同意，并支付乙方因趕工采取的措施費(fèi)用。4.2因甲方未按約定完成工作，影響工期，工期順延。4.3因乙方責(zé)任，不能按期開工或中途無故停工，影響工期，工期不順延。4.4因設(shè)計(jì)變更或非乙方原因造成的停電、停水、停氣及不可抗因素影響，導(dǎo)致停工8小時以上（

15、一周內(nèi)累計(jì)計(jì)算），工期相應(yīng)順延。第5條 關(guān)于工程質(zhì)量及驗(yàn)收的約定5.1本工程以施工圖紙、作法說明、設(shè)計(jì)變更和建筑裝飾工程施工及驗(yàn)收規(guī)范（JGJ73-91）、建筑安裝工程質(zhì)量檢驗(yàn)評定統(tǒng)一標(biāo)準(zhǔn)（GBJ300-88）等國家制訂的施工及驗(yàn)收規(guī)范為質(zhì)量評定驗(yàn)收標(biāo)準(zhǔn)。5.2甲方在收到乙方驗(yàn)收通知一日內(nèi)應(yīng)及時辦理隱蔽工程和中間工程的檢查與驗(yàn)收手續(xù)，甲方如不能按時參加隱蔽工程和中間工程驗(yàn)收，應(yīng)通知乙方，乙方可自行驗(yàn)收，甲方應(yīng)予承認(rèn)。若甲方要求復(fù)驗(yàn)時，乙方可按要求辦理復(fù)驗(yàn)。若復(fù)驗(yàn)合格，甲方應(yīng)承擔(dān)復(fù)驗(yàn)費(fèi)用，由此造成停工，工期順延；若復(fù)驗(yàn)不合格，其復(fù)驗(yàn)及返工費(fèi)用由乙方承擔(dān)，但工期也予順延。5.3由于甲方擔(dān)供的材料、

16、設(shè)備質(zhì)量不合格而影響工程質(zhì)量，其返工費(fèi)用由甲方承擔(dān)，工期順延。5.4由于乙方原因造成質(zhì)量事故，其返工費(fèi)用由乙方承擔(dān)，工期不順延。5.5工程竣工后，乙方應(yīng)通知甲方驗(yàn)收，甲方自接到驗(yàn)收通知 日內(nèi)組織驗(yàn)收，如不能及時驗(yàn)收需及時通知乙方，另定驗(yàn)收日期。但甲方應(yīng)承認(rèn)竣工日期，并承擔(dān)乙方的看管費(fèi)用和相關(guān)費(fèi)用。第6條 關(guān)于工程價款及結(jié)算的約定6.1雙方商定本合同價款采用第 種：1 固定價格。2 固定價格加 %包干風(fēng)險系數(shù)計(jì)算。包干風(fēng)險包括內(nèi)容 調(diào)價格：按照國家有關(guān)工程計(jì)價規(guī)定計(jì)算造價，并按有關(guān)規(guī)定進(jìn)行調(diào)整和竣工結(jié)算。6.2本合同生效后，甲方分 次全額付款，按下表約定支付工程款撥款分 次進(jìn)行撥款 %金額6.3

17、工程竣工后驗(yàn)收后，乙方提出工程結(jié)算并將有關(guān)資料送交甲方。甲方自接到上述資料經(jīng)審計(jì)后。并在 30 天內(nèi)，結(jié)清工程款。第7條 有關(guān)安全生產(chǎn)和防火的約定7.1 甲方提供的施工圖紙或作法說明，應(yīng)符合中華人民共和國消防條例和有關(guān)防火設(shè)計(jì)規(guī)范。7.2 乙方在施工期間應(yīng)嚴(yán)格遵守建筑安裝工程安全技術(shù)規(guī)程、建筑安裝工人安全操作規(guī)程、中華人民共和國消防條例和其它相關(guān)的法規(guī)、規(guī)范。7.3 由于甲方確認(rèn)的圖紙或作法說明，違反有關(guān)安全操作規(guī)程、消防條例和防火設(shè)計(jì)規(guī)范，導(dǎo)致發(fā)生安全或火災(zāi)事故，甲方或圖紙?jiān)O(shè)計(jì)單位應(yīng)承擔(dān)由此產(chǎn)生的一切經(jīng)濟(jì)損失。7.4 由于乙方在施工生產(chǎn)過程中違反有關(guān)安全操作規(guī)程、消防條例，導(dǎo)致發(fā)生安全或火災(zāi)

18、事故，乙方應(yīng)承擔(dān)由此引發(fā)的一切經(jīng)濟(jì)損失。第8條 獎勵和違約責(zé)任8.1 由于甲方原因?qū)е卵悠陂_工或中途停工，甲方應(yīng)補(bǔ)償乙方因停工、窩工所造成的損失。每停工或窩工一天，甲方支付乙方 元。甲方不按合同的約定撥付款，每拖期一天，按付款額的 %支付滯納金。8.2由于乙方原因，逾期竣工，每逾期一天，乙方支付甲方 元違約金。甲方要求提前竣工，除支付趕工措施費(fèi)外，每提前一天，甲方支付乙方 元，作為獎勵。8.3 乙方按照甲方要求，全部或部分工程項(xiàng)目達(dá)到優(yōu)良標(biāo)準(zhǔn)時，甲方需支付乙方 元，作為獎勵。8.4 乙方應(yīng)妥善保護(hù)甲方提供的設(shè)備及現(xiàn)場堆放的家具、陳設(shè)和工程成品，如造成損失，應(yīng)照價賠償。8.5 甲方未辦理任何手續(xù)

19、，擅自同意拆改原有建筑物結(jié)構(gòu)或設(shè)備管線，由此發(fā)生的損失或事故（包括罰款），由甲方負(fù)責(zé)并承擔(dān)損失。8.6 未經(jīng)甲方同意，乙方擅自拆改原建筑物結(jié)構(gòu)或設(shè)備管線，由此發(fā)生的損失或事故（包括罰款），由乙方負(fù)責(zé)并承擔(dān)損失。8.7 未辦理驗(yàn)收手續(xù)，甲方提前使用或擅自動用，造成損失由甲方負(fù)責(zé)。8.8 因一方原因，合同無法繼續(xù)履行時，應(yīng)通知對方，辦理合同終止協(xié)議，并由責(zé)任方賠償堆放由此造成的經(jīng)濟(jì)損失。第9條 爭議或糾紛處理9.1 本合同在履行期間，雙方發(fā)生爭議時，在不影響工程進(jìn)度的前提下，雙方可采取協(xié)商解決或請有關(guān)部門進(jìn)行調(diào)解。9.2 當(dāng)事人不愿通過協(xié)商、調(diào)解解決或者協(xié)商調(diào)解不成的，本合同在執(zhí)行中發(fā)生的爭議雙方
