英文英語版本正式勞動(dòng)合同勞動(dòng)合同LaborContract甲方(用人單位):PartyA(employer):性質(zhì):有限責(zé)任公司Property:LimitedLiabilityCompany地址:Address:乙方PartyB(勞動(dòng)者Laborer)姓名Name______性別Gender______年紀(jì)Age______身份證號IDNo.______________________家庭地址HomeAdd.______________________聯(lián)系電話ContactNo.______________________throughequalconsultationbetweenbothpartiesbythetermsofthiscontract一、勞動(dòng)合同限期TermoftheLaborContract英文英語版本正式勞動(dòng)合同依據(jù)《勞動(dòng)合同法》和國家有關(guān)規(guī)定,甲乙兩方經(jīng)同等磋商一致,自發(fā)簽署本合同,共同恪守本合同條款:Accordingtothe"laborcontractlaw"andtherelevantprovisionsofthestate,ment,sign’thisagreecontractvoluntarily,abide本合同限期種類為______限期合同Thetypeofthecontractis___________contract(填“有固定或無固定”此中一項(xiàng))(Fulfillterminableordateless。)本合同限期為___年Thetermofthecontractis_____years,自___年___月___日起至___年___月___日止。from____________to____________.兩方商定的試用期至___年____月____日止,限期為3個(gè)月。Thetwosidesagreedprobationperiodendson____________,3months'duration表現(xiàn).優(yōu)秀者,甲方可縮短試用期,但不可以少于1個(gè)月。Fortheoutstandinglaborer,theprobationperiodcanbeshortenedbyPartyA,butnolessthan1month.以達(dá)成必定工作為限期:Basedonafixedworkingterm:從___年___月___日起,就任務(wù)達(dá)成時(shí)止。startingfrom_____________untilthetaskisfinished.二、工作內(nèi)容和義務(wù)JobContentandResponsibility1、乙方贊同依據(jù)甲方工作需要,AccordingtoPartyA’sdemand,在部門,從事______(管理、銷售、技術(shù)、生產(chǎn)、后勤等)工作,并恪守崗位工作制度與合理的工作安排(包含但不限于工作內(nèi)容、工作地址)。PartyBagreestoengagein__________(management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(Includedbutunlimitedtojobcontent&workingplace.)2、乙方應(yīng)該依照甲方崗位職責(zé)要求,保質(zhì)保量達(dá)成工作任務(wù);AccordingtoPartyA’spostresponsibilityrequirement,PartyBshouldfinishworkingtaskwithqualityandquantityguaranteed.3、甲方本著“一專多能、一職多崗”的用人原則,能夠依據(jù)經(jīng)營需要及乙方的工作能力調(diào)整乙方的工作職務(wù)和崗位,乙方應(yīng)聽從安排。Basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework”,andaccordingtothebusinessdemandandParty’Bscompetence,PartyAmayadjustPartyB’sdutyandpost,whilePartyBshouldobeytheadjustment.三、勞動(dòng)保護(hù)和勞動(dòng)條件LaborProtection&LaborCondition1、甲方依據(jù)國家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生的規(guī)定,為乙方供給必需的工作條件和勞動(dòng)保護(hù)設(shè)備,保障乙方的安全與健康;Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,PartyAprovidesnecessaryworkingconditionandlaborprotectionfacilities,insuringParty’Bssafetyandhealth.2、甲方依據(jù)國家有關(guān)規(guī)定擬訂工時(shí)制度,乙方確因生產(chǎn)經(jīng)營需要延時(shí)的,甲方應(yīng)該依法安排乙方補(bǔ)休或支付相應(yīng)的加班費(fèi);若乙方推行的是級別薪資,則在當(dāng)月的績效查核中表現(xiàn);Accordingtotherelevantregulationsofworkinghoursystem,ifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyAshallarrangepartyBcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、甲方依據(jù)國家有關(guān)規(guī)定為孕期、產(chǎn)期、哺乳期的女員工供給勞動(dòng)保護(hù);PartyAshould英文英語版本正式勞動(dòng)合同provideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththerelevantprovisionsoftheState.4、甲方負(fù)責(zé)對乙方進(jìn)行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動(dòng)安全衛(wèi)生及有關(guān)規(guī)章制度的告知、教育和培訓(xùn)。PartyAisresponsibletoprovidepoliticalideology,professionalethics,businesstechnology,laborsafetyandhygiene,andrelatedrules,educationandtrainingforPartyB.四、勞動(dòng)酬勞Laborremuneration依據(jù)“按勞分派”原則,推行同工同酬,乙方的酬勞不得低于當(dāng)?shù)刈畹托劫Y標(biāo)準(zhǔn)。詳細(xì)薪酬標(biāo)準(zhǔn)、支付方式以及支付時(shí)間按公司擬訂的《薪酬管理制度》執(zhí)行。Accordingtotheprincipleofdistribution,andequalpayforequalwork,remunerationofPartyBshallnotbelowerthanthelocalminimumwagestandard.Specificcompensationstandards,payment,andtimeissetbythecompensationmanagementbythe”company五、社會(huì)保險(xiǎn)SocialInsurance甲方應(yīng)依照國家有關(guān)社會(huì)保險(xiǎn)的法律、法例和政策為乙方繳納基本養(yǎng)老、基本醫(yī)療、失業(yè)、工傷、生育保險(xiǎn)花費(fèi);社會(huì)保險(xiǎn)費(fèi)個(gè)人繳納部分,甲方從乙方薪資中代扣代繳。Inaccordancewithnationallaws,regulationsandpoliciesrelatingtosocialinsurance,PartyAshallpaythebasicpension,basicmedical,unemployment,workinjuryandmaternityinsurancecosts,forthePartyB;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfromPartyB.六、勞動(dòng)紀(jì)律和規(guī)章制度Labordisciplineandregulations1、甲方依法擬訂的勞動(dòng)紀(jì)律和規(guī)章制度,乙方有義務(wù)恪守;LabordisciplineandregulationslegallystipulatedbypartyA,partyBshallhavethedutytoabidebyit.2、簽署本合同前,甲方已對乙方進(jìn)行了勞動(dòng)紀(jì)律、操作規(guī)程、管理制度等相應(yīng)的培訓(xùn);Beforesigningthiscontract,PartyAhastoprovidepartyBthelabordiscipline,operatingprocedures,managementsystemandthecorrespondingtraining3、乙方應(yīng)該恪守甲方的工作操作規(guī)程,聽從工作安排;PartyBshallabidebytheworkingprocedures,obeytheworkarrangementofpartyA.4、乙方違犯勞動(dòng)紀(jì)律或規(guī)章制度,甲方有權(quán)按本單位的規(guī)章制度,賜予紀(jì)律處罰,直至排除本合同。IfPartyBviolateslabordisciplineorregulations,PartyAisentitledbytherulesoftheunittogivePartyAdisciplinaryaction,uptoterminatethiscontract.七、勞動(dòng)合同的更改Thechangeoflaborcontract訂立本合同所依照的客觀狀況發(fā)生重要變化,以致本合同沒法持續(xù)執(zhí)行的,經(jīng)兩方磋商贊同,予以更改勞動(dòng)合同有關(guān)內(nèi)容。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,bymutualconsent,relatedcontentinlaborcontractsshallbechanged.八、勞動(dòng)合同的排除Theremoveoflaborcontract(一)兩方磋商一致,勞動(dòng)合同能夠排除。Thetwopartymayterminatethelaborcontractwithmutualagreement.(二)乙方有以下情況之一的,甲方能夠即行排除勞動(dòng)合同:Ofanyofthefollowingcircumstances,partyAmayimmediatelyterminatethelaborcontract.英文英語版本正式勞動(dòng)合同1、在試用期內(nèi)被證明不切合錄取條件的;Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采納欺騙手段訂立本合同的;Adoptedfraudulentmeanstoenterintothiscontract.3、嚴(yán)重違犯勞動(dòng)紀(jì)律或規(guī)章制度給甲方造成重要傷害的;SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.4、嚴(yán)重瀆職、徇私作弊,或泄漏甲方商業(yè)奧密,給甲方利益造成重要損失的;Grossnegligence,malpractice,ordisclosureoftradesecretsPartyA,tocauseheavylossestotheinterestsofthePartyA.5、乙方同時(shí)與其余用人單位成立勞動(dòng)關(guān)系,對達(dá)成本單位的工作任務(wù)造成嚴(yán)重影響,或許經(jīng)用人單位提出,拒不更正的;PartyAbuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orefusedtocorrecttherulesmadebytheemployer6、被依法追查刑事責(zé)任的。Beinvestigatedforcriminalresponsibilityaccordingtolaw(三)有以下情況之一的,甲方能夠提早30日以書面形式通知乙方排除勞動(dòng)合同:Ofthefollowingcircumstances,PartyAcangivenoticetoinformPartyBtoterminatethelaborcontractaheadof30days.1、乙方不可以勝任工作,經(jīng)培訓(xùn)或調(diào)整工作崗位仍不可以勝任工作的;PartyBisnotcompetentforwork,aftertrainingoradjustmentofjobs.2、乙方生病或許非因工負(fù)傷,醫(yī)療期滿后,不可以從事原工作,也不可以從事甲方另行安排工作的;PartyBwasillorinjuredduetonon-workrelation,aftercompletionofmedical,PartAisnotcompetentforhisoriginalwork,oralternativearrangedjobs.3、勞動(dòng)合同訂即刻所依照的客觀狀況發(fā)生重要變化,以致勞動(dòng)合同沒法執(zhí)行,兩方磋商不可以就更改勞動(dòng)合同達(dá)成協(xié)議的。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.(四)有以下情況之一的,甲方能夠提早30日通知工會(huì),經(jīng)工會(huì)贊同后,與乙方排除勞動(dòng)合同:Ofthefollowingcircumstances,PartyAcangivenoticeaheadof30days,toinformtheLaborUnion,afteragreement,PartyAmayterminatethelaborcontract.1、甲方依照公司破產(chǎn)法例定進(jìn)行重整的;PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw2、甲方生產(chǎn)經(jīng)營發(fā)生嚴(yán)重困難的;ProductionandbusinessoperationofPartyAmetseriousdifficulties.3、甲方轉(zhuǎn)產(chǎn)、重要技術(shù)改革或許經(jīng)營方式調(diào)整,經(jīng)更改勞動(dòng)合同后,仍需裁汰人員的;production,technologicalinnovationorbusinessmethodofPartyAadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其余因勞動(dòng)合同訂即刻依照的客觀經(jīng)濟(jì)狀況發(fā)生重要變化,以致勞動(dòng)合同沒法執(zhí)行的。Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.(五)乙方有以下情況之一的,甲方不得排除勞動(dòng)合同:Ofanyofthefollowingcircumstances,partyAcannotterminatethelaborcontract.1、在本單位患職業(yè)病或許因工負(fù)傷并被確認(rèn)喪失或許部分喪失勞動(dòng)能力的;Injureddueto英文英語版本正式勞動(dòng)合同occupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、生病或許非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的;Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女員工在孕期、產(chǎn)期、哺乳期的;womenworkersinpregnancy,childbirth,breastfeeding.4、在本單位連續(xù)工作滿十五年,且距法定退休年紀(jì)不足五年的;Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法例規(guī)定的其余情況。Othercircumstancesstipulatedbylawsandadministrativeregulations.(六)乙方排除勞動(dòng)合同,應(yīng)該提早三十天(試用期內(nèi)提早三日)以書面形式通知甲方,甲方在乙方達(dá)成業(yè)務(wù)以及清理完債權(quán)債務(wù)的狀況下,能夠排除勞動(dòng)合同。Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.(七)有以下情況之一的,乙方能夠通知甲方排除勞動(dòng)合同:Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在試用期內(nèi)的;Duringthetrialperiod.2、甲方以暴力、威迫或許非法限制人身自由的手段逼迫勞動(dòng)的;PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按勞動(dòng)合同商定供給勞動(dòng)保護(hù)和勞動(dòng)條件的;PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未依照勞動(dòng)合同的商定支付薪資酬勞的;PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法例規(guī)定勞動(dòng)者能夠排除勞動(dòng)合同的其余情況。Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、勞動(dòng)合同的停止Terminationoflaborcontracts(一)有以下情況之一的,勞動(dòng)合同即行停止:Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、勞動(dòng)合同期滿的;Thelaborcontractexpired.2、勞動(dòng)者開始依法享受養(yǎng)老保險(xiǎn)待遇的;Workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、勞動(dòng)者死亡,或許被人民法院宣布死亡或許宣布失散的;Laborerdied,orwasdeclareddeadormissingbythepeople'scourt.4、甲方被依法宣布破產(chǎn)的;PartyAwasdeclaredbankruptbythepeople'scourt5、甲方被撤消營業(yè)執(zhí)照、責(zé)令封閉、撤除或許提早解散的;BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法例規(guī)定的其余情況。Othercircumstancesstipulatedbylaws,administrativeregulations.(二)乙方應(yīng)在勞動(dòng)合同期滿前30天通知甲方,甲方贊同續(xù)訂,乙方應(yīng)實(shí)時(shí)申請辦理續(xù)訂手英文英語版本正式勞動(dòng)合同續(xù);若甲方不一樣意續(xù)訂,到期即辦理停止合同手續(xù)。乙方未辦理停止合同手續(xù)而辭職的,甲方保留追查其法律責(zé)任的權(quán)益。PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewalease,thelaborcontractwouldgoexpireIfParty.Bleftwithouttheterminationprocedures,PartyAwouldretainrighttopursueitslegalresponsibility.十、違犯勞動(dòng)合同的責(zé)任Breachofdutyofthelaborcontract(一)補(bǔ)償經(jīng)濟(jì)損失Compensationforeconomiclosses甲方有以下情況之一,給乙方造成經(jīng)濟(jì)損失的,應(yīng)該擔(dān)當(dāng)補(bǔ)償責(zé)任:Ofanythefollowingcircumstances,partyAshallbeliableforcompensationoftheeconomiclossesofpartyB.1、因?yàn)榧追綌M訂的勞動(dòng)合同條款無效的;SinceLaborPartyestablishedthetermsoftheinvalidcontract;2、違犯勞動(dòng)合同法例定的條件排除勞動(dòng)合同的。Conditionsinviolationoftheprovisionsofthe“LaborContractLaw“toterminatethelaborcontract.乙方有以下情況之一,給甲方造成經(jīng)濟(jì)損失的,還應(yīng)該擔(dān)當(dāng)補(bǔ)償責(zé)任:Ofanythefollowingcircumstances,partyBshallbeliableforcompensationoftheeconomiclossesofpartyA.1、乙方違犯《勞動(dòng)合同法》規(guī)定的條件或許勞動(dòng)合同的商定排除勞動(dòng)合同,給甲方造成經(jīng)濟(jì)損失的,應(yīng)該依照損失的程度,擔(dān)當(dāng)補(bǔ)償責(zé)任;PartyBviolatedtheconditionsinthe"LaborContractLaw"orterminatedthelaborcontracttocausetheeconomiclossesofpartyA,PartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.2、乙方違犯勞動(dòng)合同商定的保密事項(xiàng),給甲方造成經(jīng)濟(jì)損失的,應(yīng)該依法擔(dān)當(dāng)補(bǔ)償責(zé)任;ConfidentialmattersPartyviolationsoflaborcontract,causingeconomiclossestothePartyshallbeliableforcompensationaccordingtolaw.3、乙方在合同期內(nèi)嚴(yán)重違犯甲方的有關(guān)規(guī)章制度、操作規(guī)程給甲方造成損失或致甲方聘任的其余勞動(dòng)者人身傷害的,由乙方依據(jù)責(zé)任的大小負(fù)責(zé)補(bǔ)償。Inthecontractperiod,ifPartyBcausedseriousviolationsofrelevantrulesandregulationsoftheParty,procedures,orcausedlosses,orcausespersonalinjuryofotherworkersemployedbythePartyA.PartyBshallpaycompensationinaccordancewiththesizeoftheresponsibility.(二)違約金Penalty1、甲方為乙方供給專項(xiàng)技術(shù)培訓(xùn),乙方違犯培訓(xùn)協(xié)議,須向甲方支付違約金;PartyAshallprovidespecialskillstrainingforPartyB.IfPartyBviolatedtrainingprotocol,PartyBshallpayliquidateddamagestoPartyA.2、甲方對乙方實(shí)行了競業(yè)限制,乙方違犯競業(yè)限制條款,須向甲方支付違約金。PartyAimplementedthenon-competitionforthePartyB.Ifitisviolated,PartyBshallpayliquidateddamages十一、兩方商定條款A(yù)greedTermsbytwoParties(一)甲方采納了保密舉措保護(hù)的商業(yè)奧密,乙方負(fù)有保密義務(wù);PartyAhastakenmeasurestoprotecttheconfidentialityoftradesecrets,PartyBhastheconfidentialityobligations.(二)甲方能夠就保密的內(nèi)容、范圍和地址,兩方的權(quán)益義務(wù),保密限期,違約責(zé)任以及競業(yè)限制條款等與乙方簽署協(xié)議;PartyAcansignwithPartyonconfidentialityincontent,scopeandlocationoftherightsandobligationsofbothparties,theconfidentialityperiod,andbreachofcontractand英文英語版本正式勞動(dòng)合同non-competeclause.(三)若乙方在甲方是從事過管理、經(jīng)營、技術(shù)工作的,在走開甲方兩年之內(nèi),不得在本行業(yè)內(nèi)其余公司工作,不得泄漏甲方的生產(chǎn)、經(jīng)營奧密;IfPartyBisengagedinthemanagement,operation,technicalwork.Afterleavingthepartyinlessthantwoyears,PartyBcannotworkinothercompaniesinthisindustry,andshallnotdivulgeproduction,businesssecretsofPartyA.(四)勞動(dòng)
