3、施工項(xiàng)目：土方及加固地基Projectitems:EarthworkandFoundationReinforcement（1）深層攪拌樁加固地基的施工及鑿樁頭。（鑿樁頭費(fèi)用另計(jì)）Foundationreinforcementbydeepmixingpileandcuttingpilehead(thefeeofcuttingpileheadshallbesurcharged)

二、地基加固的要求ArticleTwoRequirementofFoundationReinforcement（1）地基加固范圍按基礎(chǔ)平面圖的基礎(chǔ)范圍進(jìn)行設(shè)計(jì)和施工，施工圖紙及說明書一經(jīng)審定，不得隨意更改，要求加固后復(fù)合地基承載力標(biāo)準(zhǔn)值為250kpa。Designandconstructionofreinforcedfoundationareashallbesubjecttothesameoffoundationplan,Constructiondrawingsandspecificationwhichhavebeenexaminedandapprovedshallnotbechangedoralteredindiscretion.Thecriterionvalueofthebearingcapacityofreinforcedfoundationshallbe250kpa.

（2）工程施工中承包方必需按國家有關(guān)的標(biāo)準(zhǔn)、規(guī)范和設(shè)計(jì)要求保質(zhì)保量按時(shí)進(jìn)行施工，隨時(shí)接受業(yè)主、發(fā)包方和工程監(jiān)理的檢查檢驗(yàn)。Contractorshould,duringconstruction,subjecttoState’srelevantstandards,specificationanddesignrequirements,carryoutconstructiontosecurequalityandquantityofProjectWorks,inadditiontotakeintimeacceptanceoftheinspectionandexaminationbyEmployerandsupervision.

（3）施工中的攪拌樁的隱藏紀(jì)錄由業(yè)主、工程監(jiān)理或發(fā)包方代表負(fù)責(zé)簽字驗(yàn)收。TherecordofcoverupofmixingpileduringconstructionshallbeacceptedwiththesignaturesofprojectsupervisionorEmployer'sRepresentative.

三、土方施工的要求ArticleThreeRequirementofEarthwork1、測(cè)量定位放線。Thelineofpointingmeasurement2、土方挖運(yùn)?；討?yīng)全部挖至原土層，垃圾土運(yùn)至場(chǎng)外，可利用土運(yùn)至場(chǎng)內(nèi)指定地點(diǎn)堆放，并用鏟車整理成堆。Excavation/removalofearthworks.foundationpitshouldbedugtotheoriginalsoil,wastesoilremovedtooff-site,useablesoiltransportedtodesignatedlocationinsideandmakingapilebyforklift.Removal3、 探孔：按圖示孔距及孔深進(jìn)行探孔。Holesexploration:Holesexplorationshallbeproceedbythedistanceanddeepofholeasdrawingstipulation.

4、 對(duì)墓、井洞的處理：探孔過程中發(fā)覺墓坑、井洞，應(yīng)進(jìn)行處理。Workontombandwell-hole:Thetombandwell-holefoundduringexplorationshouldbedealtwith.

坑底回填碾壓：原取土挖深部分及東側(cè)回填的垃圾土需挖至原土層，超深部分全部用素土回填至設(shè)計(jì)虛樁頂標(biāo)高，并碾壓密實(shí)。Bottombackfillcompaction:Thedugpartoforiginalearthandbackfilledwasteearthontheeasternpartshouldbedugtotheoriginalsoil,theultra-deeppartshouldbebackfilledwithsoiltotheelevationofpileheadandcompacteddense.

7、 挖泥運(yùn)泥：打樁時(shí)產(chǎn)生的泥漿全部挖除運(yùn)出場(chǎng)地。Earthduganddump:Allmudfrompilingshouldbeexcavatedanddumpedoutthesite.

四、承包方式及工程結(jié)算ArticleFourMeansofContractandSettlement經(jīng)雙方商定，地基加固和深層攪拌樁由承包方接受包工包料的方式施工，本工程預(yù)算攪拌樁工程為____立方米。RequirementofFoundationReinforcementanddeepmixingpileshallexecutedwiththecontractingoflaborandmaterialbycontractorpursuanttotheagreementbetweenpartieshereof.SubjecttoprojectbudgettheamountofpileiscubicmetersandcostofbudgetprojectisYuanRMBpercubicmeter.

土方工程依據(jù)下列第六條（4）款規(guī)定的計(jì)價(jià)方式結(jié)算。工程結(jié)算以實(shí)際發(fā)生的并經(jīng)業(yè)主、工程監(jiān)理和發(fā)包方簽證確認(rèn)的工程量及發(fā)包方和業(yè)主簽訂的工程施工合同的有關(guān)規(guī)定進(jìn)行結(jié)算，工程結(jié)算造價(jià)經(jīng)業(yè)主審定確認(rèn)為準(zhǔn)。發(fā)包方按經(jīng)審定確認(rèn)的工程結(jié)算造價(jià)的11%收取承包方的施工管理費(fèi)及一切應(yīng)繳稅費(fèi)。施工管理費(fèi)及應(yīng)繳納的一切稅費(fèi)由發(fā)包方從工程款中扣除。Earthworkshallbesettledsubjecttothepricingwhichstipulatedin(4)ArticleSixhereinafter.Thesettlementofconstructionshallbesubjecttothequantitieswhichisanactualworkandaffirmedbythesignaturesofowner,supervisionandemployerinadditiontorelevantprovisionsofcontractbetweencontractor/owner.Thefeesofconstructionmanagementandallduetaxiesshallbechargedbyemployeronthebasisof11%ofprojectcostwhichhavebeenunderexaminationandaffirmed.Thefeesofconstructionmanagementandallduetaxiesshallbedeductedfromthepaymentofconstructionbyemployer. 五：工期ArticleFiveTimeforCompletion本工程自___日開工至___日完工，工期為____天。非承包人緣由（如停水、停電、降雨等）影響施工，工期順延。由于發(fā)包人或承包人的緣由，未能按期開工、完工時(shí)，按本合同第條規(guī)定執(zhí)行。Thisprojectcommenceonandfromthedateof,completeonthedateofandtheconstructiondurationisdays.Providedthatifthereasonsofnon-contractorsuchascuttingoffsupplyofwater,electricityandrainfallaffectconstruction,thecompletiontimeshallbeextendedcorrespondingly.Thefailureofcommencementorcompletiononscheduleshall,if,duetothereasonsofemployerorcontractor,beexecutedsubjecttotheprovisionofArticle.

六：收費(fèi)標(biāo)準(zhǔn)及支付方式ArticleSixChargeStandardandPayment1、本工程收費(fèi)按國家建筑工程價(jià)目表計(jì)??；或以“預(yù)算包干”、“中標(biāo)價(jià)加簽證”、“實(shí)際完成工作量結(jié)算”等方式計(jì)取收費(fèi)。國家規(guī)定的收費(fèi)標(biāo)準(zhǔn)中沒有規(guī)定的收費(fèi)項(xiàng)目，由發(fā)包人、承包人另行議定。ThepaymentofprojectshallchargedunderState’slistofconstructionprojectorbythemeansofLumpsumbudget,AcceptedpriceplustheConfirmationforvariationandsettlementbyactualcompletion.AnyitemofchargedfeewithoutinState’slistshallbeunderotherwisenegotiationbetweencontractor/employer.

4、土方工程量計(jì)價(jià)方式：CalculationofCostPriceforEarthworkQuantity（1）土方挖運(yùn)：每立方元，方量計(jì)算按圖紙要求的基坑底邊線加1：0.28放坡系數(shù)并結(jié)合現(xiàn)場(chǎng)的實(shí)際狀況、實(shí)際的高程簽證進(jìn)行計(jì)算。PriceofexcavationandremovalofearthworkisYUANRMBpercubicmeter,theworkquantityshallbecalculatedsubjecttodrawing‘srequirementsofthebottomedgeplus1：0.28slopingcoefficientinadditiontothesignedconfirmationforotheractualmattersandelevationonsite.（2）探孔：孔距1米，孔深2.5米，梅花型布點(diǎn)，每孔Holesexploration:Thediameterofholeis1meterandthedepthofhole2.5meter.Theplumdistributionofholes.ThesettlementofexplorationcostshallbemadeontheactualamountofholesinadditiontothepriceofYUANRMBperhole.

（3）墓、井洞處理：依據(jù)現(xiàn)場(chǎng)實(shí)際狀況以簽證方式確定價(jià)格。Theworksfortombandwellhole:Thepriceofwork’scostshallbedecidedandagreedbywrittenconfirmationontheactualworksofsite.

（4）坑底回填碾壓：每立方元。依據(jù)現(xiàn)場(chǎng)實(shí)測(cè)實(shí)量進(jìn)行算量。Bottombackfillcompaction:YUANRMBforper1cubicmeter.Work’scostthereofwould,pursuanttothemeasurementonsite,becalculated.（5）CFG樁施工：按樁延長米進(jìn)行計(jì)算，每延長米元。總工程量為延長米。Executionofpile:ThecalculationofcostissubjecttotheextendedmetersontheYUANRMBforpermeter.Thetotalextendedmetersshallbemeters.

（6）挖泥運(yùn)泥出場(chǎng)地每立方元。工程量按樁體體積進(jìn)行計(jì)算。ThepriceofearthduganddumpoutsideisYUANRMBforper1cubicmeter.Theworkquantityiscalculatedonthecubageofpilebody.

七：變更及工程費(fèi)的調(diào)整ArticleSevenAlternationandCostAdjustment1、本工程進(jìn)行中，發(fā)包人對(duì)工程內(nèi)容和技術(shù)要求提出變更時(shí)，擔(dān)當(dāng)變更導(dǎo)致承包人的經(jīng)濟(jì)支出和損失，由此延誤的工期順延。

八：發(fā)包人責(zé)任ArticleEightResponsibilitiesofEmployer1、

發(fā)包人按本合同其次條規(guī)定的內(nèi)容，在規(guī)定的時(shí)間內(nèi)向承包人供應(yīng)資料文件，并對(duì)其2、

完整性、正確性剛好限性負(fù)責(zé)。Employershould,pursuanttothecontentsintheArticle2hereof,withinthestipulatedperiodprovidecontractorwithdataanddocumentationforwhichemployerbearfullresponsibilityforthecompleteness,accuracyandtimelimitationthereof.

2、發(fā)包人要求承包人在合同規(guī)定時(shí)間內(nèi)提前時(shí)，發(fā)包人應(yīng)按每提前一天向承包人支付__元計(jì)算加班費(fèi)。Providedthatemployerrequirecontractor‘sadvancecompletionofWorkpriortothescheduleterm,employershouldeffectovertimepaymenttocontractoronthebasisofYUANRMBforperadvancedday.3、發(fā)包人應(yīng)為承包人現(xiàn)場(chǎng)工作人員供應(yīng)必要的施工、生活條件；如不能供應(yīng)時(shí)，應(yīng)一次性付給承包人臨時(shí)設(shè)施費(fèi)____元。Employershouldprovidecontractorwiththenecessaryconditionsofconstructionandlivingforfieldstaff,if,maynotprovideso,shouldmakethepaymentinlumpsumofYUANRMBascontractor’stemporaryfacilityfee.

4、開工前，發(fā)包人應(yīng)自負(fù)費(fèi)用辦理開工許可證以及完成工作場(chǎng)地運(yùn)用、青苗、樹木賠償、墳地遷移、房屋構(gòu)筑物拆遷、障礙物清除等必要程序，使工地現(xiàn)場(chǎng)具備正常工作進(jìn)行的有關(guān)條件；發(fā)包人應(yīng)向承包人供應(yīng)工作現(xiàn)場(chǎng)地下已有埋藏物（如電力、電訊電纜、各種管道、人防設(shè)施、洞室等）的資料及其具體位置分布圖，若因地下埋藏物不清，致使承包人在現(xiàn)場(chǎng)工作中發(fā)生人身損害或造成經(jīng)濟(jì)損失時(shí)，由發(fā)包人擔(dān)當(dāng)民事責(zé)任；在有毒、有害環(huán)境中作業(yè)時(shí)，發(fā)包人應(yīng)按有關(guān)規(guī)定，供應(yīng)相應(yīng)的防護(hù)措施，并擔(dān)當(dāng)有關(guān)的費(fèi)用；以書面形式向承包人供應(yīng)水準(zhǔn)點(diǎn)和坐標(biāo)限制點(diǎn)；并負(fù)責(zé)現(xiàn)場(chǎng)樁位放點(diǎn)。發(fā)包人應(yīng)解決承包人工作現(xiàn)場(chǎng)的平整、道路通行、用水用電、泥漿排放，并擔(dān)當(dāng)費(fèi)用。Employershould,priortocommencementofwork,athisexpense,acquireLicenceforCommencement,gothroughallnecessaryproceduresonthesiteuse,compensationforseedingandtrees,tombmigration,demolitionofbuilding/structuresandobstacleselimination,soastoenablethesitewithrelevantconditionsofnormalwork；Employershouldprovidecontractorwiththedataanddistributiondrawingofspecificlocationrelatedtoundergroundfacilities/structuresincludingthecablesofelectricityandtelecommunication,variouspipes,airdefensefacilitiesaswellascaverns,etc.,forwhichemployershouldtakeresponsibilityofcompensationforcontractor’spersonalinjuryoreconomiclosswhichoccuronsite,if,arisingfromunclearorunknowntotheundergroundevents.Providedthatcarryingoutprojectintoxicandhazardousenvironment,employershouldunderrelevantregulations,athisownexpense,providecontractwithcorrespondingprotectmeasurementsandissueinwrittenformthelocationofbenchmark,coordinatespointandpilelocation.Employershouldathisownexpensemakepreparationofsiteleveling,roadaccess,water/electricityanddischargeofmudforcontractor.

5、發(fā)包人應(yīng)對(duì)工作現(xiàn)場(chǎng)四周建筑物、構(gòu)筑物、古樹名木和地下管道、各種線路的愛惜負(fù)責(zé)，承包人提出書面具體愛惜要求（措施），并擔(dān)當(dāng)費(fèi)用。Employershouldberesponsiblefortheprotectionofbuilding,structure,oldandraretrees,aswellasvariousundergroundpipes/linesaroundprojectsite.Contractorsubmitonitsownexpense,thespecificrequirementofprotectionmeasuresinwritten.

6、發(fā)包人應(yīng)愛惜承包人的投標(biāo)書、報(bào)告書、文件、設(shè)計(jì)成果、專利技術(shù)、特殊工藝和合理化建議的運(yùn)用權(quán)和全部權(quán)不受侵?jǐn)_，未經(jīng)承包人同意，發(fā)包人不得復(fù)制泄露或向第三人轉(zhuǎn)讓或用于本合同外的項(xiàng)目，如發(fā)生以上狀況，發(fā)包人應(yīng)負(fù)法律責(zé)任，承包人有權(quán)索賠。Employershouldindemnifyandprotectcontractor’srightsofuseandownershipoftender,reports,documents,designresults,patentedtechnology,specialtechniquesandrationalizationproposalsfrominfringement，withoutpriorwrittenconsentofcontractor,employershallnotcopy,divulgeortransferanyandallabovedocumentationtothethirdpartyorusetootherprojectbeyondthisproject,if,theoccurrenceofsuchinfringements,contractorisentitletoclaimforcompensation.

九：承包人責(zé)任ArticleNineResponsibilityofContractor1、派出工程技術(shù)人員按任務(wù)托付書要求進(jìn)行現(xiàn)場(chǎng)踏勘，確定工作手段、工程量，編制工程預(yù)算。Dispatchengineeringandtechnicalpersonneltomakesitesurveyandmakedeterminationofconstructionmeasure,workquantityinadditiontopreparationofprojectbudget.

2、委派____為該項(xiàng)工程項(xiàng)目的負(fù)責(zé)人，全權(quán)負(fù)責(zé)該工程的現(xiàn)場(chǎng)協(xié)調(diào)，技術(shù)、施工管理等各項(xiàng)工作。____shallbedesignatedasthepersoninchargeofthisprojectandwithfullauthoritytotakeresponsibilityofthecoordinationofsite,technology,constructionmanagementandvariousworks.

3、開工前，提出施工組織設(shè)計(jì)，并依據(jù)施工組織設(shè)計(jì)，搞好技術(shù)交底，做好各項(xiàng)施工準(zhǔn)備工作。Onpre-commencementprovidethedesignofconstructionorganizationbywhichdotechnicalexplanation/disclosurewithemployerandcompletevariouspreparationofconstruction.

4、依據(jù)國家現(xiàn)行的標(biāo)準(zhǔn)、規(guī)范和規(guī)程進(jìn)行施工，按合同規(guī)定的進(jìn)度提交工程成果，并對(duì)其質(zhì)量負(fù)責(zé)。Shallunderthecurrentstate’sstandards,normsandregulations,carryoutconstructionanddeliveryprojectachievementssubjecttothescheduleshereoftowhichbeartheliabilityofquality.

十：違約責(zé)任ArticleTenLiabilityofBreach1、由于發(fā)包人供應(yīng)的資料錯(cuò)誤、不精確，造成工期延誤或返工時(shí)，除工期順延外，發(fā)包人應(yīng)向承包人支付停工費(fèi)或返工費(fèi)，造成質(zhì)量、平安事故時(shí)，由發(fā)包人擔(dān)當(dāng)法律責(zé)任和經(jīng)濟(jì)責(zé)任。Providedthaterrorsorinaccuraciesofthedata/documentationsubmittedbyemployergiverisetodelayorrework,exceptworktimeextensionemployershallmakepaymentofsuspensionorreworktocontractor,if,anyaccidentoccurrenceofqualityorsafetytherewith,theliabilitiesoflegalandeconomythereofshallbebornbyemployer.

2、在合同履行期間，發(fā)包人要求終止或解除合同，承包人未起先工作的，不退還發(fā)包人已付的定金；已進(jìn)行工作的，完成的工作量在50％以內(nèi)時(shí)，發(fā)包人應(yīng)支付承包人工程費(fèi)的50％的費(fèi)用；完成的工作量超過50％時(shí)，發(fā)包人應(yīng)支付承包人工程費(fèi)的100％的費(fèi)用。Providedthatemployerrequireterminationorrescindthiscontractduringtheperiodofperformance,if,priortocommencementofproject,contractorshallnotrefunddepositwhichhavebeenpaidbyemployer;if,contractor’scompletedquantityless50%oftotalthesame,employershalleffectpaymentof50%workcost;if,completedquantityover50%oftotalquantity,employershallpay100%ofprojectcost.

3、發(fā)包人不按時(shí)支付工程費(fèi)（進(jìn)度款），承包人有權(quán)停工，工期順延，發(fā)包人還應(yīng)擔(dān)當(dāng)滯納金。Shouldemployerfailtoeffectthepaymentofconstructioncost(gresspayment),contractorisentitletodocorrespondinglysuspensionandextensionperiodinadditiontoclaimemployerforpenaltyofdelaypayment.

4、由于承包人緣由延誤工期，每延誤一天擔(dān)當(dāng)工程費(fèi)千分之一計(jì)算的違約金。發(fā)包人不得因此而拒付工程款。Shoulddelayofworkperiodforcontractor’sreason,contractorshouldbearbreachpenaltyonthebasisof1‰(ONEINATHOUSAND)ofprojectcostpereachday,andcontractorshallnotrefusetoeffectpaymentofconstructioncosttocontractortherefore.

5、由于承包人的緣由造成工程質(zhì)量達(dá)不到合同要求時(shí)，承包人除負(fù)責(zé)實(shí)行補(bǔ)救措施外，應(yīng)免收補(bǔ)救措施的工程費(fèi)。補(bǔ)救后仍不能達(dá)到合同要求時(shí)，承包人擔(dān)當(dāng)違約責(zé)任，并依據(jù)因此造成的損失程度向發(fā)包人支付賠償金，賠償金額最高不超過返工項(xiàng)目的收費(fèi)。因地層變更或人力不行抗拒等非承包人緣由造成工程損害或質(zhì)量變更的，承包人不擔(dān)當(dāng)責(zé)任。Providedthatfailureofprojectqualityissatisfactiontotherequirementofcontractduetocontractor’sreason,contractorshouldtakeremedyactionsthereoffreeofcharge.Contractorshould,ifstillfailtosatisfytherequirementofcontract,bearliabilityofbreachandpaycompensationinaccordancewithlossextensioninconsequencethereof,providedthatmaximumamountofcompensationshallnotexceedthechargedamountofrework.However,contractorhasnoliabilitywithrespecttothedamageorqualitychangeofprojectduetothereasonsofstratigraphicvariationsand/orforcemajeure.

十一：材料設(shè)備供應(yīng)ArticleElevenProvisionofMaterialsandEquipments1、發(fā)包人、承包人應(yīng)對(duì)各自負(fù)責(zé)供應(yīng)的材料設(shè)備擔(dān)當(dāng)責(zé)任，供應(yīng)產(chǎn)品合格證明，并經(jīng)發(fā)包人、承包人代表共同驗(yàn)收認(rèn)可，如和設(shè)計(jì)和規(guī)范要求不符的產(chǎn)品，應(yīng)重新選購 符合要求的產(chǎn)品。EmployerandcontractorshalltakerespectiveliabilityforthematerialsandequipmentwhichhavebeensuppliedbyeachpartyitselfandshowQualityCertificatesofproductstowhichmutualacceptanceandconfirmedbyparties‘ssignature.If,theproductsfailtomeettherequirementofdesignandspecifications,shouldbereplacedbythere-purchasedsamewhichisinconformitywithrequirements.

承包人需運(yùn)用代用材料時(shí)，須經(jīng)發(fā)包人代表批準(zhǔn)方可運(yùn)用，增減的費(fèi)用由發(fā)包人、承包人商定。AnyalternativematerialusedbycontractortosubstitutethesamewhichspecifiedindesignshouldbesubjecttotheapprovalofEmployer’srepresentativeandincreaseordecreaseofamountthereforeshallbeagreedandconfirmedbypartieshereof.

十二：保密約定ArticleTwelveConfidentiality合同有效期內(nèi)，雙方應(yīng)實(shí)行適當(dāng)措施對(duì)本合同和技術(shù)資料予以嚴(yán)格保密，未經(jīng)書面同意，任何一方不得將合同內(nèi)容和技術(shù)資料泄露給第三方。WithinthevalidityperiodofContract,partieshereofshalltakepropermeasurestokeepthiscontractandTechnicalDocumentationstrictlyconfidential.Anypartyshallnotdiscloseordivulgespecificshereofortechnicaldocumentationtoanythirdpartywithoutpriorwrittenconsentofoppositeparty.十三：爭(zhēng)議解決方法ArticleThirteenDisputesSettlement凡因執(zhí)行本合約或有關(guān)本合同所發(fā)生的一切爭(zhēng)吵，雙方應(yīng)以友好方式協(xié)商解決；假如協(xié)商不能解決，應(yīng)提交仲裁委員會(huì)，依據(jù)該會(huì)的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對(duì)雙方都有約束力。AlldisputesarisinginconnectionwiththisContractortheexecutionthereofshallbesettledbywayofamicablenegotiation.Incasenosettlementcanbereached,thecaseatissueshallthenbesubmittedforarbitrationtotheArbitrationCommissioninaccordancewiththeprovisionsofthesaidCommission.TheawardbythesaidCommissionshallbedeemedasfinalandbindinguponbothparties.

十四：其它約定事項(xiàng)ArticleFourteenMiscellaneous

十五、合同生效和終止ArticleFifteenEffectiveandTermination本合同以中英文書寫,兩種文字具有同等法律效力。如中英文說明相沖突的，以中文準(zhǔn)。合同一式四份，雙方各持兩份，本合同自發(fā)包人、承包人簽字蓋章后生效。發(fā)包人、承包人履行完畢合同規(guī)定的義務(wù)后，本合同終止。ThiscontractiswritteninbothChineseandEnglish,withbothtextsbeingequallyauthenticandIntheeventofanyconflictbetweentheEnglishandChinese,thelattershallprevail.Thiscontractisinquadruplicate,eachpartyshallholdtwocopies.Thecontractbecomeseffectivefromthedateofsigningandstampingbypartiesandceaseeffectiveandforceonandaftercompletingtheliabilitiesstipulatedhereinbypartieshereto.
