第五章QuotationsandOffers報(bào)盤第一節(jié)TheStepsofWritingQuotationLetters報(bào)盤信的寫作步驟報(bào)盤是買方將某種產(chǎn)品按一定的交易條件(包括數(shù)量、價(jià)格、交貨期、付款條件等)向買方表達(dá)成交的愿望。在國(guó)際業(yè)務(wù)中,報(bào)盤分實(shí)盤(firmoffer)和虛盤(non-firmoffer)兩種。實(shí)盤是賣方按其所提供的條件達(dá)成交易目的的肯定承諾,一旦買方在規(guī)定的答復(fù)期限內(nèi)接受了報(bào)盤,賣方將不得對(duì)盤中任何條款作修改。虛盤則對(duì)賣方?jīng)]有這種約束力,在某些情況下,報(bào)盤中的具體條款仍可修改。
實(shí)盤是發(fā)盤人(Offerer)按其提供的條件以達(dá)成交易目的的明確表示。實(shí)盤具有法律效力。受盤人(Offeree)一旦在有效期限內(nèi)接受實(shí)盤上的條件和內(nèi)容,發(fā)盤人就無權(quán)拒絕售貨。一項(xiàng)實(shí)盤必須具備:
1.發(fā)盤的內(nèi)容和詞句必須肯定,不能用‘大約(about)’,‘參考價(jià)(referenceprice)’等摸棱兩可的詞。
2.發(fā)盤的內(nèi)容明確完整,其內(nèi)容應(yīng)包括商品品質(zhì)(Quality),數(shù)量(Quantity),包裝(Packing),價(jià)格(Price),裝運(yùn)(Shipment),支付(Payment),有效期(Validity)等。
3.發(fā)盤中不能有保留條件如:以我方最后確認(rèn)為準(zhǔn)subjecttoourfinalconfirmation;以貨物的未售出為準(zhǔn)subjecttogoodsbeingunsold
虛盤是發(fā)盤人所作的不肯定交易的表示。凡不符合實(shí)盤所具備的上述三個(gè)條件的發(fā)盤,都是虛盤。虛盤無須詳細(xì)的內(nèi)容和具體條件,也不注明有效期。它僅表示交易的意向,不具有法律效力。出現(xiàn)下列一類的詞句者,皆為虛盤:
-Withoutengagement.
不負(fù)任何責(zé)任。
-subjecttopriorsale
有權(quán)先售。
-Allquotationsaresubjecttoourfinalconfirmationunlessotherwisestated.
所作報(bào)價(jià),除特別注明外,須經(jīng)我方確認(rèn)后方能生效。
-Ourofferissubjecttoapprovalofexportlicense.
出口許可證準(zhǔn)許簽證,我方報(bào)價(jià)才有效。
完整的報(bào)價(jià)應(yīng)包括下列要點(diǎn):
1.對(duì)詢價(jià)表示感謝;(Thankthereaderfortheirenquiry)

收到詢價(jià)信時(shí),盡可能簡(jiǎn)潔清楚地回答問題。如果你不能回答詢問中的問題,應(yīng)解釋原因并提供可能的其他解決方式。

3.Beinapositionto能夠。強(qiáng)調(diào)客觀上允許做某事。Beinapositionto通常不與條件從句連用。

4.Offer報(bào)價(jià),報(bào)盤??梢杂米鲃?dòng)詞或名詞。用法如下:
offersbaprice,make(send)sbanofferforsth
(1)Pleasemakeusanofferfor100metrictonsofwalnuts.
請(qǐng)給我們報(bào)盤100公噸核桃。
(2)Wecanofferyouvariouskindsofironnails.
我們可以給你們報(bào)盤各種鐵釘。
(3)Wecanofferyoulargequantitiesofthisyear’speanutsatattractiveprice.
我們能以很具吸引力的價(jià)格給你方報(bào)盤大量今年產(chǎn)的花生。
名詞offer常與動(dòng)詞make/send/give/cable等連用。后接介詞for或on/of,接for最普通,買方提及賣方的報(bào)盤時(shí),接of較好。
例:Pleasesendusafirmofferfor20metrictonswalnutmeat.(請(qǐng)給我報(bào)20公噸核桃仁的實(shí)盤。)
動(dòng)詞offer可以及物,也可以不及物。及物時(shí)可以用雙賓語。
例:Wefaxedbackthismorning,offeringyou250metrictonsGroundnutsat¥500permetrictonCNFCopenhagenforshipmentduringOctober/November.(我方今晨回復(fù),報(bào)你250公噸花生每公噸500元哥本哈根成本加運(yùn)費(fèi)價(jià)十月/十一月裝運(yùn)。)
5.owingto由于。
owingto與dueto,onaccountof,becauseof都當(dāng)因?yàn)椤⒂捎诮?。用作表語時(shí),一般用dueto;用作狀語時(shí)可通用。
例:Themarkethasdeclinedowingtothedecreaseindemand.(行情跌落是由于需求減少所致。)
6.Excessive過多的。
例:ThereisanexcessivesupplyofJapaneseTVsets.(日本產(chǎn)的電視機(jī)供應(yīng)過剩。)
7.Demand名詞,需求。動(dòng)詞,需要。
例:
(1)Supplyexceedsdemand.(供大于求。)
(2)Theydemandlargequantitiesoftextiles.(他們需要大量的紡織品。)

11.substitute名詞,替代品

13.DM4.80,DM意思是德國(guó)馬克。
14.peryard每碼。Per每個(gè),Yard一種基本長(zhǎng)度單位,碼。
