中英文勞務(wù)合同模板【篇一:外國人簡易勞務(wù)合同--中英文】雇傭合同employmentcontract甲方partya:乙方partyb:簽訂日期date::甲方:partya:地址:address:乙方partyb:性別gender:___國籍nationality:護照號碼passportno.:_____________________在華居住地址address(beijing):聯(lián)系方式contact:______________________________________其他緊急聯(lián)絡(luò)人contactpersonincaseofemergency:一、雇傭期限Ⅰemploymentterm雇傭期限為_____年,自______年___月___日起至______年___月__日止theemploymenttermis________year(s),lastingfrom_______________to___________.二、雇傭內(nèi)容及工作時間Ⅱcontentandworkinghours2.1甲方根據(jù)工作需要,安排乙方完成以下內(nèi)容的工作任務(wù):partyagivespartybthefollowingworkassignmentsaccordingtoitsoperatingrequirements:工作內(nèi)容jobresponsibilities:工作地點place:2.2工作時間:乙方每日工作時間不超過8小時,平均每周工作不超過40小時,每周休息日為周六、日。partybworksnomorethan8hoursperday,nomorethan40hoursperweek,andsaturdayandsundayaresetasweeklyrestdays.三、報酬及其他福利Ⅲremunerationandotherwelfarebenefits3.1乙方的報酬為稅前__________元/月,大寫:partyb’ssalaryisrmb_3.2甲方應(yīng)于每月10號以貨幣或轉(zhuǎn)帳形式足額支付乙方上述報酬。partyashallpaysalarytopartybbeforethe10thdayofeverymonthintheformofcashorbank-transfer.3.3乙方應(yīng)遵守國家及地方的稅法制度,自行繳納其個人收入的個人所得稅,甲方無義務(wù)為其代繳。partybshallpaypersonalincometaxvoluntarilyaccordingtothestate’staxlaw.partyadoesn’tshouldertheresponsibilitytowithholdandremittaxesforpartyb.3.4乙方在合同期內(nèi)享受中國法律規(guī)定的節(jié)日,公休假日。partybisentitledwithalllegalholidaysinaccordancewiththestate’sregulations四、雇傭合同的解除和終止Ⅳcontractcancellationandtermination4.1合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時,雇傭合同即終止。thiscontractshallbeterminatedonceitexpiresandbothpartiesdonotextendthecontract.4.2經(jīng)合同雙方當事人協(xié)商一致,本合同可以解除。thecontractmaybecanceledbasedonbothparties’mutualnegotiation.4.3乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的,本合同自動終止。thecontractwillautomaticallyterminateincasepartybisabsentforover10dayswithoutwrittenexplanationduetohomecomingorotherprivatereasons.五、其他事項Ⅴothers5.1其他未盡事宜,雙方可參照甲方公司內(nèi)部的相關(guān)規(guī)章制度執(zhí)行。otheritemsnotstipulatedbythetwopartiescanbeimplementedaccordingtotheinternalrulesandregulationsofpartya.5.2甲乙雙方均應(yīng)遵守本合同之約定,任何一方違約,非違約方均有權(quán)要求違約方承擔相應(yīng)的損失。partyashallprovidenecessaryworkingconditiontoensurepartyb’ssafetyandhealth.六、社會保險和福利articlesixsocialinsuranceandwelfare6.1甲方依法替乙方辦理各項社會保險并繳納保險費用。但依法規(guī)定之分攤比例,屬于乙方須自行負擔之各項社會保險金,由甲方于每月發(fā)薪時,從乙方薪資中代扣代繳。partyashalltransactsocialinsuranceandpaythemforpartyb.partyashallwithholdthesocialsecuritycontributionlegallyundertookbypartybwhenpayingtheremunerationeverymonth.6.2乙方享有國家規(guī)定的所有法定假日。partybwilltakeallstatutoryholidaysstipulatedbythestate.6.3甲方實行年休假制度,乙方連續(xù)工作滿一年以上的可享受有薪年假,申請享受辦法按甲方制定的年假規(guī)定執(zhí)行。partyacarriesoutannualvocationsystem,partybcantakepaidannualvocationaftercontinuouslyworkingfor1yearandtheapplyingprocedureforannualvocationshallbedonepursuanttopartya’sstipulation.七、乙方責任articlesevenpartyb’sresponsibility7.1乙方必須認真工作和勞動,保質(zhì)保量地完成自己的生產(chǎn)任務(wù)。partybmustworkearnestlyandaccomplishitsowntaskswithqualityandquantity.7.2乙方必須如實匯報工作,積極配合和協(xié)助上級的工作。partybmustreportitsjobaccordingtothefactsandshallcooperatewithitsuppersandassisttheirjobs.7.3乙方應(yīng)嚴格履行甲方依法制定的規(guī)章制度和《員工手冊》。partybshallstrictlyimplementtherulesandregulationsandhandbooklegallystipulatedbypartya.7.4乙方應(yīng)愛護甲方的財物,對由于本人責任造成的直接經(jīng)濟損失,必須予以賠償并接受甲方的處罰。partybshalltakegoodcareofpartya’spropertyandhe/shemustindemnifydirectdamageduetohis/herliabilityandacceptspartya’spunishment.7.5乙方在勞動合同有效期內(nèi)未經(jīng)甲方事先書面同意,不得為另一家雇主工作。partybcannotworkforanotheremployerwithoutpartya’swrittenconsentinthedurationoflaborcontract.7.6乙方應(yīng)嚴格保守甲方的商業(yè)秘密,不得向任何第三方泄露。partybshallstrictlykeeppartya’stradesecretandcannotdivulgetoanythirdparty7.7如實陳述履歷和學歷。partybshallstatehis/hercurriculumvitaeandeducationalbackgroundaccordingtothefacts.7.8如甲方委派乙方培訓(包括海外培訓),乙方必須遵守甲方的培訓條規(guī)和承諾。partybshallobservepartya’strainingrulesandundertakingwhenpartyaassignspartybtobetrained.八、甲方無償解除合同articleeightcancellationofthecontractwithoutcompensationbypartya若符合下列情況之一的,甲方可以隨時解除合同,而不必給予乙方任何經(jīng)濟補償:partyamaycancelthecontractatanytimewithoutcompensationtopartybunderthefollowingcircumstances:8.1當乙方在試用期內(nèi)不符合甲方的職工錄用條件,甲方無須給予乙方解除的原因。whenpartybisproventobeunqualifiedforpartya’semploymentconditionsduringprobationperiod,partyaneednotgivepartybthereasonforcancellation.8.2乙方嚴重違反甲方依法制定的規(guī)章制度和勞動紀律。partybseriouslyviolatesrulesandregulations,labordisciplinelegallystipulatedbypartya.8.3乙方嚴重失職,營私舞弊,給甲方利益造成重大損失。partybseriouslyneglectshis/herdutyandgraftsresultinginpartya’sgreatloss.8.4乙方違反中國法律,受到司法處罰或追究刑事責任。partybviolatesthelawsofprcandgainsjudicialpunishmentorisfoundaguilty.九、甲方有償解除合同articlenightcancellationofthecontractwithcompensationbypartya有下列情形之一的,甲方可以解除勞動合同,但是應(yīng)當提前30天以書面形式通知乙方或支付一個月基本工資代替,并依法支付乙方經(jīng)濟補償金或補助費。underthefollowingcircumstances,partyamaycancelthecontractwith30dayspriorwrittennoticetopartyborpayingonemonthbasicwageinsteadandlegallypayeconomiccompensationorsubsidytopartyb.9.1乙方患病或非因工受傷,醫(yī)療期滿后仍不能從事原工作或由甲方另行安排的工作的。partybisillornon-work-relatedinjured,andunabletodotheformerjoborotherjobassignedbypartyaaftermedicaltreatment.9.2乙方不能勝任工作,經(jīng)過培訓或調(diào)整工作崗位,仍不能勝任的。partybisnotcompetentforthejobandstillremainssoaftertrainingoradjustmentofthepost.9.3本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,甲乙雙方不能就變更本合同達成協(xié)議的。thebasisfortheconclusionofthecontracthasgreatlychangedsothatthecontractcannolongerbecarriedout,whilebothpartiescannotreachanagreementonmodifyingthecontractbymutualnegotiation.9.4甲方瀕臨破產(chǎn),進入法定整頓期間或者生產(chǎn)經(jīng)營狀況發(fā)生嚴重困難,達到當?shù)厝嗣裾?guī)定的嚴重困難企業(yè)標準,確須裁減人員,并按法定程序解除勞動合同的。partyaisclosetobankruptcyandentersintolegalrectificationperiodoritisinaseveredifficultytomeetthestandardofseveredifficultenterprisestipulatedbythelocalgovernmentandtheretrenchmentisneeded,andthenpartyacancelsthecontractaccordingtolegalprocedure.十、乙方要求解除合同articletencancellationofthecontractatpartyb’srequest10.1乙方要求解除勞動合同,應(yīng)當提前三十天以書面形式通知甲方,但必須依照11.2條款賠償甲方。partybshallgive30dayspriorwrittennoticetopartyawhenrequestingtocancelthecontract,buthe/sheshallindemnifypartyaaccordingtoarticle11.2.10.2乙方在下列情況下,可隨時通知甲方解除勞動合同。underthefollowingcircumstances,partybmayinformpartyatoterminatethecontractatanytime.a.在試用期內(nèi)?!酒褐杏⑽墓緞趧雍贤縧aburemploymentcontract目錄contents第1條合同期限contractperiod第2條工作崗位、任務(wù)positions,dutiesresponsibilities第3條工作條件、勞動保護laborconditionslaborprotection第4條勞動報酬payroll第5條社會保障和福利待遇socialinsurancefringebenefits第6條勞動紀律和獎懲辦法labordisciplineandreward第7條合同變更、續(xù)訂、終止和解除contractrenewandtermination第8條兼職規(guī)定part-timejobpolicy第9條保密及附隨義務(wù)keepsecretandemployee’sincumbency第10條違約責任liabilitiesresultingfrombreachofcontract第11條勞動爭議laborcontentions第12條其他others乙方:partyb:姓名:name性別:sex:出生日:dateofbirth:家庭住址:address:通訊地址:postaddress:電話:phone:蒙特工業(yè)有限公司(甲方)聘用乙方為甲方勞動合同制員工。根據(jù)《中華人民共和國勞動法》、《蒙特工業(yè)有限公司章程》以及已頒布并可公開得到的有關(guān)法律法規(guī),甲乙雙方本著自愿平等、協(xié)商一致的原則,簽訂本合同。accordingtothelaborlawofthep.r.china,aswellasthepersonnelregulationsoflaborcontract,valmontindustriesltd.employspartyb(theemployee)asacontractemployee.bothpartiestothiscontractsignonthebasisofequity,freewill,andmutualbenefits.第1條合同期限contractperiod1.1本合同有效期自200___年___月___日至200___年___月___日止(含試用期____個月)。thecontractperiodofemploymentwillbevalidfrom____(m/d/y)to___(m/d/y).duringwhichtheperiodof____monthswillbeconsideredasprobationaryemployment.1.2在試用期內(nèi),甲方發(fā)現(xiàn)乙方不符合錄用條件的,甲方可以即行解除本合同。partyahastherighttoterminatepartyb’slaborcontractimmediatelywithoutnotificationifpartybdoesnotprovetobesuitablethroughtheperiodofprobationaryemployment.第2條工作崗位、任務(wù)positions,dutiesresponsibilities2.1甲方安排乙方在____部門____崗位工作,覆蓋崗位為_____partya(theemployer)employspartyb(theemployee)inthecapacityof_____2.2乙方必須按照甲方規(guī)定的崗位職責和要求全面完成指標和任務(wù),并接受甲方對其進行的有關(guān)考核測評。partybisrequiredtofulfillhis/herresponsibilitiescompletelyandaccuratelyasdescribedbypartyaandacceptperformancemeasurementhandledbypartya2.3甲方根據(jù)生產(chǎn)經(jīng)營需要及乙方的工作技能和表現(xiàn),可變更乙方的工作,乙方須服從甲方的調(diào)動,如無正當理由,不服從調(diào)動者,甲方可辭退乙方,解除其勞動合同。partyahastherighttoadjustpartyb’spositionaccordingtotheactualbusinesssituationandtheperformanceofpartyb.partybmustacceptpartya’sarrangement.第3條工作條件、勞動保護laborconditionslaborprotection3.1甲方實行每周40小時工作制。對特殊崗位可實行不定時工作制。partyb’snormalworkingtimewillnotexceed40hoursperweek,whereasit’sflexibleforsomespecialpositionholders.3.2甲方因生產(chǎn)經(jīng)營原因需要乙方加班時,乙方應(yīng)服從。同時甲方應(yīng)按規(guī)定支付乙方加班費報酬作補償。ifitisnecessaryforpartyatorequestpartybtoputinovertime,partybmustbesubordinatedtorequestofpartya.partyashallprovidepartybwitheconomiccompensationaccordingtorelevantregulations.3.3甲方為乙方提供必要的工作條件,根據(jù)國家勞動法則提供符合中國政府規(guī)定的勞動安全衛(wèi)生條件和提供必要的勞動保護用品,保證乙方在人身安全及個體不受危害的環(huán)境條件下工作,對女職工及未成年工按《勞動法》的規(guī)定酌情予以特殊勞動保護。partyamustprovidepartybwithasafeandnon-toxicworkingenvironment,necessarysafetymeasurestoguaranteesafeworkingconditionsofpartyb,accordingtonationalsafetyandsanitationstandards.partyashallprovidespecialprotectionmeasuresforfemaleandunderageemployeesaccordingtothelaborlaw.3.4甲方認為乙方的健康狀況將會對工作或其他員工造成不利影響時,甲方有權(quán)按制度采取相應(yīng)的措施,并有權(quán)要求乙方進行健康檢查,乙方不應(yīng)拒絕。ifpartyathinkspartyb’shealthinesswilleffecttotheworkorotherstaffs,partyawillhavetheauthoritytocorrespondandwillhavetheauthoritytoaskpartybtohaveaphysicalcheck-up,atsametimethepartybshouldnottorefuse.3.5乙方在被聘用期間,甲方負責對乙方進行崗位職責、技能、安全規(guī)程、職業(yè)道德及相關(guān)規(guī)章制度的教育和培訓,乙方須積極配合,并根據(jù)崗位職責要求努力提高自身的技能。partyaisinchargeofvarioustrainingsuchastechnicaltraining,positionprinciples,safetyoperations,company’sregulationsandprovision,etc.withintheemploymentperiod.partybshallacceptthetrainingwithpositiveattitudeforraisinghis/herworkefficiency.第4條勞動報酬payroll4.1公司實行內(nèi)部薪酬管理制度,甲方依據(jù)按勞取酬準則、企業(yè)經(jīng)營狀況及崗位確定乙方的薪酬標準,并按有關(guān)規(guī)定支付。partyaimplementscompany’sinternalsalarysystem.partyawillpaypartybmonthlysalarybasedonthefollowingconditions:theactualbusinesssituation,thelevelofpartyb’spositionandthegeneralprincipleof“distributionaccordingtowork”.4.2公司在實行新工資制度、調(diào)整員工工資水準或當乙方崗位職務(wù)發(fā)生變化時,甲方可根據(jù)政策給予乙方以工資待遇調(diào)整。partyahastherighttoadjustthesalarystandardofpartybifpartyaimplementsnewsalarysystem,ortransfersthepositionofpartyb.4.3每月最后一天為甲方的當月薪金發(fā)放日。salarywillbegiventopartybontheendofmonth.第5條社會保障和福利待遇socialinsurancefringebenefits5.1在勞動合同期內(nèi)甲方按照中國政府有關(guān)規(guī)定為乙方辦理養(yǎng)老保險、醫(yī)療保險、住房公積金、失業(yè)保險等手續(xù)。partyashouldprovidethepension,medicalinsurance,unemploymentinsuranceandhousingfundforpartybwithinthecontractperiodaccordingtotherelevantgovernmentlaws.5.2甲方為乙方提供因傷病、工傷、職業(yè)病及計劃生育而發(fā)生醫(yī)療費用保險,并創(chuàng)造條件辦好員工福利。5.3乙方在甲方工作期間不滿一年的可享受累計3個月的停工醫(yī)療期,工作時間每增加一年,累計停工醫(yī)療期增加一個月,最多不超過24個月。partybhastherighttohave3monthswork-offmedicaltreatmentifhe/sheworksforpartyalessthanoneyear.onemoremonthwork-offmedicaltreatmentwillbepermittedwiththeonemoreyearemployment.thetotalwork-offmedicaltreatmentislimitedwithin24hours.5.4乙方享有國家規(guī)定的法定節(jié)假日、婚喪、探親、生育假以及年休假等有薪假期。partybhastherighttoenjoypublicholidays,marriageleave,funeralleave,home-visitleave,familyplanningleave,new-yearholiday,companyholidays,etc.5.5乙方因工作或非因工死亡的待遇等按中國政府的法規(guī)執(zhí)行。partyb’scompensationforthedeathofworkingaccidentetc.isexecutedaccordingtotheprevailingrulesandregulationsenactedbythegovernment.第6條勞動紀律和獎懲辦法labordisciplineandreward6.1乙方在合同期內(nèi)必須嚴格遵守國家法律法規(guī),熟知并遵守本公司《員工手冊》和各項規(guī)章制度。partybmustobeystatelawsandregulations,thejointventureemployeehandbookandthebylawofcompany.6.2甲方依照本公司《員工手冊》,對于模范遵守規(guī)章制度和為公司經(jīng)營、生產(chǎn)和發(fā)展作出重大貢獻的員工予以獎勵;對于違反規(guī)章制度的乙方予以處罰。partyawillrewardthemodelemployeeswhoperformcompany’sdisciplineperfectlyandmakeabigcontributiontooperation,productionanddevelopmentofcompany’sbusiness.partyawilldisciplinarytheemployeeswhobreachcompany’semployeeshandbook.第7條合同變更、續(xù)訂、終止和解除contractrenewandtermination7.1合同雙方在履行本合同過程中確因客觀情況發(fā)生重大變化,可變更本合同的有關(guān)內(nèi)容,但需雙方協(xié)商并辦理變更手續(xù)。bothpartieshavetherighttochangethecontractsduetonotbeestimatedexternalconditionsduringtheactualcontractprocesswithnecessarynegotiationandprocedures.7.2本合同期滿即行終止,甲乙雙方如需延長勞動合同期限,應(yīng)在合同期滿前30天,續(xù)訂延長合同期手續(xù)。乙方在本企業(yè)工作滿10年以上,如甲乙雙方同意續(xù)延勞動合同,可以簽訂無固定期限的勞動合同。theexpirationdateofsignedcontractwillbeconsideredasthenaturaltermination.ifeitherpartyaorpartybintendstocontinuethiscontract,suchintentshallbedeliveredtotheotherparty30dayspriortotheprocessingofcontractterminationbasedonthemutualnegotiation.partybhadtherighttosignlifecontractswithpartyabasedon10yearsworkingforpartyaandpermissionofpartya.7.3乙方達到規(guī)定的退休年齡或因病喪失勞動能力提前退休時,勞動合同自然終止。thelaborcontractexpiresnaturallywhenpartybisintheretirementageorlosesthecapabilitiesduetodisease.7.4符合下列情況之一的,甲方可以解除本合同,辭退乙方。partyahastherighttoterminatethecontractduetothefollowingconditions.7.4.1在試用期內(nèi),甲方認為乙方不符合錄用條件(包括但不限于乙方提供的個人情況不實,乙方的試用表現(xiàn)不符合甲方要求等項情況);partybdoesn’tprovetobesuitablethroughtheperiodofprobationaryperiod.(itincludingandbenotlimitedthatthesituationwhichpartybprovidesisnottrue,andpartybdoesn’tpassthroughtheperiodofprobationary.)7.4.2乙方嚴重違反勞動紀律或甲方規(guī)章制度,以及公司《員工手冊》規(guī)定可以辭退的;partybactsinanywaythatisinseriousviolationofgenerallabordisciplineorviolationofotherregulations,orviolationofhandbook.7.4.3乙方被依法追究刑事責任或被勞動教養(yǎng)的;partybbreaksstatelaw,andhasbeensentencedtopunishmentorforcedlabor.7.4.4嚴重失職、營私舞弊,對甲方利益造成重大損害的。partybisinseriousneglectofduty,orengagesingrafts.7.4.5合同期間發(fā)生計劃外生育者,按政府規(guī)定立即解除勞動關(guān)系。partyawillterminatethelaborcontractwithpartybwhodoesn’tabidebythefamilyplanningaccordingtorelatedregulations.7.5有下列情況之一的,甲方可以解除勞動合同,但是應(yīng)當提前30天通知乙方。partyahastherighttoterminatepartyb’slaborcontractinanyofthefollowingsituationwithwillingtoinformpartyb30daysinadvance.7.5.1乙方不能勝任工作,經(jīng)過培訓或調(diào)整工作崗位后仍不能勝任工作的;partybisdeemedincompetentevenfollowingadditionaltrainingoradjustmentofposition.7.5
