最新停薪留職協(xié)議書2025年通用合同編號:__________latestunpaidleaveagreementThislatestunpaidleaveagreement(the"Agreement")ismadeandenteredintoasof__________(the"EffectiveDate"),andbetween____________________________(the"Employer"),and____________________________(the"Employee").RECITALSWHEREAS,theEmployerisengagedinthebusinessof____________________________,andtheEmployeeisemployedtheEmployeras____________________________;WHEREAS,theEmployeedesirestotakeanunpaidleaveofabsencefromhis/heremploymentwiththeEmployerforaspecifiedperiodoftime;NOW,THEREFORE,inconsiderationofthemutualpromisescontainedherein,thepartiesheretoagreeasfollows:1.UnpaidLeave1.2DuringtheLeavePeriod,theEmployeeshallbeconsideredonleavewithoutpayandshallnotbeendtoreceiveanysalaryorwagesfromtheEmployer.1.3TheEmployeeshallberesponsibleforensuringthatallnecessarydocumentation,includingbutnotlimitedtomedicalcertificatesorothersupportingdocumentation,isprovidedtotheEmployerinatimelymannertosupporttheEmployee'sapplicationfortheunpaidleaveofabsence.2.BenefitsandObligations2.1DuringtheLeavePeriod,theEmployeeshallnotbeendtoreceiveanybenefits,includingbutnotlimitedtohealthinsurance,dentalinsurance,paidtimeoff,oranyotherbenefitsprovidedtheEmployertoitsemployees.2.2TheEmployeeshallberesponsibleformakingarrangementswiththerelevantbenefitproviderstocontinueanynecessaryinsurancecoverageduringtheLeavePeriod,andshallbesolelyresponsibleforanycostsassociatedtherewith.3.ReturntoWork3.2IftheEmployeefailstoreturntoworkattheendoftheLeavePeriod,theEmployershallhavetherighttoterminatetheEmployee'semploymentinaccordancewiththetermsofthisAgreement.4.Termination4.1ThisAgreementmaybeterminatedeitherpartyatanytimeforanyreasonuponwrittennoticetotheotherparty.4.2IntheeventofterminationofthisAgreement,theEmployeeshallbeendtoreceiveanyaccruedbutunusedpaidtimeofftothedateoftermination,subjecttotheEmployer'spoliciesandproceduresregardingpaidtimeoff.5.EntireAgreement5.1ThisAgreementconstitutestheentireagreementbetweenthepartiesheretowithrespecttothesubjectmatterhereofandsupersedesallprioragreements,understandings,negotiations,anddiscussions,whetheroralorwritten,oftheparties.5.2ThisAgreementmaybeamendedormodifiedonlyawritteninstrumentexecutedbothparties.6.GoverningLawandJurisdiction6.1ThisAgreementshallbegovernedandconstruedinaccordancewiththelawsofthe____________________(the"GoverningJurisdiction").6.2AnydisputesarisingoutoforinconnectionwiththisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsoftheGoverningJurisdiction.INWITNESSWHEREOF,thepartieshaveexecutedthisAgreementasoftheEffectiveDate.Employer:____________________________By:____________________________Name:Title:Employee:____________________________By:____________________________Name:Title:一、附件列表:1.Employee'sApplicationforUnpaidLeave2.MedicalCertificateorothersupportingdocumentation3.InsuranceApplicationandPolicy4.ConfidentialityAgreement5.NonSolicitationandNonCompetitionAgreement6.Employer'sPoliciesandProceduresregardingPaidTimeOff二、違約行為及認定:1.FailureoftheEmployeetoprovidethenecessarydocumentationtosupporttheapplicationforunpaidleave.2.FailureoftheEmployeetomaintainnecessaryinsurancecoverageduringtheLeavePeriod.3.FailureoftheEmployeetoreturntoworkattheendoftheLeavePeriod.4.TerminationofthisAgreementeitherpartywithoutwrittennotice.5.AmendmentsormodificationstothisAgreementwithoutwritteninstrumentexecutedbothparties.三、法律名詞及解釋:1.UnpaidLeave:AperiodoftimeduringwhichtheEmployeeisabsentfromemploymentwithoutreceivingsalaryorwages.2.LeavePeriod:ThespecificperiodoftimeforwhichtheEmployeeisendtotakeanunpaidleaveofabsence.3.Benefits:Anyincentives,advantages,orprivilegesprovidedtheEmployertoitsemployees,includingbutnotlimitedtohealthinsurance,dentalinsurance,andpaidtimeoff.4.Obligations:AnydutiesorresponsibilitiesrequiredoftheEmployeeunderthisAgreementoranyotheragreementswiththeEmployer.5.GoverningJurisdiction:ThejurisdictionwhoselawsshallgovernandconstruethisAgreement.四、執(zhí)行中遇到的問題及解決辦法:2.Insurancecoverageisnotmaintained:TheEmployeeshouldbeinformedoftheimportanceofmaintaininginsurancecoverageduringtheLeavePeriodandprovidedwithguidanceonhowtoarrangeforcontinuedcoverage.TheEmployeeshouldberesponsibleforanycostsassociatedwiththecontinuedinsurancecoverage.3.Employeefailstoreturntowork:IftheEmployeefailstoreturntoworkattheendoftheLeavePeriod,theEmployershouldprovidewrittennoticetotheEmployeeoftherequirementtoreturntowork.IftheEmployeestillfailstoreturn,theEmployermayterminatetheEmployee'semploymentinaccordancewiththetermsofthisAgreement.4.Terminationwithoutwrittennotice:IfeitherpartyterminatesthisAgreementwithoutwrittennotice,theterminatingpartyshouldprovideawrittenexplanationofthereasonforterminationandanyapplicablenoticeperiod.TheotherpartymayhavetherighttoseeklegalremediesinaccordancewiththeGoverningJurisdiction'slaws.5.Amendmentsormodificationswithoutwritteninstrument:Ifeitherpartyattemptstomakeamendments
