海洋運(yùn)輸貨物保險(xiǎn)條款(附英文)(20210910123528)

1、一、責(zé)任范圍本保險(xiǎn)分為平安險(xiǎn)、水漬險(xiǎn)及一切險(xiǎn)三種。被保險(xiǎn)貨物遭受損 失時(shí)，本保險(xiǎn)按照保險(xiǎn)單上訂明承保險(xiǎn)別的條款規(guī)定，負(fù)賠償責(zé)任。一平安險(xiǎn)本保險(xiǎn)負(fù)責(zé)賠償：1、被保險(xiǎn)貨物在運(yùn)輸途中由于惡劣氣候、雷電、海嘯、地震、 洪水自然災(zāi)害造成整批貨物的全部損失或推定全損。當(dāng)被保險(xiǎn)人要 求賠付推定全損時(shí)，須將受損貨物及其權(quán)利委付給保險(xiǎn)公司。被保 險(xiǎn)貨物用駁船運(yùn)往或運(yùn)離海輪的，每一駁船所裝的貨物可視作一個(gè) 整批。推定全損是指被保險(xiǎn)貨物的實(shí)際全損已經(jīng)不可防止，或者恢 復(fù)、修復(fù)受損貨物以及運(yùn)送貨物到原訂目的地的費(fèi)用超過(guò)該目的地 的貨物價(jià)值。2、由于運(yùn)輸工具遭受擱淺、觸礁、漂浮、互撞、與流冰或其他 物體碰撞以及失火、爆

2、炸意外事故造成貨物的全部或部份損失。3、在運(yùn)輸工具已經(jīng)發(fā)生擱淺、觸礁、漂浮、焚毀意外事故的情 況下，貨物在此前后又在海上遭受惡劣氣候、雷電、海嘯等自然災(zāi) 害所造成的部份損失。4、在裝卸或轉(zhuǎn)運(yùn)時(shí)由于一件或數(shù)件整件貨物落海造成的全部或 部份損失。5、被保險(xiǎn)人對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物采取搶救、防止或減 少貨損的措施而支付的合理費(fèi)用，但以不超過(guò)該批被救貨物的保險(xiǎn) 金額為限。6、運(yùn)輸工具遭遇海難后，在避難港由于卸貨所引起的損失以及 在中途港，避難港由于卸貨，存?zhèn)}以及運(yùn)送貨物所產(chǎn)生的特別費(fèi)用。7、共同海損的犧牲、分?jǐn)偤途戎M(fèi)用。8、運(yùn)輸契約訂有“船舶互撞責(zé)任條款，根據(jù)該條款規(guī)定應(yīng)由 貨方歸還船方的損失。

3、二水漬險(xiǎn)除包括上列平安險(xiǎn)的各項(xiàng)責(zé)任外，本保險(xiǎn)還負(fù)責(zé)被保險(xiǎn)貨物由 于惡劣氣候、雷電、海嘯、地震、洪水自然災(zāi)害所造成的部份損失。三一切險(xiǎn)除包括上列平安險(xiǎn)和水漬險(xiǎn)的各項(xiàng)責(zé)任外，本保險(xiǎn)還負(fù)責(zé)被保 險(xiǎn)貨物在運(yùn)輸途中由于外來(lái)原因所致的全部或局部損失。二、除外責(zé)任本保險(xiǎn)對(duì)以下?lián)p失不負(fù)賠償責(zé)任：一被保險(xiǎn)人的成心行為或過(guò)失所造成的損失。二屬于發(fā)貨人責(zé)任所引起的損失。三在保險(xiǎn)責(zé)任開(kāi)始前，被保險(xiǎn)貨物已存在的品質(zhì)不良或數(shù) 量短差所造成的損失。四被保險(xiǎn)貨物的自然損耗、本質(zhì)缺陷、特性以及市價(jià)跌落; 運(yùn)輸遲延所引起的損失或費(fèi)用。五本公司海洋運(yùn)輸貨物戰(zhàn)爭(zhēng)險(xiǎn)條款和貨物運(yùn)輸罷工險(xiǎn)條款 規(guī)定的責(zé)任范圍和除外責(zé)任。三、責(zé)任起訖一本保

4、險(xiǎn)負(fù)“倉(cāng)至倉(cāng)責(zé)任，自被保險(xiǎn)貨物運(yùn)離保險(xiǎn)單所 載明的起運(yùn)地倉(cāng)庫(kù)或儲(chǔ)存處所開(kāi)始運(yùn)輸時(shí)生效，包括正常運(yùn)輸過(guò)程 中的海上、陸上、內(nèi)河和駁船運(yùn)輸在內(nèi)，直至該項(xiàng)貨物到達(dá)保險(xiǎn)單 所載明目的地收貨人的最后倉(cāng)庫(kù)或儲(chǔ)存處所或被保險(xiǎn)人用作分配、 分派或非正常運(yùn)輸?shù)钠渌麅?chǔ)存處所為止。如末抵達(dá)上述倉(cāng)庫(kù)或儲(chǔ)存 處所，那么以被保險(xiǎn)貨物在最后卸載港全部卸離海輪后滿六十天為止。 如在上述六十天內(nèi)被保險(xiǎn)貨物需轉(zhuǎn)運(yùn)到非保險(xiǎn)單所載明的目的地時(shí), 那么以該項(xiàng)貨物開(kāi)始轉(zhuǎn)運(yùn)時(shí)終止。二由于被保險(xiǎn)人無(wú)法控制的運(yùn)輸延遲、繞道、被迫卸貨、 重行裝載、轉(zhuǎn)載或承運(yùn)人運(yùn)用運(yùn)輸契約賦予的權(quán)限所作的任何航海 上的變更或終止運(yùn)輸契約，致使被保險(xiǎn)貨物運(yùn)到非保險(xiǎn)

5、單所載明目 的地時(shí)，在被保險(xiǎn)人及時(shí)將獲知的情況通知保險(xiǎn)人，并在必要時(shí)加 繳保險(xiǎn)費(fèi)的情況下，本保險(xiǎn)仍繼續(xù)有效，保險(xiǎn)責(zé)任按以下規(guī)定終止。1、被保險(xiǎn)貨物如在非保險(xiǎn)單所載明的目的地出售，保險(xiǎn)責(zé)任至 交貨時(shí)為止，但不管任何情況下，均以被保險(xiǎn)貨物在卸載港全部卸 離海輪后滿六十天為止。2、被保險(xiǎn)貨物如在上述六十天期限內(nèi)繼續(xù)運(yùn)往保險(xiǎn)單所載原目 的地或其他目的地時(shí)，保險(xiǎn)責(zé)任仍按上述第一款的規(guī)定終止。四、被保險(xiǎn)人的義務(wù)被保險(xiǎn)人應(yīng)按照以下規(guī)定的應(yīng)盡義務(wù)辦理有關(guān)事項(xiàng)，如因未履 行規(guī)定的義務(wù)而影響保險(xiǎn)人利益時(shí)，本公司對(duì)有關(guān)損失，有權(quán)拒絕 賠償。一當(dāng)被保險(xiǎn)貨物運(yùn)抵保險(xiǎn)單所載明的目的港地以后， 被保險(xiǎn)人應(yīng)及時(shí)提貨，當(dāng)發(fā)現(xiàn)被

6、保險(xiǎn)貨物遭受任何損失，應(yīng)即向保 險(xiǎn)單上所載明的檢驗(yàn)、理賠代理人申請(qǐng)檢驗(yàn)，如發(fā)現(xiàn)被保險(xiǎn)貨物整 件缺少或有明顯殘損痕跡應(yīng)即向承運(yùn)人、受托人或有關(guān)當(dāng)局海關(guān)、 港務(wù)當(dāng)局等索取貨損貨差證明。如果貨損貨差是由于承運(yùn)人、受 托人或其他有關(guān)方面的責(zé)任所造成，并應(yīng)以書(shū)面方式向他們提出索 賠，必要時(shí)還須取得延長(zhǎng)時(shí)效的認(rèn)證。二對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物，被保險(xiǎn)人和本公司都可 迅速采取合理的搶救措施，防止或威少貨物的損失，被保險(xiǎn)人采取 此項(xiàng)措施，不應(yīng)視為放棄委付的表示，本公司采取此項(xiàng)措施，也不 得視為接受委付的表示。三如遇航程變更或發(fā)現(xiàn)保險(xiǎn)單所載明的貨物、船名或航程 有遺漏或錯(cuò)誤時(shí)，被深險(xiǎn)人應(yīng)在得悉后立即通知保險(xiǎn)人并

7、在必要時(shí) 加繳保險(xiǎn)費(fèi)，本保險(xiǎn)才繼續(xù)有效。四在向保險(xiǎn)人索賠時(shí)，必須提供以下單證：保險(xiǎn)單正本、提單、發(fā)票、裝箱單、磅碼單、貨損貨差證明、 檢驗(yàn)報(bào)告及索賠清單。如涉及第三者責(zé)任，還須提供向責(zé)任方追償 的有關(guān)函電及其他必要單證或文件。五在得悉有關(guān)運(yùn)輸契約中“船舶互攜責(zé)任條款的實(shí)際責(zé) 任后，應(yīng)及時(shí)通知保險(xiǎn)人。五、索賠期限本保險(xiǎn)索賠時(shí)效，認(rèn)被保險(xiǎn)貨物在最后卸裁港全部卸離海輪后 起算，最多不超過(guò)二年。oceanmarinecargoclausesi. scopeofcover:thisinsuranceisclassifiedintothefollowingthreecondition s-freefrom
