RENT CONTENT1.1 租賃地址:甲方將其位于的商鋪?zhàn)赓U給乙方作商業(yè)經(jīng)營用途。甲方 對(duì)所出租的商鋪具有合法產(chǎn)權(quán)、并出示房 產(chǎn)證(或具有出租權(quán)的有效證明)、身份證明 等文件;乙方也應(yīng)提供身份證明文件。雙方 可復(fù)印對(duì)方文件備存。所有復(fù)印件僅供本 次租賃使用,不得挪作它用。1.
4、2 LOCATION: Part B rent the 正式協(xié)議示范文木協(xié)議編號(hào):QC/RE-KA3985shop located on from Part A forcommercial business purposes. The shop is the legal property owned by Part A, and showed the property ownership certificate (or other certificate can prove the Part A have the rights to rent the shop legally), identi
5、fications and otherdocuments which needed for law; Party B should also provide identification. The two parties can copy each other documents forkeeping. All copies can use for the rent affairs only, and can not be used for any other purpose.1.3 租賃面積:甲方租賃給乙方的商 鋪建筑面積為 平方米,使用面積為一平方米。甲方將該商鋪交付乙方使用時(shí),商 鋪結(jié)構(gòu)
6、及配套設(shè)施為:簡裝修。承租期內(nèi)乙 方在不改變和影響房屋整體結(jié)構(gòu)的前提 下,可進(jìn)行裝修裝飾、對(duì)室內(nèi)空間進(jìn)行重 新劃分;若期滿不續(xù)租,其裝修材料由乙方 自行處理,若拆除,其費(fèi)用由乙方自理。1.4 AREA: The area of the shop is m2(SQUARE METERS), in this area,m2 can be used. When Part A put into serviced the shop to Part B, the shop building structure and the supporting equipments was: SIMPLE DECORA

During the rent time,Part B have the rights to decorate the shop and redistrict the space but can not change and influrence the building structure; When the contract be expired and do not renew, Part B have allrights to handle the decorations, if dismantle the decorations, Part B pay all the c
8、ost第二條租賃期限2. TERM OF CONTRACT2.1 租賃期限:甲乙雙方商定,租賃期 限自年月日起至24 : 00止,共力影響導(dǎo)致 的合同終止情形外,任何一方不得破壞租 賃期限的完整和連續(xù)。2.1 CONTRACTPERIOD: After both parties agreed, the term of contract is: stcontract terminated and the force majeure due to the influence of the contract to be terminated, either parties can not destr
9、oy the integrity and continuity of the contract.2.2 裝修免租期:甲方承諾自交付商鋪給乙方的第一個(gè)月給乙方做裝修,免其 租金。即自20xx年06月01日起20xx年 07月01日止。租金從次月開始收取。2.3 RENTAL-FREE PERIOD: Part Apromised to make the first month to be RENTAL-FREE PERIOD after the shop be able to use for Part B. The period stst22.4 續(xù)租:合同期滿后,甲方如繼續(xù)出 租該商鋪,則同等
10、條件下,乙方可享有優(yōu)先承 租權(quán)。乙方如有意續(xù)租,可于合同期滿前30 天向甲方提出,雙方另行協(xié)商,訂立新的租賃 合同。2.5 CONTRACT EXTENSION: After the contract be expired, if the shop still be able to be rent, Part B have the priority right to rent. If Part B have the mind contract be expired, after negotiated, create the new rent contract2.6 合同的中止2.4 CONTR
11、ACT TERNIMATION2.4.1 乙方有如下情形之一時(shí),甲方有權(quán) 提前中止合同,收回商鋪:a,乙方利用該商鋪從事非法活動(dòng)或損 害公共利益的;b,乙方拖欠租金超過2.4.2 Under the follow status of Part Bz Part A have the rights to terminatethe contract, take back the shop: a, Part B use the shop to do the illegal or public-interests damagingactivities;2.4.3 甲方有如下情形之一時(shí),乙方有權(quán) 提前中止
12、合同:a,甲方不能提供商鋪或提供商鋪不符合條件,嚴(yán)重影響乙方正常使用;b,甲方未盡 房屋修繕義務(wù),嚴(yán)重影響乙方正常使用 的。2.4.4 Under the follow status of Part Az Part B have the rights to terminatethe contract:a, Part A can not offer the shop or the shop mismatch conditions,seriously affect the normal using of Part B;bz Part A does not matter the obligation
13、s, seriously affect the normal use of Part B.第三條租金及其支付方式和其它費(fèi)用3. RENTAL, MODE OF PAYMENT AND OTHER CHARGES3.1 年租金總額:甲乙雙方商定,租賃 期內(nèi)該商鋪的年租金為(大寫:人民 幣 圓整),合同期限內(nèi)無浮動(dòng)。3.2 TOTALOF YEAR RENTAL: A代er both parties negotiated, the year rental is (RMB) during the contract period, and no fluctuate.3.3 租金的支付:租金按年計(jì)算按半
14、年 收付。乙方在每半年到期后月份的5日前 將下半個(gè)年度租金以現(xiàn)金或轉(zhuǎn)帳方式一次 交付到甲方(節(jié)假日可順延)。甲方收款后應(yīng) 提供給乙方有效的收款憑證。3.4 RENTAL PAYMENT: The rental11正式協(xié)議示范文木協(xié)議編號(hào):QC/RE-KA3985calculation is ANNUAL RENTAL PartB pay the rental as CASH or BANK TRANSFER to Part A in 5th of the next month after every half year period expired in one time(can postpo

Part have the obligations to offer the valid voucher to Part B.3.5 首期款的支付:訂立本合同后甲方 將商鋪交付乙方裝修時(shí),乙方一次向甲方交 納相當(dāng)于租金總額10%(百分之十)共計(jì) (大寫:人民幣圓整);免租期過后,乙方一次性補(bǔ) 交租金支付周期內(nèi)的當(dāng)期房租;3.6 THE MODE OF PAYMENT OF FIRSTINSTALLMENT: When Part A put into service shop to Part B for decorating after this contrac
16、t be signed, Part B pay 10% of total rental in one time, it is: (RMB); A代er RENTAL-FREE PERIOD, Part B pay the remainder rental in this RENTAL PERIOD to Part A in one time;3.7 水、電費(fèi)及其他公用事業(yè)費(fèi):合同 期內(nèi),政府對(duì)租賃物征收的有關(guān)稅、費(fèi)項(xiàng),由 甲方負(fù)責(zé)繳交,該商鋪的衛(wèi)生費(fèi)、電費(fèi)、 水費(fèi)及經(jīng)營活動(dòng)產(chǎn)生的一切費(fèi)用由乙方負(fù) 責(zé),乙方應(yīng)如期足額繳交上述應(yīng)繳費(fèi)用,如因 乙方欠費(fèi)造成向甲方追繳時(shí),甲方有權(quán)向乙 方追繳。3.8
17、WATER,ELECTRIC AND OTHER PUBLIC UTILITY CHARGES: During contract period, Part A pay all the tax and charges, etc government revenue from the shop, and Part B pay the clean, electric, water and all the charges because the business, Part B have the obligations to pay the charges enough and on time, if
18、 Part A be disgorged from other parties cause Part B arrears, Part A have the rights to disgorge from Part B.3.9 合同簽訂時(shí)水電表使用情況: 水表:噸電表:度合同簽訂時(shí)最近一期水電費(fèi)繳納憑據(jù) 經(jīng)雙方簽字確認(rèn)后以附件形式加入本合 同。3.10 The status of water and electric meters when contract be signed: WATER METER:TON(ES)ELECTRIC METER:KWH(S)The copies of the
19、latest water and electric charged voucher be confirmed and signed by both parties then add into the contract as annex.第四條招牌設(shè)置4. SHOP SIGN SETTING甲方同意乙方在符合國家法律、法 規(guī)、政府規(guī)章和規(guī)范性文件的前提下,在租賃商鋪的室內(nèi)外安裝設(shè)置帶有其公司標(biāo) 志的招牌等廣告裝置(例如帶照明的透明廣 告燈箱、立牌和戶外廣告招牌等),并協(xié)助 乙方做好跟物業(yè)裝修申請(qǐng)、施工以及廣告 設(shè)置的交涉工作。Part A agreed Part B set the shop s
20、igns and other advertising equipments with company logo(such as: illuminating transparent advertising lamp box, erect signs and outside advertising signs, etc.) in outside of the shop comply with the state laws, regulations, government regulations and normative documents, and Part A have the obligat
21、ions to assist Part B to apply to the property management company, construction and other signs setting works needed negotiate with other parties.第五條雙方的責(zé)任和權(quán)利5. OBLIGATIONS AND RIGHTS5.1 甲方的責(zé)任和權(quán)利5.1 OBLIGATIONS AND RIGHTS OFPART Aa,甲方應(yīng)保證所出租的商鋪及配套設(shè)施 在交付乙方使用時(shí)完好并能夠正常使用;a, Part A have the obligation to i
22、ssue the shop and supportingequipments condition is good and can be use normally;b按公共契約負(fù)責(zé)商鋪結(jié)構(gòu)維修和保 養(yǎng),凡遇政府部門要求需對(duì)商鋪或配套設(shè)施進(jìn)行改造時(shí),相關(guān)費(fèi)用由甲方負(fù) 責(zé);b, Part A have the obligation to repair and maintenance the shopstructures, in every case of government requests reconstruct shop orsupporting equipments, Part A pay
23、all the charges;C,負(fù)責(zé)協(xié)調(diào)本地區(qū)各有關(guān)部門的關(guān)系, 并為乙方辦理營業(yè)執(zhí)照提供有效的房產(chǎn)證明及相關(guān)手續(xù);cz Part A have the obligation to coordinate the relationships with all the departments in the shop located district, and offer the valid property ownership certificate and other document be relate to Part B apply the business license;d,不得以任
24、何理由占用乙方所租門面 及其附屬設(shè)施,如門面前面的空地等。d, Part A can not occupy the shop and equipments which the Part B with any reason, such as the empty land outside of the shop.5.2乙方的責(zé)任和權(quán)利a,合同有效期內(nèi),乙方對(duì)所租賃的商鋪及配套設(shè)施擁有合法使用權(quán);a, Part B have the legal right to use the rented shop and supportingequipments during the rent period;b
25、,乙方應(yīng)遵守國家法律,法規(guī),依法經(jīng)營;b, Part B have the obligations to do business as the state law, regulations;C,乙方不得在租賃的商鋪內(nèi)貯存危險(xiǎn)、 違禁物品;c, Part B can not store the dangers, prohibited goods in the shop;d,乙方必須依約繳納租金及其他因經(jīng) 營產(chǎn)生的費(fèi)用,不得無故拖欠;d, Part B have the obligations to19正式協(xié)議示范文木協(xié)議編號(hào):QC/RE-KA3985pay rental and other ch
26、arges causebusiness on time, can not arrears without reason;e,乙方在承租的商鋪內(nèi)需要安裝或者使 用超過水、電表容量的任何水電設(shè)備,應(yīng)事 前征得甲方同意,并由乙方負(fù)責(zé)到有關(guān)部門 辦理增容手續(xù),費(fèi)用由乙方負(fù)擔(dān);e, Part B have the obligation to get the authorization from Part A when install the equipments7 value over the limited of the water and electricmeters value, Part B a
27、lso have obligation to make the application to the related department and pay all the charges;e,租賃期滿或者解除合同時(shí),所屬乙方 的財(cái)物,均由乙方自行處理,甲方不得以 任何理由進(jìn)行任何形式的干涉;e, When the contract be expired or terminated, all the properties owned by Part B, Part B have the rights to handle the properties, Part A can not interfe
28、re with any reason in any modality;f,租賃期滿或者解除合同時(shí),由甲乙雙方 共同檢查商鋪和配套設(shè)施,檢查無異議后,商鋪交還甲方。如發(fā)現(xiàn)有損壞 的,則由乙方照價(jià)負(fù)責(zé)賠償。t When the contract be expired or terminated, both parties need check the shop and supporting equipments together, after either partiesconfirmed, Part A take back the shop. If anything be broken, Par
29、t Bneed pay for as market price.第六條出租方和承租方的變更6. PARTIES CHANGE6.1 產(chǎn)權(quán)人與承租人:合同期內(nèi),甲方 和乙方中任何一方法定代表人(或產(chǎn)權(quán)人)變 更、企業(yè)遷址、合并,不影響本合同繼續(xù)履 行。變更、合并后的一方即成為本合同當(dāng) 然執(zhí)行人,并承擔(dān)本合同的內(nèi)容之權(quán)利和義 務(wù);6.2 OWNER AND RENTER: During contract period, either of both parties legal representative(or property owner) be changed, company moved o
30、rmerged, will not influence the contract continue perform. Anyone fter change, merge be the successor will be the performer; and assume all the rights and obligations in the contract;6.3 轉(zhuǎn)租:合同期內(nèi),乙方如欲將租賃的 商鋪轉(zhuǎn)租給第三方時(shí),必須事先征得甲方同 意,并由三方書面確認(rèn),取得使用權(quán)的第三方 成為本合同的當(dāng)然乙方,繼續(xù)履行本合同;6.4 SUBLEASE: During contract period

32、st written inform Part B at least 3 months before, and must issue the rent period in the contract.第七條違約及處理7. DEFAULT AND DISPOSE7.1 任何一方未能履行本合同規(guī)定的條款的,均視為違約;7.2 Either parties can not perform the rules and conditions in the contract, all deemed to be default;7.3 若乙方違約,甲方有權(quán)提前解除合 同,并無需退還已繳納的房屋租金;7.3.1
33、f Part B defaulted, Part A have the rights to terminate the contract and do not need pay back the paid rental;7.4 若甲方違約,乙方有權(quán)提前解除合 同,且甲方必須雙倍退還乙方已繳納但未 完成使用期限的全部租金,并賠償乙方裝 修費(fèi)。裝修費(fèi)賠償標(biāo)準(zhǔn):若第一年內(nèi)違 約,賠償全部裝修款(100%),以實(shí)際裝修 情況計(jì)算;若第二年違約。賠償裝修款的 70% ,以實(shí)際裝修情況計(jì)算;若第三年違 約,賠償裝修款的50% ,以實(shí)際裝修情況 計(jì)算;7.5 If Part A defaulted, Par

The decoration compensation standard is: 1st year, pay for 100% of thedecoration cost, count as the actually payment;2nd year, pay for 70% of the decoration cost, count a
35、s the actually paymentt;3rd year; pay for 50% of the decoration cost, count as the actually payment7.6 :違約方逾期向守約方賠付違約金或 逾期向守約方賠償經(jīng)濟(jì)損失的,每逾期一天, 守約方有權(quán)向違約方加收實(shí)欠違約金總額 1%的滯納金;7.7 The defaulter who arrears, need pay the liquidated damages to opposite party, arrears every 1 day, performer have the rights to c
36、harge 1% of the total arrearage;7.8 :因不可抗拒的因素引起本合同不能正常履行時(shí),不視為違約,雙方互免承擔(dān)違約 責(zé)任。7.9 The force majeure due to the influence of the contract to be can not continue perform, do not deemed to be default, both parties avoid each other s obligations.第八條合同生效及糾紛處理8.1:本合同自雙方簽字加印手印(右手 食指)后即生效,具有法律效力;8.1 After signature and finger printed(right index finger), this contract be go into effect with the force of law;82本合同未盡事宜,甲乙雙方通過協(xié) 商議定,制訂補(bǔ)充協(xié)議,補(bǔ)充
