互聯(lián)網(wǎng)使用管理規(guī)定1.目的Objectives為了確保員工僅將互聯(lián)網(wǎng)運(yùn)用于與工作相關(guān)的業(yè)務(wù),并遵守公司相關(guān)的規(guī)定。ToensureInternetusagesisstrictlyforbusinessespurposes,andcomplywiththecodeofconduct.2.適用范圍Areaapplication適用于電子郵件,網(wǎng)頁(yè)瀏覽,文件傳送或其他任何基于網(wǎng)絡(luò)的工具的使用。Usageofemail,internetbrowsing,filetransferoranyrelatedtoolsusedontheInternetmedium.3.規(guī)范性引用文件Referencedocuments無(wú)None4.職責(zé)DutyIT部門負(fù)責(zé)監(jiān)控與管理所有相關(guān)的網(wǎng)絡(luò)使用。ITdepartmentisresponsibleforthemonitoringandadministeringallrelatedInternetusageactivities.IT負(fù)責(zé)確保提供互聯(lián)網(wǎng)的可用性以提供相關(guān)訪問(wèn)互聯(lián)網(wǎng)的服務(wù)。ITisresponsibleforensuringInternetinfrastructureavailabilitytoprovideaccessofInternetrelatedservices.5.術(shù)語(yǔ)和定義Glossaryanddefinition無(wú)None6.管理內(nèi)容Content6.1Suntech-Power為員工提供了計(jì)算機(jī)設(shè)備、內(nèi)外部網(wǎng)絡(luò)連接(包括互聯(lián)網(wǎng)),使得員工可以更有效率的溝通,為客戶提供更好的服務(wù)和達(dá)成Suntech-Power的營(yíng)業(yè)目標(biāo)。Suntech-Powerprovidesouremployeeswithcomputerequipmentandonlineaccesstointernalandexternalnetworks,includingtheInternet,sothatemployeesmaycommunicatemoreefficiently,betterservecustomersandaccomplishthecompany'sbusinessgoals.Suntech-Power嚴(yán)禁使用其所提供的設(shè)備或網(wǎng)絡(luò)從事非法目的訪問(wèn)例如(但不僅限于):未經(jīng)授權(quán)訪問(wèn)或企圖損壞其它計(jì)算機(jī)系統(tǒng)、網(wǎng)絡(luò)或這些系統(tǒng)及設(shè)備中的數(shù)據(jù)。從事盜竊、欺騙或任何其他類型的犯罪行為。散播或取得非法拷貝軟件、圖像、聲音、文本或其它數(shù)據(jù)/材料。發(fā)送或粘貼騷擾性的或脅迫性的信息或含有色情或猥褻內(nèi)容的信息。Suntech-Powerspecificallyprohibitsusingequipmentoronlineaccesswhichitprovidesforanyillegalpurposes,forexample(butnotlimitedto):Gainingunauthorizedaccesstoorintentionallydamagingothercomputersystemsornetworksortheinformationcontainedwithinthecommittingtheft,fraudorothercriminalactsofanykinds.Distributingorobtainingillegallycopiedsoftware,graphics,sounds,text,orothermaterial.Sendingorpostingharassingorthreateningmessagesormessagescontainingpornographicorpatentlyindecentcontent.Suntech-Power將與法律部門合作依法起訴違法者,對(duì)任何違法行為或涉嫌違法的行為,員工必須及時(shí)報(bào)告。Suntech-Powerwillcooperatewithlawenforcementauthoritiestoprosecuteoffenders.Employeemustreportanyillegalactionorsuspectedillegalaction.6.3未經(jīng)全球首席信息執(zhí)行官允許,第三方不得以任何理由直接接觸或通過(guò)電子方式訪問(wèn)Suntech-Power的電子設(shè)備、數(shù)據(jù)或計(jì)算機(jī)。Nodirectthirdpartyphysicalorelectronicaccesstocompanyfacilities,informationorcomputersofantypeorforanyreasonmaybeestablishedwithouttheexpresspermissionoftheITDirector.6.4在線通信可能會(huì)遭到Suntech-Power以外的人的攔截或偵聽,這種攔截或偵聽可能無(wú)法被察覺(jué)。因此,機(jī)密數(shù)據(jù)在未采取例如加密(在傳送前使用軟件改變數(shù)據(jù)型態(tài),收件者在收到后再予以解除)等保護(hù)措施的情況下,不應(yīng)被通過(guò)互聯(lián)網(wǎng)予以傳送,任何加密軟件應(yīng)該由首席信息官提供或經(jīng)其核準(zhǔn),且Suntech-Power也應(yīng)被提供一份員工為上述目的而使用的加密副本及解密方式。OnlinecommunicationsmaybesubjecttointerceptionbypersonsoutsideSuntech-Powerandsuchinterceptionmaynotbedetectable.Therefore,noconfidentialinformationshouldbesentovertheInternetwithoututilizingprotectionsuchasencryption(usingsoftwaretoscramblemessagesbeforetheyaresent,anddescramblethemuponreceipt).AnyencryptionsoftwareshouldbeprovidedorapprovedbytheITDirector,andSuntech-Powershouldbegivenacopyofallencryptionanddecryption“keys”utileziepllcbyeefortheabovepurpose。6.5為了保護(hù)Suntech-Power免于遭受任何版權(quán)侵權(quán)起訴,員工不應(yīng)從任何網(wǎng)絡(luò)下載或存取任何數(shù)據(jù),除非:(a)該網(wǎng)站明顯系官方網(wǎng)站;(b)該數(shù)據(jù)/資料是被合法地允許下載的,且沒(méi)有侵犯任何著作權(quán)或商標(biāo)權(quán)。ToprotectSuntech-Powerfromcopyrightinfringementactions,employeemaynotdownloadorsaveanymaterialfromanyonlinesource,howeverretrieved,uniess(a)thesourceisclearlyofficial,(b)thematerialislegallypermittedtobedownloadedwithoutviolationofcopyrightortrademark.6.6自外部來(lái)源處下載數(shù)據(jù)、信息、圖像、及其他類似物會(huì)增加計(jì)算機(jī)的感染病毒的風(fēng)險(xiǎn)及其它的危害,除非員工確有業(yè)務(wù)方面原因而必須如此行事,否則不應(yīng)自外部取得資料,特別是自那些員工不了解的來(lái)源。任何自外部來(lái)源下載的數(shù)據(jù)/資料都應(yīng)該立即檢測(cè)其是否含有病毒及其它有害成份。信息服務(wù)人員將提供必要的軟件來(lái)做檢測(cè)。Downloadingdata,information,images,andthelikefromanoutsidesourceincreasestheriskstoourcomputersofvirusesandotherdamagingagents.Employeeshouldnotretrievematerialfromoutsidesources,particularlyfromsourcesnotknowntoemployee,unlessemployeehavegoodbusinessreasontodoso.Anymaterialdownloadedfromanoutsidesourceshouldbecheckedimmediatelyforvirusesandotherdamagingelements.Informationservicesstaffwillprovidethenecessarysoftwareandmakeitselfavailabletoemployee.6.7Suntech-Power無(wú)法控制互聯(lián)網(wǎng),我們對(duì)信息的發(fā)送或是訪問(wèn)外部網(wǎng)站不做任何保證/擔(dān)保,例如:?jiǎn)T工的郵件可能沒(méi)有被發(fā)送出去,而員工卻沒(méi)有被通知這項(xiàng)錯(cuò)誤。SUNTECH-POWERdoesnotcontroltheInternet.Wecannotguaranteedeliveryofmessagesoraccesstoexternalwebsites.Forexample,amailmessageemployeesendmayneverbedelivered,andemployeewouldnotbenotifiedofthiserror.6.8當(dāng)訪問(wèn)外部系統(tǒng)時(shí),員工不應(yīng)下載、拷貝、掃描、發(fā)送或接收機(jī)密性的、專有性的或私人的數(shù)據(jù),包括但不僅限于:相應(yīng)文檔、圖像、軟件程序、模型范例及設(shè)計(jì)等。使用者必須尊重他人的著作權(quán)及其它相關(guān)知識(shí)產(chǎn)權(quán)。著作權(quán)法律同樣適用于對(duì)復(fù)印機(jī)、錄放機(jī)、錄音機(jī)等等的使用,且亦嚴(yán)禁違反這些法令。Whenaccessingexternalsystems,employeesshouldnotdownload,copy,scan,sendorreceiveconfidentialorproprietaryinformation,includingbutnotlimitedtodocuments,images,softwareprograms,modelsandprojections.Usersmustrespectthecopyrightandrelatedintellectualpropertyrightsofothers.CopyrightLawsalsoapplytotheuseofphotocopiers,VCR's,taperecorders,etc.,andviolationofsuchlawsisalsoprohibited.6.9所有第三方軟件必須是得到許可的。除非經(jīng)軟件發(fā)行人/出版人允許,否則使用者無(wú)權(quán)復(fù)制該軟件或復(fù)制任何相關(guān)書籍或資料。除非軟件提供方明確準(zhǔn)許,否則該軟件如用于家庭使用必須另行取得許可。Allthirdpartysoftwaremustbeproperlylicensed.Unlessthesoftwarepublisherallowsit,usersdonothavetherighttoreproducethesoftwareoranyrelatedbooksormaterials.Unlessexplicitlypermittedbythevendorinwrittenform,softwaremustbeseparatelylicensedforhomeuse.6.10未經(jīng)某一互聯(lián)網(wǎng)站或其他遠(yuǎn)程系統(tǒng)許可而進(jìn)入或企圖進(jìn)入該網(wǎng)站或系統(tǒng)將構(gòu)成“黑客”行為,并將嚴(yán)重違反Suntech-Power政策。同時(shí)這種行為也可能導(dǎo)致員工遭受民事或刑事訴訟及處罰。Accessing,orattemptingtoaccess,aWebsiteorotherremotesystemwithoutthepermissionofthatsiteisaformof"hacking”andconstitutesaseriousviolationofSuntech-Powerpolicy.Suchactionsmay,inaddition,subjectemployeetocivilandcriminalchargesandpenalties.6.11Suntech-Power連網(wǎng)系統(tǒng)應(yīng)僅為商業(yè)目的使用。所有收發(fā)的外部電子郵件通信都屬于Suntech-Power所有。因此,不應(yīng)期望對(duì)該等通信享有隱私權(quán)。員工在使用Suntech-Power連網(wǎng)系統(tǒng)時(shí)必須尊重他人的著作權(quán)和相關(guān)知識(shí)產(chǎn)權(quán)。TheSuntech-PowerConnectionisintendedtobeusedforbusinesspurposes.Alloutgoingandincomingexternale-mailcommunicationsbelongtoSuntech-Power.Therefore,thereisnoexpectationofprivacyinthesecommunications.EmployeesmustrespectthecopyrightandrelatedintellectualpropertyrightsofotherswhenusingtheSuntech-PowerConnection6.12以下列出一些使用Suntech-Power連網(wǎng)系統(tǒng)時(shí)被禁止的事宜,包括(但不僅限于):證券買賣;以Suntech-Power名義簽訂契約;教唆員工;及參與非法活動(dòng);員工自遠(yuǎn)程(如家中)連接Suntech-Power網(wǎng)絡(luò)時(shí)不得允許外人(如家庭成員)使用Suntech-Power網(wǎng)絡(luò)。此外,禁止使用Suntech-Power互聯(lián)網(wǎng)連接進(jìn)行以下行為:辦理私人交易:下載個(gè)人軟件;玩游戲;從事非法活動(dòng);賭博、打賭或投機(jī);謀取個(gè)人利益;及其它違反倫理或正當(dāng)行為的活動(dòng)。ThereareanumberofprohibitedusesoftheSuntech-PowerConnectionincluding,butnotlimitedto,communications:Regardingthepurchaseorsaleofsecurities,WhichobligateSuntech-Powercontractually,Whichsolicitemployees;andWhichinvolveanyillegalactivities.EmployeesutilizingtheSuntech-PowerConnectionfromaremotelocation(suchashome)arenotpermittedtoallowoutsiders(suchasfamilymembers)tousetheSuntech-PowerConnection.Additionally,itisnotacceptabletouseSuntech-Power'sInternetconnectionforanyofthefollowing:Conductingapersonalbusiness;Downloadingpersonalsoftware;Playinggames;Engaginginanyillegalactivities;Wagering,betting,orsellingchance;Personalgain;andOtheractivitiesoutsidetheboundsofethicalorproperbehaviors.6.13員工經(jīng)由網(wǎng)絡(luò)或其它外部系統(tǒng)或電子郵件及附件所接收的數(shù)據(jù),可能包含其它人的頁(yè)號(hào):5/11文件名:互聯(lián)網(wǎng)使用管理規(guī)定頁(yè)號(hào):5/11文件號(hào):AD-信息技術(shù)-29版本號(hào):A知識(shí)產(chǎn)權(quán)(包括享有著作權(quán)、商業(yè)機(jī)密或商標(biāo)權(quán)的信息),在使用Suntech-Power網(wǎng)絡(luò)時(shí)不得以任何方式侵犯任何人的著作權(quán)或相關(guān)權(quán)利。侵犯著作權(quán)(或其他類似權(quán)利)可能使員工及Suntech-Power因此而受到民事或刑事處罰。如果員工在互聯(lián)網(wǎng)絡(luò)上遇到有興趣的文章,請(qǐng)將其原始來(lái)源推介給其他人而不是直接轉(zhuǎn)發(fā)出去。Materialsinwebsitesorotherexternalsystemsore-mailmessagesandattachments,whichemployeereceive,maycontainintellectualpropertybelongingtoothers(includingcopyrighted,tradesecretortrademarkedinformation).EmployeemaynotusetheSuntech-PowerConnectioninwayswhichinfringeuponanyparty'scopyrightorrelatedrights.Violationsofcopyright(orothersimilarrights)maysubjectemployeeandSuntech-Powertocivilandorcriminalpenalties.IfemployeecomeuponanarticleontheInternetthatisinteresting,referotherstotheoriginalsourceratherthanforwardingit.6.14作為一般準(zhǔn)則,員工不可以轉(zhuǎn)發(fā)、分發(fā)或合并從互聯(lián)網(wǎng)站或其他外部系統(tǒng)獲得的其他作品資料。在某些特定的情況下,方可允許使用“限制使用”或“正當(dāng)使用”;如果員工希望復(fù)制或儲(chǔ)存屏幕或網(wǎng)站上的內(nèi)容,請(qǐng)聯(lián)系人事部門、財(cái)務(wù)或IT部門。然而,在員工自己的計(jì)算機(jī)上瀏覽或觀看這些信息一般是被允許的。Asageneralrule,employeemaynotforward,distributeorincorporateintoanotherworkmaterialretrievedfromawebsiteorotherexternalsystem.Verylimiteduseor"fairuse”maybepermittedincertaincircumstances;ifemployeewishestoreproduceorstorethecontentsofascreenorwebsite,contacttheHR,FinanceorITDepartment.Browsing,orviewingmaterialonemployee'sownPC,is,however,generallypermissible.6.15通過(guò)Suntech-Power網(wǎng)絡(luò)發(fā)送及接收的信息應(yīng)被定期檢查(至少每三十天)及清除或刪除。然而,如果這些信息是有關(guān)訴訟,或預(yù)料會(huì)與訴訟相關(guān),就不適用這類基本規(guī)則。不論何時(shí),如有疑問(wèn),請(qǐng)聯(lián)絡(luò)人事或IT部門。MessagessentandreceivedovertheSuntech-PowerConnectionshouldbereviewedperiodically(atleastevery30days)andpurged,orotherwisedestroyed,ifpossible.However,ifmessagesrelatetoamatterinlitigation,orinwhichlitigationisanticipated,thisgeneralruledoesnotapply.Wheneverindoubt,contacttheHR,FinanceorITDepartment.若員工將那些有傷風(fēng)化的、令人不快的、或其他不當(dāng)內(nèi)容的信息/材料顯示在員工的計(jì)算機(jī)屏幕上或儲(chǔ)存、拷貝、打印、轉(zhuǎn)發(fā)或顯示該等信息/材料,則此等行為均違反Suntech-Power的政策,將會(huì)招致相應(yīng)懲戒,甚至發(fā)生被解雇的后果。AllowingobjectionablematerialtoappearorremainonemployeePCscreenorstoring,copying,printing,forwardingordisplayingsuchmaterialisaviolationof文件名:互聯(lián)網(wǎng)使用管理規(guī)定 發(fā)布日期:2006815Suntech-Powerpolicyandwillsubjecttheusertodisciplinaryactionuptoandincludingdischargefromemployment.6.16Suntech-Power公司有權(quán)禁止訪問(wèn)某些有問(wèn)題的網(wǎng)站,但并不意味著某些沒(méi)有被禁止訪問(wèn)的網(wǎng)站即是被允許瀏覽的。在任何情況下均不得訪問(wèn)那些為公眾所知曉的包含或可能含有有傷風(fēng)化的、令人不快的、或其他不當(dāng)內(nèi)容(包括(但不僅限于):褻瀆性的或其它煽動(dòng)性的信息、色情或其它性暗示的信息/材料)的網(wǎng)站,否則均會(huì)被視為違反公司政策。任何人在收到有傷風(fēng)化的、令人不快的、或其他不當(dāng)內(nèi)容的信息/材料時(shí)均應(yīng)立即通過(guò)電子郵件轉(zhuǎn)發(fā)該信息給人事部門;告知發(fā)送者根據(jù)Suntech-Power的政策這些信息/材料是不當(dāng)?shù)?。任何情況下均不再將此信息轉(zhuǎn)發(fā)給其它人,并且刪除此信息。6.17瀏覽這些網(wǎng)站違反了Suntech-Power的某些政策,包括玷污了Suntech-Power的名聲。網(wǎng)站的管理員可通過(guò)"點(diǎn)擊"率得知有多少來(lái)自Suntech-Power的人員瀏覽過(guò)此網(wǎng)站,其可能會(huì)將這些信息公開并造成Suntech-Power收到損害。將這些含有有傷風(fēng)化的、令人不快的、或其他不當(dāng)內(nèi)容的信息/材料顯示于員工的計(jì)算機(jī)屏幕上或儲(chǔ)存、打印或展示這些信息/材料都可能造成一種有害的工作環(huán)境,并將使員工受到相應(yīng)懲戒,甚至發(fā)生被解雇的后果,而且會(huì)使Suntech-Power及員工招致民事或刑事訴訟和嚴(yán)重的困窘。Suntech-Powerreservestherighttoblockaccesstocertainquestionablesites,butthefactthataccesstocertainsitesisnotblocked,doesnotmeanthatitispermissibletovisitthatsite.Connectingtowebsitesthatareknowntocontainorsuspectedofcontainingobjectionablematter,includingbutnotlimitedto,profaneorotherwiseinflammatorymessages,pornographicorothersexuallyexplicitmaterialofanykind,wouldviolateseveralofourpoliciesmustnotoccurunderanycircumstances.Anyonewhoreceivesobjectionablematerialshould:Immediatelyforwardthemessageviae-mailto"HumanResources”;InformthesenderthatSuntech-Powerpolicyconsidersthematerialobjectionable;Undernocircumstancesforwardthemessagetoanyotherperson;andDeletethemessage.VisitingsuchsitesviolatesseveralpoliciesincludingrepresentingSuntech-Powerinanunfavorablelight.Operatorsofwebsitesknowhowmany"hits”arefromSuntech-PowerandcouldpublicizesuchinformationtoSuntech-Power'sdetriment.AllowingobjectionablematerialtoappearonemployeerPCscreenorstoring,printingoutordisplayingsuchmaterialmayconstitutethecreationofahostileworkenvironment,subjectingemployeetodisciplinaryactionuptoand文件名:互聯(lián)網(wǎng)使用管理規(guī)定
