36、設(shè)定試用期：合同期限不滿 6 個月的，不設(shè)定試用期；合同期限滿 6 個月不滿 1年的，試用期 1 個月；合同期限滿 1 年不滿 3 年的，試用期 2 個月；合同期限滿 3 年以上的，試用期不超過 6 個月。試用期包括在勞動合同期限中。第 14 條 企業(yè)與職工協(xié)商一致， 可以訂立無固定期限勞動合同。 有下列情形之一，職工提出或者同意續(xù)訂、 訂立勞動合同的， 除職工提出訂立固定期限勞動合同外，企業(yè)與職工一律訂立無固定期限勞動合同：（ 1）職工在企業(yè)連續(xù)工作滿十年的；（ 2）連續(xù)訂立二次固定期限勞動合同，且職工沒有勞動合同法第三十九條和第四十條第一項(xiàng)、第二項(xiàng)規(guī)定的情形，續(xù)訂勞動合同的。第 15 條

51、動合同；勞動合同期滿，勞動合同應(yīng)當(dāng)續(xù)延至相應(yīng)的情形消失時終止：（ 1）從事接觸職業(yè)病危害作業(yè)的勞動者未進(jìn)行離崗前職業(yè)健康檢查，或者疑似職業(yè)病病人在診斷或者醫(yī)學(xué)觀察期間的；（ 1）患職業(yè)病或因工負(fù)傷被確認(rèn)完全喪失或部分喪失勞動能力的；（ 2）患病或非因工負(fù)傷，在規(guī)定的醫(yī)療期內(nèi)的；（ 3）女職工在符合計(jì)劃生育規(guī)定的孕期、產(chǎn)期、哺乳期內(nèi)的；（ 4）在本企業(yè)連續(xù)工作滿十五年，且距法定退休年齡不足五年的；（ 5）法律、法規(guī)、規(guī)章規(guī)定的其他情形。第 19 條 企業(yè)有下列情形之一的，職工可以隨時通知解除勞動合同：（ 1）未按照勞動合同約定提供勞動保護(hù)或者勞動條件的；（ 2）未及時足額支付勞動報(bào)酬的；（ 3）未依法為職工繳納社會保險費(fèi)的；（ 4）企業(yè)的規(guī)章制度違反法律、法規(guī)的規(guī)定，損害勞動者權(quán)益的；（ 5）因勞動合同法第二十六條第一款規(guī)定的情形致使勞動合同無效的；（ 6）法律、行政法規(guī)規(guī)定勞動者可以解除勞動合同的其他情形。企業(yè)以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫職工勞動的， 或者企業(yè)違章指揮、強(qiáng)令冒險作業(yè)危及勞動者人身安全的， 職工可以立即解除勞動合同， 不需事先告知企業(yè)。職工依本條規(guī)定解除勞動合同，企業(yè)應(yīng)依法支付職工經(jīng)濟(jì)補(bǔ)償金。第 20 條職工提前 30 日以書面形式通知企業(yè)， 可以解除勞動合同。 職工在試用;.in order to
