However,alossforOlsonandBoiescouldbeamajorsetbacktothemovementformarriageequality.SoonafterOlsonandBoiesfiledthecase,lastMay,someleadinggay-rightsorganizations—amongthemtheA.C.L.U.,HumanRightsCampaign,LambdaLegal,andtheNationalCenterforlesbianRights—issuedastatementcondemningsuchefforts.Theoddsofsuccessforasuitweren’tgood,thegroupssaid,becausethe“SupremeCourttypicallydoesnotgettoofaraheadofeitherpublicopinionorthelawinthemajorityofstates.”Thelegalprecedentthatthesegroupswerefocusedonwasn’tLovingv.Virginiabut,rather,Bowersv.Hardwick,the1936SupremeCourtdecisionthatstunnedgay-rightsadvocatesbyupholdingGeorgia’santiquatedlawagainstsodomy.ItwasseventeenyearsbeforetheCourtwaswillingtorevisittheissue,inLawrencev.Texas,thoughbythenonlythirteenstatesstillhadanti-sodomystatutes;thistime,theCourtoverturnedthelaws,witha6-3voteandanacerbicdissentfromJusticeAntoninScalia,whodeclaredthattheCourthadaligneditselfwiththe“homosexualagenda,”adding,“ManyAmericansdonotwantpersonswhoopenlyengageinhomosexualconductaspartnersintheirbusiness,asscoutmastersfortheirchildren,asteachersintheirchildren’sschools,orasboardersintheirhome.Theyviewthisasprotectingthemselvesandtheirfamiliesfromalifestylethattheybelievetobeimmoralanddestructive.”
