第頁共頁場地租賃合同英文場地租賃合同英文。合同編號:ContractNumber:出租方〔甲方〕:Lessor〔PartyA〕:承租方〔乙方〕Lessee〔PartyB〕:根據(jù)《中華人民共和國合同法》及其他法律法規(guī)的規(guī)定,甲乙雙方在自愿、平等、公平、老實信譽的根底上,就會展場地租賃的有關(guān)事宜達(dá)成如下協(xié)議。Inaccordancewith“ContractLawofthePeople‘sRepublicofChina”andotherrelevantlawsandregulations,thePartieshave,basedontheprinciplesofequality,willingness,fairness,honestandcredit,enteredintotheContractconcerningissuesrelatedtoleaseofexhibitionplaceandagreedasfollows:第一條租賃場地及用處Article1LeasePlaceandPurpose1.詳細(xì)位置:Location:2.用處:用于乙方舉辦活動。Purpose:tousefortheactivitiesofbyPartyB.第二條租賃期限Article2TermofLease1.租賃期限為:至;第三條使用時限Article3TimeLimitedofUse1.乙方使用租賃區(qū)域的時限為時至?xí)r。在租賃期限內(nèi),乙方應(yīng)在約定的時限內(nèi)使用租賃區(qū)域;如乙方需在約定時限之外使用租賃區(qū)域的,應(yīng)提早征得甲方同意并向甲方支付超時使用費,超時費用按照方式計算。PartyBwillusetheleaseareafrom‘clockto’clock.Withinthetermoflease,PartyBshallusetheleaseareawithinthestipulatedtime,andshallobtainPartyA‘sapprovalinpriorandpayovertimeusefeetoPartyAincasePartyBusestheleaseareabeyondthestipulatedtime.第四條租金支付Article4RentalPayment1.租金的計算按照以下標(biāo)準(zhǔn)計算:Therentalshallbecalculatedas:2.租金預(yù)付PrepaymentofRental3.定金:甲方在前向乙方支付定金元〔最高不得超過總價款〔20%〕。Earnestmoney:PartyAshallpayPartyBtheearnestmoneyof〔notmorethan20%ofthetotalcontractpriceatmost〕before.預(yù)付款:甲方在前向乙方支付預(yù)付款元。Advancepayment:PartyAshallpayPartyBtheadvancepaymentofbefore4余款支付:Paymentofremainingmoney:5支付方式:Paymentmethod:第五條甲方提供的根本效勞Article5BasicServicesProvidedbyPartyA1.在租賃期限內(nèi)甲方向乙方提供以下根本效勞:PartyAwillprovidePartyBwiththefollowingbasicserviceswithinthetermoflease:〔1〕租賃區(qū)域和公共區(qū)域的原建筑照明。Lightingoftheoriginalbuildingsintheleaseareaandpublicarea;〔2〕15-20名效勞人員。15-20waiter;〔3〕音響系統(tǒng)及燈光系統(tǒng)AcousticsystemandLightingsystem;〔4〕其他:提供DJ一名Otherstipulations:SupplyaDJforLessee;2.如乙方需甲方提供根本效勞之外的其他效勞,雙方應(yīng)另行達(dá)成補充協(xié)議。AsupplementagreementshallbeenteredintobetweenthePartiesincasePartyBneedsotherservicesprovidedbyPartyAinadditiontobasicservices.第六條設(shè)施的使用Article6UseofFacilities1.甲方應(yīng)在簽約前向乙方如實說明與租賃區(qū)域有關(guān)的場地情況,并向乙方提供場地設(shè)施技術(shù)數(shù)據(jù)等書面資料。乙方應(yīng)向甲方如實說明會展情況,并根據(jù)甲方提供的數(shù)據(jù)資料判斷場地是否滿足會展需求。PartyAshallprovidetrueinformationregardingsituationoftheleaseareatoPartyBbeforesigningtheContract,togetherwithwrittenmaterialsincludingon-sitefacilitiesandtechnicaldata.PartyBshallprovidetrueinformationoftheexhibitiontoPartyA,andtojudgeiftheplacecouldmeettheexhibitionrequirementsinaccordancewiththedatamaterialsprovidedbyPartyA.甲方未如實提供場地、設(shè)施的有關(guān)情況而造成乙方辦展活動無法順利進(jìn)展的,應(yīng)賠償由此給乙方造成的損失;乙方未如實說明展品情況,造成場地設(shè)施無法滿足展品需要的,乙方自行承當(dāng)損失,造成甲方場地設(shè)施損壞的,應(yīng)承當(dāng)賠償責(zé)任。IncasePartyAfailstoprovidetrueinformationoftheplaceandfacilities,whichcausesPartyBafailureintheexhibition,PartyAshallpensatePartyBforanylossincurred;PartyBshallbearthelossifPartyBfailstostateclearlythesituationofexhibitssothatthesitefacilitiescouldnotmeettheneeds,andshallundertaketheliabilityofpensationincaseofdamagetoPartyA‘sfacilities.2.甲方協(xié)助乙方進(jìn)展展臺搭建、安裝、拆卸、搬遷及善后等工作。乙方進(jìn)展上述活動時不應(yīng)阻礙甲方場地內(nèi)的其他展覽和活動。PartyAmayassistPartyBwithbuilding,installation,dismantling,removingoftheboothandafter-treatmentatitsowncost,whichshallnotinterferewithotherexhibitionsandactivitiesinsidePartyA‘splace.3.在租賃期限內(nèi),雙方應(yīng)共同保持租賃區(qū)域和公共區(qū)域的清潔和暢通。Withinthetermoflease,thePartiesshalltogetherkeeptheleaseareaandpublicareacleanandunobstructed.4.如無甲方書面特別答應(yīng),以下物品制止進(jìn)入甲方場館:ThefollowingarticlesshallnotbeallowedintoPartyA‘splacewithoutPartyA’sspecialpermissioninwriting:〔1〕危險物,包括但不限于武器、、刀、劍、彈藥、易燃物、放射物或其他危險物品。Dangerousarticlesincludingbutnotlimitedtoanyweapon,gun,knife,sword,cartridge,explosiveflammablearticles,radioactivearticlesorotherdangerousarticles.〔2〕未經(jīng)海關(guān)同意的進(jìn)口物品。ImportedgoodswithouttheCustoms‘permission.〔3〕任何影響甲方正常運作或被有關(guān)部門制止的物品。AnyarticleaffectingnormaloperationofPartyAorforbiddenbyrelevantauthorities.第七條甲方權(quán)利義務(wù)Article7RightsandObligationsofPartyA1.甲方有權(quán)監(jiān)視乙方在租賃期限內(nèi)遵守本合同約定及甲方的有關(guān)規(guī)章制度,并對乙方違背有關(guān)約定的行為予以制止。PartyAshallbeentitledtomonitorPartyB‘sacttoconformwithstipulationscontainedhereinandrelevantrulesandregulationsofPartyAwithinthetermoflease,andprohibitanyPartyB’sactagainstrelevantstipulations.2.甲方應(yīng)按約定為乙方提供場地及相關(guān)配套設(shè)施和經(jīng)營條件,保障乙方正常的會展活動。PartyAshallprovidetheplaceandrelevantsupportingfacilitiesandoperationconditionsasstipulatedtoensurethenormaloperationofexhibitionbyPartyB.3.除有明確約定外,甲方不得不干預(yù)乙方正常的會展活動。Exceptasotherwiseclearlystipulated,PartyAshallnotinterferewithPartyB‘snormalexhibitionactivities.4.甲方應(yīng)對市場進(jìn)展物業(yè)管理,并負(fù)責(zé)場內(nèi)的平安防范和經(jīng)營設(shè)施的建立及維護(hù)、包括:建筑物〔包括公共區(qū)域及租賃場地〕的管理及維修保養(yǎng);對乙方裝修的審查和監(jiān)視;水、電、氣、空調(diào)、電梯、扶梯等設(shè)備、管道、線路、設(shè)施及系統(tǒng)的管理、維修及保養(yǎng);清潔管理;保安管理并負(fù)責(zé)市場的公共平安;消防管理;內(nèi)外各種通道、道路、停車場的管理。PartyAshallconductpropertymanagementtothemarket,andtakechargeofsecurityinsidetheplaceandconstructionandmaintenanceofoperationfacilities,includingmanagement,repairandmaintenanceofbuildings〔includingthoseinpublicareaandleasearea〕,inspectingandmonitoringPartyB‘sdecoration,management,repairandmaintenanceofequipment,pipelines,lines,facilitiesandsystemsuchaswater,power,gas,airconditioning,escalators,andetc.,cleaningmanagement,securitymanagementandpublicsecurityofthemarket,fireprotectionmanagement,andmanagementofallpassageways,roadsandparkinglotsinsideandoutside.第八條乙方權(quán)利義務(wù)Article8RightsandObligationsofPartyB1.乙方應(yīng)按照約定用處使用甲方場地,自覺遵守甲方依法制訂的各項規(guī)章制度,服從甲方的監(jiān)視。PartyBshallusePartyB‘splaceforthepurposeasstipulatedandobservePartyA’srulesandregulationsestablishedinaccordancewithlawsandacceptPartyA‘ssupervision.2.乙方應(yīng)按合同約定及時支付甲方租金。PartyBshallpaytherentaltoPartyAintimeasstipulatedherein.3.乙方有責(zé)任維護(hù)租賃區(qū)域和公共區(qū)域的整潔。租賃期限屆滿,乙方應(yīng)按時把自己及參展商的所有物品〔展臺、展架、遺棄物以及垃圾〕移出租賃區(qū)域。有關(guān)物品未能按時移出的,甲方將視為遺棄物進(jìn)展處理。乙方也可以委托甲方對上述物品進(jìn)展清理,所需費用由乙方承當(dāng)。PartyBshallhavetheliabilitytomaintaintheleaseareaandpublicareainacleanstatus.Uponexpirationofthetermoflease,PartyBshallremoveallitsortheparticipatingexhibitors‘a(chǎn)rticlesforexhibition〔booth,display,derelictsandgarbage〕outoftheleasearea.Anyarticlethathasnotbeenremovedoutintimeshallbetreatedasderelicts.PartyBmayalsoentrustPartyAtotreattheabovearticlesatPartyB’scost.4.乙方應(yīng)合理使用場內(nèi)的各項設(shè)施,如需安裝設(shè)備、擺放展品、設(shè)置宣傳廣告等,應(yīng)先征得甲方同意,造成損壞的應(yīng)承當(dāng)修復(fù)或賠償責(zé)任。PartyBshallusefacilitiesinsidetheareainareasonableway,andshallobtainPartyA‘spriorpermissionincaseofneedforequipmentinstallation,exhibitsdisplayandpublicizingadvertisementsetup,andshallundertaketheliabilityforrepairorpensationtoanydamage.5.乙方保證自己和自己的客戶不會對甲方或甲方場所進(jìn)展的其他展覽會有任何攻擊、損害或干擾的不正當(dāng)競爭行為。PartyBshallpledgethatitoritscustomerswillnothaveanyunfairpetitionactssuchasattack,damageorinterferenceagainstPartyAorotherexhibitionsatPartyA‘splace.6.乙方負(fù)責(zé)對自己財產(chǎn)進(jìn)展妥善保管,并保證其展品或其他物品,將不占用或堆放在非租賃區(qū)域〔包括室外場地〕;否那么甲方有權(quán)予以處理,所需費用由乙方承當(dāng)。PartyBshallproperlykeepitsownproperties,andensureitsexhibitsorotherarticleswouldnotoccupyorpileupatthenon-leasearea〔includingoutdoorfield〕;otherwisePartyAshallbeentitledtohandlesuchexhibitsandarticlesatPartyB‘scost.7.乙方如為宣傳會展活動而需使用甲方名稱、商標(biāo)和標(biāo)識,應(yīng)事先獲得甲方書面同意,否那么乙方應(yīng)承當(dāng)由此產(chǎn)生的法律責(zé)任。PartyBshallobtainPartyA‘spriorapprovalincaseofneedsofusingPartyA’sname,trademarkandlogoforpublicizingtheexhibition;otherwisePartyBshallundertakethelegalliabilitiesincurredhereby.第九條違約責(zé)任Article9DefaultLiabilities1.甲方未按約定提供場地或用水、用電等市場內(nèi)的經(jīng)營設(shè)施或條件致使乙方不能正常經(jīng)營的,應(yīng)減收相應(yīng)租金,乙方有權(quán)要求甲方繼續(xù)履行合同或解除合同,并要求甲方賠償相應(yīng)的損失。IncasePartyAfailstoprovidetheplaceorwater,powerandotheroperationfacilitiesorconditionsinthemarket,whichcausesPartyBafailureinnormaloperation,PartyAshallreducetheamountofrental,andPartyBshallbeentitledtorequestPartyAtocontinuetoperformtheContractorterminatetheContract,andtopensateforrelevantloss.2.乙方未按照約定支付租金及其他費用的,應(yīng)每日向甲方支付遲延金額的%的違約金。IncasePartyBfailstopaytherentalandotherexpensesasstipulated,itshallpayPartyAtheliquidateddamagesasper%oftheamountnotdulypaidforeachdayoverdue.第十條爭議解決Article10SettlementofDisputes本合同項下發(fā)生的爭議,由雙方當(dāng)事人協(xié)商解決,或向有關(guān)部門申請調(diào)解解決;協(xié)商或調(diào)解解決不成的,按以下第種方式解決。AnydisputearisingfromorinconnectionwiththeContractshallbesettledbythePartiesthroughconsultation,ormaybesubmittedtorelevantdepartmentformediation;failingthesame,ofthefollowingwaysshallbeadopted.〔一〕依法向人民法院起訴;FilealawsuittoPeople‘sCourtinaccordancewithlaws;〔二〕提交仲裁委員會仲裁。SubmitthedisputetoArbitrationmitteeforarbitration.第十一條不可抗力Article11ForceMajeure因發(fā)生自然災(zāi)害、重大疫情等不可抗力或突發(fā)事件的,經(jīng)核實可全部或局部免除責(zé)任,但應(yīng)及時通知對方,并在合理期限內(nèi)提供有效證明。Incaseofanyforcemajeureoremergencysuchasnaturaldisastersandkeyepidemicsituations,liabilitiesmay,uponverification,beexemptedwhollyorpartly;however,itshallbenotifyedtotheotherpartyintimeandeffectivecertifyshallbeprovidedwithinareasonabletime.第十二條其他約定Article12Miscellaneous1.本合同經(jīng)雙方簽字蓋章后生效。TheContractshallbeeeffectiveuponsigningandsealingoftheParties.2.本合同正本一式二份,甲、乙方各執(zhí)一份。TheContractshallbeservedintwooriginals,PartyAholdingoneoriginalsandPartyBholdingone.3.本合同用中文英文書寫。兩種文本具有同等法律效力。如兩種文本有分歧,以中文文本為準(zhǔn)。任何修改須以書面形式并由雙方簽字同意。TheContractshallbemadeinbothChineseandEnglish,andtwoversionsshallhavethesamelegalforce.Incaseofanydiscrepancybetweenthetwoversions,theChineseversionshallprevail.AnymodificationtheretoshallbemadeinwritingandsignedbythePartiesforpermission.4.未盡事宜,雙方可另行以附件形式補充。附件由雙方簽字確認(rèn),與本合同具有同等效力。甲方〔簽章〕:PartyA〔Seal〕:乙方〔簽章〕:PartyA〔Seal〕:簽訂日期:Date:簽訂日期:Date:土地租賃合同英文出租方〔甲方〕Lessor〔hereinafterreferredtoasPartyA〕:承租方〔乙方〕Lessee〔hereinafterreferredtoasPartyB〕:根據(jù)國家有關(guān)法律、法規(guī)和有關(guān)規(guī)定,甲、乙雙方在平等自愿的根底上,經(jīng)友好協(xié)商一致,就甲方將其合法擁有的房屋出租給乙方使用,乙方承租使用甲方房屋事宜,訂立本合同。一、物業(yè)地址Locationofthepremises甲方將其所有的位于上海市_________區(qū)____________________________________的房屋及其附屬設(shè)施在良好狀態(tài)下出租給乙方___________使用。PartyAwillleasetoPartyBthepremisesandattachedfacilitiesallownedbyPartyAitself,whichislocatedat_________________________________________________________________andingoodconditionfor_____________.二、房屋面積Sizeofthepremises出租房屋的登記面積為_________平方米〔建筑面積〕。Theregisteredsizeoftheleasedpremisesis_________squaremeters〔Grosssize〕。三、租賃期限Leaseterm租賃期限自_______年___月___日起至_______年___月___日止,為期___年,甲方應(yīng)于_______年___月___日將房屋騰空并交付乙方使用。Theleasetermwillbefrom_____〔month〕_____〔day〕_______〔year〕to________〔month〕_____〔day〕_______〔year〕。PartyAwillclearthepremisesandprovideittoPartyBforusebefore_____〔month〕_____〔day〕_______〔year〕。四、租金Rental1.數(shù)額:雙方商定租金為每月人民幣_____________元整,乙方以___________形式支付給甲方.Amount:therentalwillbe____________permonth.PartyBwillpaytherentaltoPartyAintheformof____________in________________.2.租金按_____月為壹期支付;第一期租金于_______年_____月_____日以前付清;以后每期租金于每月的______日以前繳納,先付后住〔假設(shè)乙方以匯款形式支付租金,那么以匯出日為支付日,匯費由匯出方承當(dāng)〕。甲方收到租金后予書面簽收。Paymentofrentalwillbeoneinstallmenteverymonth〔s〕。Thefirstinstallmentwillbepaidbefore_______〔month〕______〔day〕__________〔year〕。Eachsuccessiveinstallmentwillbepaid_____________eachmonth.PartyBwillpaytherentalbeforeusingthepremisesandattachedfacilities〔IncasePartyBpaystherentalintheformofremittance,thedateofremittingwillbethedayofpaymentandtheremittancefeewillbebornebytheremitter.〕PartyAwillissueawrittenreceiptafterreceivingthepayment.3.如乙方逾期支付租金超過十天,那么每天以月租金的0.5%支付滯納金;如乙方逾期支付租金超過十五天,那么視為乙方自動退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。Incasetherentalismorethantenworkingdaysoverdue,PartyBwillpay0.5percentofmonthlyrentalasoverduefineeveryday,iftherentalbepaid15daysoverdue,PartyBwillbedeemedtohavewithdrawnfromthepremisesandbreachthecontract.Inthissituation,PartyAhastherighttotakebackthepremisesandtakeactionsagainstpartyB'sbreach.五、保證金Deposit1.為確保房屋及其附屬設(shè)施之平安與完好,及租賃期內(nèi)相關(guān)費用之如期結(jié)算,乙方同意于______年_____月_____日前支付給甲方保證金人民幣_________元整,甲方在收到保證金后予以書面簽收。Guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduringtheleaseterm,partyBwillpay_________topartyAasadepositbefore_____〔month〕_____〔day〕_______〔year〕。PartyAwillissueawrittenreceiptafterreceivingthedeposit.2.除合同另有約定外,甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點清并付清所有應(yīng)付費用后的當(dāng)天將保證金全額無息退還乙方。Unlessotherwiseprovidedforbythiscontract,PartyAwillreturnfullamountofthedepositwithoutinterestonthedaywhenthiscontractexpiresandpartyBclearsthepremisesandhaspaidallduerentalandotherexpenses.3.因乙方違背本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費用,甲方可在保證金中抵扣,缺乏局部乙方必須在接到甲方付款通知后十日內(nèi)補足。IncasepartyBbreachesthiscontract,partyAhasrighttodeductthedefaultfine,pensationfordamageoranyotherexpensesfromthedeposit.Incasethedepositisnotsufficienttocoversuchitems,PartyBshouldpaytheinsufficiencywithintendaysafterreceivingthewrittennoticeofpaymentfromPartyA.六、甲方義務(wù)ObligationsofPartyA1.甲方須按時將房屋及附屬設(shè)施〔詳見附件〕交付乙方使用。2.房屋設(shè)施如因質(zhì)量原因、自然損耗或災(zāi)害而受到損壞,甲方有修繕并承當(dāng)相關(guān)費用的責(zé)任。Incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesordisasters,PartyAwillberesponsibletorepairandpaytherelevantexpenses.3.甲方應(yīng)確保出租的房屋享有出租的權(quán)利,反之如乙方權(quán)益因此遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。PartyAwillguaranteetheleaserightofthepremises.Otherwise,PartyAwillberesponsibletopensatePartyB'slosses.七、乙方義務(wù)ObligationsofPartyB1.乙方應(yīng)按合同的規(guī)定按時支付定金、租金及保證金。PartyBwillpaytherental,thedepositandotherexpensesontime.2.乙方經(jīng)甲方同意,可在房屋內(nèi)添置設(shè)備。租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常使用。PartyBmaydecoratethepremisesandaddnewfacilitieswithPartyA'sapproval.Whenthiscontractexpires,PartyBmaytakeawaytheaddedfacilitieswhichareremovablewithoutchangingthegoodconditionsofthepremisesfornormaluse.3.未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并保護(hù)使用該房屋如因乙方過失或過錯致使房屋及設(shè)施受損,乙方應(yīng)承當(dāng)賠償責(zé)任。PartyBwillnottransfertheleaseofthepremisesorsubletitwithoutPartyA'sapprovalandshouldtakegoodcareofthepremises.Otherwise,PartyBwillberesponsibletopensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence.4.乙方應(yīng)按本合同規(guī)定合法使用該房屋,不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險物品。否那么,如該房屋及附屬設(shè)施因此受損,乙方應(yīng)承當(dāng)全部責(zé)任。PartyBwillusethepremiseslawfullyaccordingtothiscontractwithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.Otherwise,PartyBwillberesponsibleforthedamagescausedbyit5.乙方應(yīng)承當(dāng)租賃期內(nèi)的水、電、煤氣、電訊、收視費、等一切因?qū)嶋H使用而產(chǎn)生的費用,并按單如期繳納。PartyBwillbearthecostofutilitiessuchasmunications,water,electricity,gas,managementfeeetc.ontimeduringtheleaseterm.八、合同終止及解除的規(guī)定Terminationanddissolutionofthecontract1.乙方在租賃期滿后如需退租或續(xù)租,應(yīng)提早兩個月通知甲方,由雙方另行協(xié)商退租或續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。2.租賃期滿后,乙方應(yīng)在當(dāng)天將房屋交還甲方;任何滯留物,如未獲得甲方諒解,均視為放棄,聽?wèi){甲方處置,乙方?jīng)Q無異議。Whentheleasetermexpires,PartyBwillreturnthepremisesandattachedfacilitiestoPartyAwithindays.
