5、ajesty the King of Romania, His Majesty the King of the Serbs, Croats and Slovenes, His Majesty the King of Sweden, and the President of the Republic of Uruguay, HAVING RECOGNIZED the utility of fixing by agreement certain uniform rules of law relating to bills of lading, HAVE DECIDED to conclude a
6、convention with this object and have appointed the following Plenipotentiaries: WHO, duly authorized thereto, have agreed as follows:第一條 Article 1本公約所用下列各詞,涵義如下:In this Convention the following words are employed with the meanings set out below:(a) “承運(yùn)人”包括與托運(yùn)人訂有運(yùn)輸合同的船舶所有人或租船人。(a)Carrier includes the

8、in so far as such document relates to the carriage of goods by sea, including any bill of lading or any similar document as aforesaid issued under or pursuant to a charter party from the moment at which such bill of lading or similar document of title regulates the relations between a carrier and a

10、舶。(d)Ship means any vessel used for the carriage of goods by sea.“貨物運(yùn)輸”是指自貨物裝上船時(shí)起,至卸下船時(shí)止的一段期間。(e)Carriage of goods covers the period from the time when the goods are loaded on to the time they are discharged from the ship.第二條 Article 2除遵照第六條規(guī)定外,每個(gè)海上貨物運(yùn)輸合同的承運(yùn)人,對(duì)有關(guān)貨物的裝載、搬運(yùn)、積載、運(yùn)送、保管、照料和卸載,都應(yīng)按照下列規(guī)定承擔(dān)責(zé)任和
11、義務(wù),并享受權(quán)利和豁免。Subject to the provisions of Article 6, under every contract of carriage of goods by sea the carrier, in relation to the loading, handling, stowage, carriage, custody, care and discharge of such goods, shall be subject to the responsibilities and liabilities, and entitled to the rights a
12、nd immunities hereinafter set forth.第三條 Article 31承運(yùn)人須在開(kāi)航前和開(kāi)航時(shí)謹(jǐn)慎處理:1.The carrier shall be bound before and at the beginning of the voyage to exercise due diligence to:(a)使船舶適航;(a)Make the ship seaworthy. (b) 適當(dāng)?shù)嘏鋫浯瑔T、裝備船舶和供應(yīng)船舶;(b)Properly man, equip and supply the ship.(c) 使貨艙、冷藏艙和該船其他載貨處所能適宜和安全地收受、運(yùn)
13、送和保管貨物。(c)Make the holds, refrigerating and cool chambers, and all other parts of the ship in which goods are carried, fit and safe for their reception, carriage and preservation.2除遵照第四條規(guī)定外,承運(yùn)人應(yīng)適當(dāng)和謹(jǐn)慎地裝卸、搬運(yùn)、積載、運(yùn)送、保管、照料和卸載所運(yùn)貨物。2.Subject to the provisions of Article 4, the carrier shall properly and ca
14、refully load, handle, stow, carry, keep, care for, and discharge the goods carried.3承運(yùn)人或船長(zhǎng)或承運(yùn)人的代理人在收受貨物歸其照管后,經(jīng)托運(yùn)人的請(qǐng)求,應(yīng)向托運(yùn)人簽發(fā)提單,其上載明下列各項(xiàng):3.After receiving the goods into his charge the carrier or the master or agent of the carrier shall, on demand of the shipper, issue to the shipper a bill of lading
15、 showing among other things:(a) 與開(kāi)始裝貨前由托運(yùn)人書(shū)面提供者相同的、為辨認(rèn)貨物所需的主要標(biāo)志,如果這項(xiàng)標(biāo)志是以印戳或其他方式標(biāo)示在不帶包裝的貨物上,或在其中裝有貨物的箱子或包裝物上,該項(xiàng)標(biāo)志通常應(yīng)在航程終了時(shí)仍能保持清晰可認(rèn)。(a)The leading marks necessary for identification of the goods as the same are furnished in writing by the shipper before the loading of such goods starts, provided such
16、marks are stamped or otherwise shown clearly upon the goods if uncovered, or on the cases or coverings in which such goods are contained, in such a manner as should ordinarily remain legible until the end of the voyage.(b) 托運(yùn)人用書(shū)面提供的包數(shù)或件數(shù),或數(shù)量,或重量。(b)Either the number of packages or pieces, or the qua

18、o state or show in the bill of lading any marks, number, quantity, or weight which he has reasonable ground for suspecting not accurately to represent the goods actually received, or which he has had no reasonable means of checking.4依照第3款(a)、(b)、(c)項(xiàng)所載內(nèi)容的這樣一張?zhí)釂?,?yīng)作為承運(yùn)人收到該提單中所載貨物的初步證據(jù)。4. Such a bill o

The shipper shall be deemed
20、to have guaranteed to the carrier the accuracy at the time of shipment of the marks, number, quantity and weight, as furnished by him, and the shipper shall indemnity the carrier against all loss, damages and expenses arising or resulting from inaccuracies in such particulars. The right of the carri
21、er to such indemnity shall in no way limit his responsibility and liability under the contract of carriage to any person other than the shipper.6在將貨物移交給根據(jù)運(yùn)輸合同有權(quán)收貨的人之前或當(dāng)時(shí),除非在卸貨港將貨物的滅失和損害的一般情況,已用書(shū)面通知承運(yùn)人或其代理人,則這種移交應(yīng)作為承運(yùn)人已按照提單規(guī)定交付貨物的初步證據(jù)。6. Unless notice of loss or damage and the general nature of such
22、loss or damage be given in writing to the carrier or his agent at the port of discharge before or at the time of the removal of the goods into the custody of the person entitled to delivery thereof under the contract of carriage, or, if the loss or damage be not apparent, within three days, such rem

25、ess suit is brought within one year after delivery of the goods or the date when the goods should have been delivered. 遇有任何實(shí)際的或推定的滅失或損害,承運(yùn)人與收貨人必須為檢驗(yàn)和清點(diǎn)貨物相互給予一切合理便利。In the case of any actual or apprehended loss or damage the carrier and the receiver shall give all reasonable facilities to each other
26、for inspecting and tallying the goods.7貨物裝船后,如果托運(yùn)人要求,簽發(fā)“已裝船”提單,承運(yùn)人、船長(zhǎng)或承運(yùn)人的代理人簽發(fā)給托運(yùn)人的提單,應(yīng)為“已裝船”提單,如果托運(yùn)人事先已取得這種貨物的物權(quán)單據(jù),應(yīng)交還這種單據(jù),換取“已裝船”提單。但是,也可以根據(jù)承運(yùn)人的決定,在裝貨港由承運(yùn)人、船長(zhǎng)或其代理人在上述物權(quán)單據(jù)上注明裝貨船名和裝船日期。經(jīng)過(guò)這樣注明的上述單據(jù),如果載有第三條第3款所指項(xiàng)目,即應(yīng)成為本條所指的“已裝船”提單。7.After the goods are loaded the bill of lading to be issued by the ca
27、rrier, master, or agent of the carrier, to the shipper shall, if the shipper so demands, be a shipped bill of lading, provided that if the shipper shall have previously taken up any document of title to such goods, he shall surrender the same as against the issue of the shipped bill of lading, but a
28、t the option of the carrier such document of title may be noted at the port of shipment by the carrier, master, or agent with the name or names of the ship or ships upon which the goods have been shipped and the date or dates of shipment, and when so noted, if it shows the particulars mentioned in p
29、aragraph 3 of Article 3, shall for the purpose of this Article be deemed to constitute a shipped bill of lading.8運(yùn)輸合同中的任何條款、約定或協(xié)議,凡是解除承運(yùn)人或船舶對(duì)由于疏忽、過(guò)失或未履行本條規(guī)定的責(zé)任和義務(wù),因而引起貨物或關(guān)于貨物的滅失或損害的責(zé)任的,或以下同于本公約的規(guī)定減輕這種責(zé)任的,則一律無(wú)效。有利于承運(yùn)人的保險(xiǎn)利益或類似的條款,應(yīng)視為屬于免除承運(yùn)人責(zé)任的條款。8.Any clause, covenant, or agreement in a contract of ca
30、rriage relieving the carrier or the ship from liability for loss or damage to, or in connexion with, goods arising from negligence, fault, or failure in the duties and obligations provided in this Article or lessening such liability otherwise than as provided in this Convention, shall be null and vo
31、id and of no effect. A benefit of insurance in favour of the carrier or similar clause shall be deemed to be a clause relieving the carrier from liability.第四條 Article 41不論承運(yùn)人或船舶,對(duì)于因不適航所引起的滅失或損壞,都不負(fù)責(zé),除非造成的原因是由于承運(yùn)人未按第三條第1款的規(guī)定,克盡職責(zé);使船舶適航;保證適當(dāng)?shù)嘏鋫浯瑔T、裝備和供應(yīng)該船,以及使貨艙、冷藏艙和該船的其它裝貨處所能適宜并安全地收受、運(yùn)送和保管貨物。凡由于船舶不適航所引
32、起的滅失和損害,對(duì)于已克盡職責(zé)的舉證責(zé)任,應(yīng)由根據(jù)本條規(guī)定要求免責(zé)的承運(yùn)人或其他人承擔(dān)。1.Neither the carrier nor the ship shall be liable for loss or damage arising or resulting from unseaworthiness unless caused by want of due diligence on the part of the carrier to make the ship seaworthy and to secure that the ship is properly manned, equ
33、ipped and supplied, and to make the holds, refrigerating and cool chambers and all other parts of the ship in which goods are carried fit and safe for their reception, carriage and preservation in accordance with the provisions of paragraph 1 of Article 3. Whenever loss or damage has resulted from u
34、nseaworthiness the burden of proving the exercise of due diligence shall be on the carrier or other person claiming exemption under this Article.2不論承運(yùn)人或船舶,對(duì)由于下列原因引起或造成的滅失或損壞,都不負(fù)責(zé):2.Neither the carrier nor the ship shall be responsible for loss or damage arising or resulting from:(a)船長(zhǎng)、船員、引水員或承運(yùn)人的雇傭人

36、ngers and accidents of the sea or other navigable waters.(d)天災(zāi);(d)Act of God.(e)戰(zhàn)爭(zhēng)行為;(e)Act of war.(f)公敵行為;(f)Act of public enemies.(g)君主、當(dāng)權(quán)者或人民的扣留或管制,或依法扣押;(g)Arrest or restraint or princes, rulers or people, or seizure under legal process.(h)檢疫限制;(h)Quarantine restrictions.(i)托運(yùn)人或貨主、其代理人或代表的行為或不行為
37、;(i)Act or omission of the shipper or owner of the goods, his agent or representative.(j)不論由于任何原因所引起的局部或全面罷工、關(guān)廠停止或限制工作;(j)Strikes or lockouts or stoppage or restraint of labour from whatever cause, whether partial or general.(k)暴動(dòng)和騷亂;(k)Riots and civil commotions.(l)救助或企圖救助海上人命或財(cái)產(chǎn);(l)Saving or attem
38、pting to save life or property at sea.(m)由于貨物的固有缺點(diǎn)、質(zhì)量或缺陷引起的體積或重量虧損,或任何其它滅失或損壞;(m)Wastage in bulk or weight or any other loss or damage arising from inherent defect, quality or vice of the goods.(n)包裝不充分;(n)Insufficiency of packing.(o)標(biāo)志不清或不當(dāng);(o)Insufficiency or inadequacy of marks.(p)雖克盡職責(zé)亦不能發(fā)現(xiàn)的潛在缺點(diǎn)
39、;(p)Latent defects not discoverable by due diligence.(q)非由于承運(yùn)人的實(shí)際過(guò)失或私謀,或者承運(yùn)人的代理人,或雇傭人員的過(guò)失或疏忽所引起的其它任何原因;但是要求引用這條免責(zé)利益的人應(yīng)負(fù)責(zé)舉證,證明有關(guān)的滅失或損壞既非由于承運(yùn)人的實(shí)際過(guò)失或私謀,亦非承運(yùn)人的代理人或雇傭人員的過(guò)失或疏忽所造成;(q)Any other cause arising without the actual fault or privity of the carrier, or without the actual fault or neglect of the ag
40、ents or servants of the carrier, but the burden of proof shall be on the person claiming the benefit of this exception to show that neither the actual fault or privity of the carrier nor the fault or neglect of the agents or servants of the carrier contributed to the loss or damage.3.對(duì)于任何非因托運(yùn)人、托運(yùn)人的代
41、理人或其雇傭人員的行為、過(guò)失或疏忽所引起的使承運(yùn)人或船舶遭受的滅失或損壞,托運(yùn)人不負(fù)責(zé)任。3.The shipper shall not be responsible for loss or damage sustained by the carrier or the ship arising or resulting from any cause without the act, fault or neglect of the shipper, his agents or his servants.4.為救助或企圖救助海上人命或財(cái)產(chǎn)而發(fā)生的繞航,或任何合理繞航,都不能作為破壞或違反本公約或運(yùn)
42、輸合同的行為;承運(yùn)人對(duì)由此而引起的任何滅失或損害,都不負(fù)責(zé)。4.Any deviation in saving or attempting to save life or property at sea or any reasonable deviation shall not be deemed to be an infringement or breach of this Convention or of the contract of carriage, and the carrier shall not be liable for any loss or damage resultin
43、g therefrom.5.承運(yùn)人或是船舶,在任何情況下對(duì)貨物或與貨物有關(guān)的滅失或損害,每件或每計(jì)費(fèi)單位超過(guò)一百英鎊或與其等值的其他貨幣的部分,都不負(fù)責(zé);但托運(yùn)人于裝貨前已就該項(xiàng)貨物的性質(zhì)和價(jià)值提出聲明,并已在提單中注明的,不在此限。5.Neither the carrier nor the ship shall in any event be or become liable for any loss or damage to or in connexion with goods in an amount exceeding 100 pounds sterling per package o
44、r unit, or the equivalent of that sum in other currency unless the nature and value of such goods have been declared by the shipper before shipment and inserted in the bill of lading.該項(xiàng)聲明如經(jīng)載入提單,即作為初步證據(jù),但它對(duì)承運(yùn)人并不具有約束力或最終效力。This declaration if embodied in the bill of lading shall be prima facie evidenc

48、of the carrier, master or agent of the carrier has not consented with knowledge of their nature and character, may at any time before discharge be landed at any place, or destroyed or rendered innocuous by the carrier without compensation and the shipper of such goods shall be liable for all damage
49、and expenses directly or indirectly arising out of or resulting from such shipment. If any such goods shipped with such knowledge and consent shall become a danger to the ship or cargo, they may in like manner be landed at any place, or destroyed or rendered innocuous by the carrier without liabilit
50、y on the part of the carrier except to general average, if any.第五條Article 5承運(yùn)人可以自由地全部或部分放棄本公約中所規(guī)定的他的權(quán)利和豁免,或增加他所應(yīng)承擔(dān)的任何一項(xiàng)責(zé)任和義務(wù)。但是這種放棄或增加,須在簽發(fā)給托運(yùn)人的提單上注明。A carrier shall be at liberty to surrender in whole or in part all or any of his rights and immunities or to increase any of his responsibilities and
51、obligations under this Convention, provided such surrender or increase shall be embodied in the bill of lading issued to the shipper.本公約的規(guī)定,不適用于租船合同,但如果提單是根據(jù)租船合同簽發(fā)的,則上述提單應(yīng)符合本公約的規(guī)定。本公約中的任何規(guī)定,都不得妨礙在提單中加注有關(guān)共同海損的任何合法條款。The provisions of this Convention shall not be applicable to charter parties, but if
52、bills of lading are issued in the case of a ship under a charter party they shall comply with the terms of this Convention. Nothing in these rules shall be held to prevent the insertion in a bill of lading of any lawful provision regarding general average. 第六條Article 6雖有前述各條規(guī)定,只要不違反公共秩序,承運(yùn)人、船長(zhǎng)或承運(yùn)人的代

54、in regard to any particular goods be at liberty to enter into any agreement in any terms as to the responsibility and liability of the carrier for such goods, and as to the rights and immunities of the carrier in respect of such goods, or his obligation as to seaworthiness, so far as this stipulatio
55、n is not contrary to public policy, or the care or diligence of his servants or agents in regard to the loading, handling, stowage, carriage, custody, care and discharge of the goods carried by sea, provided that in this case no bill of lading has been or shall be issued and that the terms agreed sh
56、all be embodied in a receipt which shall be a non-negotiable document and shall be marked as such.這樣訂立的任何協(xié)議,都具有完全的法律效力。Any agreement so entered into shall have full legal effect.但本條規(guī)定不適用于依照普通貿(mào)易程序成交的一般商業(yè)貨運(yùn),而僅在擬裝運(yùn)的財(cái)物的性質(zhì)和狀況,或據(jù)以進(jìn)行運(yùn)輸?shù)沫h(huán)境、條款和條件,有訂立特別協(xié)議的合理需要時(shí),才能適用。Provided that this Article shall not apply
