11、,第七條 費用雙方商定，本合同的設計費為_萬元。收費依據(jù)和計算方法按國家和地方有關規(guī)定執(zhí)行，國家和地方?jīng)]有規(guī)定的，由雙方商定。如果上述費用為估算設計費，則雙方在初步設計審批后，按批準的初步設計概算核算設計費。工程建設期間如遇概算調整，則設計費也應做相應調整。Article 7 Charges The Parties agree that charges for the design hereunder shall be % of the total investment of the transformer (the appraised price of this contract shall

12、 be taken as basis). The basis for charges and the method of computing shall be in accordance with relevant national and local provisions. Where there are no relevant national and local provisions, it shall be discussed and determined by the Parties.第八條 支付方式本合同生效后三天內(nèi)，發(fā)包人支付設計費總額的20%，計_萬元作為定金（合同結算時，定金

13、低作設計費）。設計人提交_設計文件后三天內(nèi)，發(fā)包人支付設計總額的30%，計_萬元；之后，發(fā)包人應按設計人所完成的施工圖工作量比例，分期分批向設計人支付總設計費的20%，計_萬元，施工圖完成后，發(fā)包人結清設計費，不留尾款。雙方委托銀行代付代收有關費用。Article 8 Terms of payment Within three days upon the effectiveness of this contract, the Employer shall pay 1% of RMB 1,800,000yuan, the appraised price of investment to the

14、transformer, namely RMB1,8000 yuan as the down payment.( the down payment shall be counted as the charges for design upon settlement of the contract). The Designer shall submit eight sets of design documents to Party A for submission to the power supply department and the Employer will pay % of RMB

15、1,800,000yuan, the appraised price of investment to the transformer, namely RMB 6,3000 yuan, without any remainder. The Parties shall entrust bank to collect and pay for relevant charges.第九條 雙方責任發(fā)包人責任發(fā)包人按本合同第五條規(guī)定的內(nèi)容，在規(guī)定的時間內(nèi)向設計人提交基礎資料及文件，并對其完整性、正確性及時限負責。發(fā)包人不得要求設計人違反國家有關標準進行設計。發(fā)包人提交上述資料及文件超過規(guī)定期限15天以內(nèi)，

16、設計人按本合同第六條規(guī)定的交付設計文件時間順延；發(fā)包人交付上述資料及文件超過規(guī)定期限15天以上時，設計人有權重新確定提交設計文件的時間。Article 9 Responsibilities of the Parties Responsibilities of the Employer The Employer shall submit to Designer basic materials and documents withinspecified period as provided in Article 5 of this contract and shall be responsible

17、 for the completeness, accuracy and time limit of the materials and documents. The Employer shall not require the Designer to conduct design in violation of relevant national standards. In case there is a delay of less than 15 days exceeding the specified time limit for the delivery of the above mat

18、erials and documents by the Employer, the time limit for the Designer to deliver design documents shall be extended accordingly; in case there is a delay of more than 15 days exceeding the specified time limit for the delivery of the above materials and documents by the Employer, the Designer shall

19、have the right to re-determine the time for delivery of the design documents.發(fā)包人變更委托設計項目、規(guī)模、條件或因提交的資料錯誤，或所提交資料作較大修改，以致造成設計人設計返工時，雙方除另行協(xié)商簽訂補充協(xié)議（或另訂合同）、重新明確有關條款外，發(fā)包人應按設計人所耗工作量向設計人支付返工費。在未簽訂合同前發(fā)包人已同意，設計人為發(fā)包人所做的各項設計工作，發(fā)包人應支付相應設計費。 In case of the Designers rework on the design resulted for changes of the

20、 engineering, size and conditions of the design by the Employer or mistakes of the materials submitted or major revision on the submitted materials, the Parties shall conclude supplementary agreement separately (or conclude additional agreement) and redefine relevant terms and conditions, and the Em

21、ployer should pay charges for rework to the Designer according to the workload.The Employer has agreed before the conclusion of the contract that it will pay charges of design to the Designer for all the design works conducted by the Designer.在合同履行期間，發(fā)包人要求終止或解除合同，設計人未開始設計工作的，不退還發(fā)包人已付的定金；已開始設計工作的，發(fā)包人

22、應根據(jù)設計人已進行的實際工作量，不足一半時，按該階段設計費的一半支付；超過一半時，按該階段設計費的全部支付。 During the performance of the contract, if the Employer requires to terminate or cancel the contract before the Designer starts the design work, the Designer will not return the down payment already paid by the Employer; if the Designer has star

23、ted the design work, the Employer shall pay for the actual workload already done by the Designer. When the actual workload of the design is less than half of the work at the stage, the Employer shall pay half of the payment for the design work at the stage. When the actual workload of the design is

24、more than half of the work at the stage, the Employer shall pay all the payment for the design work at the stage.發(fā)包人必須按合同規(guī)定支付定金，收到定金作為設計人設計開工的標志。未收到定金，設計人有權推遲設計工作的開工時問，且交付文件的時間順延。 The Employer should pay down payment as provided by the contract and receipt of down payment will be the symbol for the

25、commencement of the design work by the Designer. The Designer shall have the right to put off the commencement date of the design work if it has not received the down payment and the time for delivery shall be extended accordingly.發(fā)包人應按本合同規(guī)定的金額和日期向設計人支付設計費，每逾期支付一天，應承擔應支付金額千分之二的逾期違約金，且設計人提交設計文件的時間順延。

26、逾期超過30天以上時，設計人有權暫停履行下階段工作，并書面通知發(fā)包人。發(fā)包人的上級或設計審批部門對設計文件不審批或本合同項目停緩建，發(fā)包人均應支付應付的設計費。 The Employer should pay charges for design to the Designer at the amount and date provided in this Contract. Where the delay of payment has exceeded 30 days, the Designer shall have the right to suspend the performance of the work at the next stage and give written notice to the Employer. In case the higher authority or competent department

28、of design approval would not approve the design documents or the engineering construction of this contract is suspended or stopped, the Employer should pay the payable charges for design.發(fā)包人要求設計人比合同規(guī)定時間提前交付設計文件時，須征得設計人同意，不得嚴重背離合理設計周期，且發(fā)包人應支付趕工費。發(fā)包人應為設計人派駐現(xiàn)場的工作人員提供工作、生活及交通等方面的便利條件及必要的勞動保護裝備。設計文件中選用的國

The Employer should offer conveniences in
